Reso 1835 7-Ti1-78 RESOLUTION NO. 1835 OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO RECOMMENDING APPROVAL OF A TENTATIVE MAP TO LEGALIZE A ONE-HALF ACRE Ilk PARCEL THROUGH THE CREATION OF A "ONE LOT SUBDIVISION" PER THE PROVISION OF SECTION 18.04.060 OF THE CUPERTINO MUNICIPAL CODE. APPLICANT: George Savage & Leon Frangadakis ADDRESS: 10383 Torre Avenue, Suite, J, Cupertino , California 95014 SUBMITTED: March. 7, 1978 LOCATION: North side of Pacifica Drive approximately 300 ft. easterly of the intersection with South De Anza Boulevard Approval is recommended subject to the findings as set forth on Page 1 and subconclusions as set forth in the minutes of the Planning Commission meeting of May 8, 1978. CONDITIONS: 1-14. Standard Conditions to the extent that they do not conflict with the special conditions enumerated herein. In the event a conflict does exist, the special conditions as enumerated herein shall apply. 15. That the approval is based upon Exhibit A of Application 7-TM-78 as may be modified by additional conditions contained herein. 16. That the applicant shall sign a statement agreeing to provide reciprocal ® ingress/egress easements with all of the adjoining properties at such time in the future the City can require the same of the adjoining property owners. The applicant/developer shall also agree to relocate the landscape islands located in the northern portion of the site, to ensure that they do not interfere with the planned reciprocal ingress/egress easements with the surrounding properties. 17. Prior to issuance of a building permit, the developer shall pay to the City the amount of $619.33 for reimbursement of underground electrical utilities put in with the Town Center in accordance with the action of the- City Council on August 16, 1965. NOW, THEREFORE, BE IT RESOLVED: 1. That the Planning Commission makes the following findings : a) That the proposed map is consistent with the general and specific 111 plans. b) That the design or improvement of the proposed subdivision is consistent with the general and specific plans. c) That the site is physically suitable for the type of development. d) That the site is physically suitable for the proposed density of development. e) That the design of the subdivision or the proposed improvements are not likely to cause substantial environmental damage or substantially and avoidably injure fish or wildlife or their habitat. f) That the design of the subdivision or the type of improvements are not likely to cause serious public health problems. g) That the design of the subdivision or the type of improvements will not conflict with easements, acquired by the public at large, for access through or use of, property within the proposed subdivision. 411 -1-
