WfmUM, the Planning O=mission of the City of Cupertino has received an
application for a Use Permit, as described cn Page 2 of this Resolution;
and
WH MM' the necessary notices have been given in accordance with the
Procedural Ordinance of the City of Cupertino, and the Planning Camitssion
. has held one or more Public Hearings on this matter; and
wHEREM, the applicant has failed to meet the burden of proof required to
support this application, and has cwt satisfied the following
zequirvments:
1) That the use does not provide adequate density related to General
Plan Policy and Jobs/Reusing Goals for the City.
2) That there is inadequate parking to serve the needs of both guest
and residence.
3) Tnat the building coverage of the site (FAR) is excessive when
related to the low density being achieved.
NOW, nEWME, BE IT RESOLVED:
That after careful consideration of maps, facts, exhibits, testimony and
other evidence submitted in this matter, the application for Use Permit is
hereby, recommended for denial by the City Council of the City of
Cupertino; and
BE IT FURMM RESOLVED:
That the s,*concnusions upon which the :ftnlings specified in this
Resolution are based are contained in the Public Hearing record concerning
Application io-U-89 as set forth in the Minutes of the Adjourned Regular
Planning cmmission meeting of June 15, 1989 and are incorporated by
refE--esce as duxxjh fully set forth herein.
