OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO
RECOMMENDING APPROVAL OF A TENTATIVE MAP TO SUBDIVIDE
411 5.5 ACRES INTO TWO PARCELS CONSISTING OF APPROXIMATELY
1.3 ACRES AND 4.2 ACRES.

LOCATION: Northeast corner of South De Anza Boulevard and Rodrigues Avenue
Approval is recommended subject to the findings as set forth on Page 1 and sub-
conclusions as set forth in the minutes of the Planning Commission meeting of
August 14, 1978.
CONDITIONS:
1-14. Standard Conditions to the extent that they do not conflict with the special
conditions enumerated herein. In the event a conflict does exist, the
special conditions enumerated herein shall apply.
15. That the approval is based upon Exhibit A of Application 15-TM-78 as may
be modified by additional conditions contained herein.
16. The applicant shall record a deed restriction and covenant running with
the land which requires and obligates the existing and future owners of®
Parcels One and Two to enter into reciprocal ingress/egress easements at
such time in the future as Parcel Two develops. Also, applicant/owner
shall record a covenant and deed restriction running with the land which
is acceptable to the City Attorney, which obligates future property owners
of Parcel Two to participate in reciprocal ingress/egress easements with
the adjoining property to the north at such time in the future as the
City can require the same of the adjoining property owner.
17. The applicant shall record a covenant and deed restriction running with
the land which provides that the owners of both Parcels One and Two will
agree to participate with other owners in the Town Center area (as defined
in Rezoning Application 24-Z-77) and cooperate with the City of Cupertino
in the comprehensive planning of the Town Center area. The applicant shall
agree that no portion of Parcel Two may be developed preceeding an overall
approved conceptual zoning for the Town Center.
As part of the comprehensive planning effort, the covenant and deed
restriction running with the land shall recognize and obligate existing
and future property owners to interconnect on-site circulation with the
adjoining properties even though said interconnection of circulation
patterns may necessitate the deletion of one or more of the driveways
serving the existing Northern California Savings and Loan site and/or
require modification of the on-site circulation system to adjoin with
neighboring properties. The interconnected circulation system should
be designed in a manner which does not significantly impair the opera-
tional requirements of the existing Savings and Loan facility. The

RESOLUTION OF THE PLANNING COMMISSIOND OF THE CITY OF CUPERTINO RECOMMENDING
THE APPROVAL OF A TENTATIVE MAP
WHEREAS, the attached application has been submitted to the City of Cupertino
requesting approval of a tentative map; and
WHEREAS, the Planning Commission has held at least one public hearing in
regard to the application; and
WHEREAS, the Planning Commission has duly considered and heard all evidence
submitted in regard to said application; and
WHEREAS, the necessary public notices have been given as required by the
subdivision and procedural ordinances of the City of Cupertino.
NOW, THEREFORE, BE IT RESOLVED:
1. That the Planning Commission makes the following findings :
a) That the proposed map is consistent with the general and specific 110
plans.
b) That the design or improvement of the proposed subdivision is
consistent with the general and specific plans.
( c) That the site is physically suitable for the type of development.
d) That the site is physically suitable for the proposed density of
development.
e) That the design of the subdivision or the proposed improvements are
not likely to cause substantial environmental damage or substantially
and avoidably injure fish or wildlife or their habitat.
f) That the design of the subdivision or the type of improvements are
not likely to cause serious public health problems.
g) That the design of the subdivision or the type of improvements will
not conflict with easements, acquired by the public at large, for
access through or use of, property within the proposed subdivision.

covenant and deed restriction shall provide that the applicants will
II modify the circulation and/or landscaping areas at their own expense to
coordinate with the overall planning and common circulation efforts.
PASSED AND ADOPTED this 14th day of August, 1978, at a regular meeting of the
Planning Commission of the City of Cupertino, State of California, by the
following roll call vote:
