Reso 1871 19-TM-78 RESOLUTION NO. 1871 OF THE PLANNING COMMISSION OF THE CITY .OF CUPERTINO RECOMMENDING APPROVAL OF A TENTATIVE MAP TO DIVIDE TWO EXISTING LOTS CONSISTING OF 28.5 ACRES INTO FOUR PARCELS. APPLICANT: Vallco Park Ltd. ADDRESS: P.O. Drawer V, Cupertino, California 95014 SUBMITTED: June 9, 1978 LOCATION: North side of Vallco Parkway approximately 1,500 ft. east of Wolfe Road Approval is recommended subject to the findings as set forth on Page 1 and subconclusions as forth in the minutes of the Planning Commission meeting of July 24, 1978. CONDITIONS: 1-14. Standard Conditions to the extent that they do not conflict with the special conditions enumerated herein. In the event a conflict does exist, the special conditions enumerated herein shall apply. 15. That the approval is based upon Exhibit A of Application 19-TM-78 78 as may be modified by the conditions contained herein. 16. Exhibit A of this application shall be revised as follows prior to recordation of a final subdivision map: a. The common parcel line between Parcels One and Two shall be coordinated with layout of exterior building walls and parking areas, to the satisfaction of the Director of Planning. b. The 58'+•.wide westerly extension'of P.arcel' Two shall be deleted. Instead,'. the map shall designate an easement across Parcel One to Parcel Two for access to the existing J. C. Penney site. An appropriate instrument creating such easement shall be prepared to the satisfaction of the City Attorney, and shall be recorded simultaneously with the final map. c. Parcel Three shall be labeled to reflect current status of dedication. 17. The subject map does not officially vacate the .09+ acre extension of Finch Avenue north of Vallco Parkway. The action to vacate said area, • if approved-, will be effectuated via a separate public hearing process. NOW, THEREFORE, BE IT RESOLVED: 1. That the Planning Commission makes the following findings: a) That the proposed map is consistent with the general and specific 110 plans. b) That the design or improvement of the proposed subdivision is consistent with the general and specific plans. c) That the site is physically suitable for the type of development. d) That the site is physically suitable for the proposed density of development. e) That the design of the subdivision or the proposed improvements are not likely to cause substantial environmental damage or substantially and avoidably injure fish or wildlife or their habitat. f) That the design of the subdivision or the type of improvements are not likely to cause serious public health problems. . g) That the design of the subdivision or the type of improvements will not conflict with easements, acquired by the public at large, for access through or use of, property within the proposed subdivision. • -1-
