OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO
RECOMMENDING AN AMENDMENT TO TENTATIVE MAP APPLICATION
411 7-TM-76 TO SUBDIVIDE 8.5 ACRES INTO 106 SINGLE-FAMILY,
RESIDENTIAL CLUSTER LOTS WITH ONE LOT TO BE HELD IN
COMMON OWNERSHIP

CONDITIONS:
1-14. Standard Conditions to the extent that they do not conflict with the
special conditions enumerated herein. In the event a conflict does
exist, the special conditions as enumerated herein shall apply.
15. The approval is based on Exhibit A - Amendment of Application 7-TM-76.
16... That because this application is simply an amendment to the previousl3f
approved Application 7-TM-76, all those conditions enumerated on
Application 7-TM-76 as listed in Resolution No. 1512 of the Planning
Commission and the additional conditions imposed by the City Council
requiring that an 8 ft, fence is to be constructed on the west side
of the property, and that appropriate fees will be paid in lieu of
'dedication of land, shall continue to be applicable to this property.
17. That all of the common area outlined in Phase 1 and all of the perimeter
landscaping along North De Anza Boulevard, Homestead Road and the northern
property line, shall be installed with Phase 1 of the development. Addi-
tionally, all roadway dedication and improvements for the entire develop-
ment shall be installed in conjunction with Phase 1.

18. That the City Engineer shall determine phasing of utilities in order to
properly service the site.
PASSED AND ADOPTED this 13th day of September, 1976, at a regular meeting of
the Planning Commission of the City of Cupertino; State of California, by the
following roll call vote:

RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO RECOMMENDING
THE APPROVAL OF A TENTATIVE MAP
WHEREAS, the attached application has been submitted to the City of Cupertino
requesting approval of a tentative map; and
WHEREAS, the Planning Commission has held at least one public hearing in
regard to the application; and
WHEREAS, the Planning Commission has duly considered and heard all evidence
submitted in regard to said application; and
WHEREAS, the necessary public notices have been given as required by the
subdivision and procedural ordinances of the City of Cupertino.
NOW, THEREFORE, BE IT RESOLVED:
1. That the Planning Commission makes the following findings:
a) That the proposed map is consistent with the general and specific
plans.
b) That the design or improvement of the proposed subdivision is
consistent with the general and specific plans.
c) That the site is physically suitable for the type of development.
d) That the site is physically suitable for the proposed density of
development.
e) That the design of the subdivision or the proposed improvements are
not likely to cause substantial environmental damage or substantially
and avoidably injure fish or wildlife or their habitat.
f) That the design of the subdivision or the type of improvements are
not likely to cause serious public health problems.
g) That the design of the subdivision or the type of improvements will
not conflict with easements, acquired by the public at large, for
access through or use of, property within the proposed subdivision.
