WHEREAS, the applicant has met the burden of proof required to support said application; and WHEREAS, the Planning Cmmdssicn finds that the application meets the following requirements: a) That the use or uses are in conformance with the General Plan of the City of Cupertino, and are not detrimental to existing uses or to uses specifically permitted in the zone in which the proposed use is to be located. b) That the property involved is adequate in size and shape to acroim odate the proposed use. c) That the proposed use will not generate a level of traffic over and above that of the capacity of the existing street system. • d) That the proposed use is otherwise not detrimental to the health, safety, peace, morals and general welfare of persons residing or working in the neighborhood of such proposed uses, nor injurious to property and improvements in the neighborhood. APPROVED EXHIBrrS Rhe recommendation of approval is based on Floor Plan and Site Plan exhibits of Application 9-U-89, except as said exhibit may be amended by the Conditions contained in this Resolution. 2. USE ISt=ATICkI The subject use permit authorizes operation of 3205± sq, ft. of specialized educational classroom space within the tenant space. 3. PARKING SOII7TI(kI Prior to initiation of the Use Permit for the proposed classroom space, the applicant in cooperation with the property owner, shall enter into an agreement which will run with the land for "satellite" parking located at the north end of .the K-Mart/bank site. 'This agreement is subject to review and approval by the City Attorney prior to recordation. 4. FUTURE INGRESS EGRESS EASEMENTS The applicant shall sign an agreement to participate in reciprocal ingress/egress easements with owners of adjoining properties. The agreement shall provide that reciprocal access shall be implemented at such time as the adjoining property owner(s) is obligated by the City of Cupertino to participate in a similar agreement.
