ADDRESS : 164 Main Street, Los Altos , California SUBMITTED: February 10, 1978 LOCATION: Northwest corner of California Oak Way and Stevens Creek Boulevard Approval is recommended subject to the findings as set forth on Page 1 and subconclusions as set forth in the minutes of the Planning Commission meeting of April 17 , 1978. CONDITIONS: 1-14. Standard Conditions to the extent that they do not conflict with the special conditions enumerated herein. In the event a conflict does exist, the special conditions enumerated herein shall apply. 13. The approval is based upon Tentative Map Exhibits A 1st Revision and A-1 1st Revision of 6-TM--78 as may be amended by additional conditions contained here': 16. The street right of way and cross-sections for Stevens Creek Boulevard and California Oak shall reflect the approved street plan line for Stevens Creek Boulevard. ® 17 . The Architectural and Site Approval Committee shall review the final design and location of acoustical barriers on the Stevens Creek Boulevard and California Oak street frontage. The wall height and location shall comply with the acoustical attenuation recommendations contained within the Acoustical Consultants Inc . report dated February 23 , 1978. The Committee shall have the authority to make site design changes relative to sound wall placement which may result in minor (0-3 ' ) shifts in the location of private drives and building pads . 18 . The use of security gates for the development is optional. If security gates are to be installed, a turn-around space shall be provided external to the main gate. Additionally, the activating mechanism shall be re- viewed by the Central Fire District and Sheriff's Department prior to City approval. The homeowners association shall be responsible for long- term maintenance and liability in the case the activating device fails and the gate must be forceably opened. 19. A covenant shall be recorded running with the land as approved by the City Attorney which informs future lot purchasers of existing and future noise conditions resulting from external noise sources and further refer- encing the acoustical consultant 's report dated February 23 , 1978. -2- • CITY OF CUPERTINO 410 City Hall, 10300 Torre Avenue Cupertino, California 95014 Telephone: (408) 252-4505 RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CTPERTINO REC0MMENDING THE APPROVAL, OF A TENTATIVE HAP WHEREAS, the attached application has been submitted to the City of Cupertino requesting approval of a tentative map; and WHEREAS, the Planning Commission has held at least one public hearing in regard to the application; and WHEREAS, the Planning Commission has duly considered and heard all evidence submitted in regard to said application; and WHEREAS, the necessary public notices have been given as required by the subdivision and procedural ordinances of the City of Cupertino. NOW, THEREFORE, BE IT RESOLVED: 1.
