OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO
RECOMMENDING A MODIFICATION OF CONDITIONS OF APPROVAL
FOR TENTATIVE MAP 8-TM-76 RELATED TO BUILDING SITE
LOCATION, BUILDING DESIGN, GRADING AND A PEDESTRIAN
AND EQUESTRIAN EASEMENT.

LOCATION: Southerly of and at the westerly terminus of Rainbow Drive
approximately 400' westerly of Bubb Road.

The condition of approval for said tentative map listed in Planning Commission
Resolution 1581, as modified by the City Council and described in the City
:lerk's letter of December 7, 1976, is modified as follows:
• COND ITIONS :
1-14. Standard Conditions to the extent that they do not conflict with the
special conditions enumerated herein. In the event a conflict does exist,
the special conditions as enumerated herein shall apply.
L5. The approval is granted based upon Tentative tap Exhibit A, 2nd Revision,
and B, 3rd Revision, as may be modified by additional conditions herein.
L6. The grading plan and location of public streets and private roadways
shall substantially reflect the Tentative Map Exhibit B, 3rd Revision.
17. With the exception of the lots listed below, residential dwellings
and accessory buildings shall be located within the building envelopes
defined in Exhibit B, 3rd Revision. Fence locations shall be determined
by Section 8.7 of the Hillside Residential Slope Density Zoning Ordinance.
If a conflict exists between the building envelope and setbacks
established by the Hillside Residential Zone, said zoning regulations
shall prevail.
Lots 5,6,7,17,18,19,20, and 21 are restricted to the building envelopes
described on Exhibit B, 2nd Revision with a provision that each envelope
is expanded 20 feet in each direction.
If a lot owner deserves to expand beyond the approved building envelope,
he or she may file a request for expansion 'aith the Planning Commission.
Said request will be heard as an "Unfinished Business" item on a Planning
Commission agenda.
18. The grading for dwellin¢s, vehicular turn -around, and private 4riv ways
shall be regulated by the technical provisions of the grading ordinance
and the following design standard pertaining to aesthetics:
a. In general, grading shall be geographically limited to include
a reasonable flat area for residential structure(s), driveway and

emergency vehicular circulation space, and a limited area to accommo-
date private recreation facilities such as a pool.
b. Cut and fill slopes shall be contoured into the natural terrain
through slope rounding. Fill slopes shall be kept to an absolute
minimum.
C. The subdivision applicant and subsequent building permit applicant
shall retain a registered landscape architect to review grading
plans and submit a plan to plant slopes to prevent soil erosion
and to visually screen grading impacts. The plant material should
be indigenous and shall be in conformance with provisions of the
Uniform Fire Code.
The grading policy shall be reviewed and approved by the Directors
of Public Works and Planning and Development. A property owner
• may appeal a decision to the Planning Commission, and said appeal
would be heard as an "Unfinished Business" Item on a Planning Commission
meeting agenda.
19. A turn -around area for emergency vehicles shall be provided at the
Intersection of private driveways for Parcels 2 and 3, 4 and 5, and
20 and 21. A turn -around shall also be provided for Lot 17. Said
turn -grounds shall be reviewed by the Central Fire District and
approved by the Directors of Public Works and Planning and Development.
20. The City's geological consultant shall review each building permit
application to determine whether additional geological reports are
required over and above the original report prepared for the subdivision.
The need for additional geological (and soils) Investigations are
required as a result of the additional flexibility in the building site
• Location.
2L. Conditions 19, 25, 26, 27 and 28 of Planning Commission Resolution L581
have been implemented and are therefore not reiterated in this revised
set of conditions.

PASSED AND ADOPTED this 14th day of May, 1980, at a regular meeting of the
Planning Commission of the City of Cupertino, State of California, by the
