Development in all other zoning districts shall be served by on site storm drainage facilities connected to the city storm drainage system. If City storm drains are not available, drainage facilities shall be installed to the satisfaction of the City Engineer. The developer shall comply with the requirements of the Underground Utilities ordinance No. 331 and other related ordinances and regulations of the City of Cupertino, and shall coordinate with affected utility providers for installation of underground utility devices. The developer shall submit detailed plans showing utility underground provisions. Said plans shall be subject to prior approval of the affected Utility provider and the City Engineer. The project developer shall enter into a development agreement with the city of Cupertino providing for payment of fees, including but not limited to checking and inspection fees, storm drain fees, park dedication fees and fees for urclergrounding of utilities. said agreement shall be executed prior to issuance of construction permits. 11. BUS D —C-M-- P The applicant shall install a bus duckout as shown on the approved exhibits. Duck out design shall be approved by the city and the Santa Clara County Transit District. Applicant shall install a concrete pad as required by the Sancta Clara County Transit District. Applicant is not responsible for installation of a bus stop shelter. Applicant shall provide a pedestrian easemerrt over the pad area prior to issuance of building permits. The reccmmadaticn of approval is based on Exhibits A, A-1, A-2, B-1, B-2, C, and F-1 of Application 46-U-87, except as may be amended by the Cxarditions contained in this Resolution. 13. SIGNS: The signs shown in the approved exhibits are not approved under this application. Applicant shall file the appropriate sign program application with the architectural and Site Approval Ccnmrittee for approval of signs. RESOL=ON NO. 4038 46-U-87 MARCH 14, 1988 PAGE, -4- 14. Mjta= SETBACK• The new retail center structure shall be setback a minimum of twenty-five feet from the Stevens Creek Boulevard curbline as required by the Stevens Creek Boulevard Conceptual Zoning Plan. 15. j,jgQgr6 PE PLAN• The final landscape plan shall be submitted to the Architectural and Site Approval Committee for informal approval prior to occupancy of the new retail center. Specifically, the Committee shall exmine the landscape treatment on the east side of the retail center to ensure that the landscaping will provide an effective vegetative screen of the east elevation when viewed from Bandley Drive. The landscape area adjacent to a bus stop pad or enclosure shall be adjusted to maintain an width of approximately seven feet. The adjustment shall be shown on the final landscape plan. 16. APPRMIED USES Permitted uses may include all uses allowed without the securing of a Use Permit in the City of Cupertino 03 (General commercial) zoning district. in the 13,000 square foot retail center, restaurant and food service uses including im-aream stores, yogurt steeps, and delicatessens may be approved by the Planning Director subject to the following findings: 1. Sufficient parking exists to acocmnodate the use 2. The total area of food service uses does not exceed 25% of the gross floor area of the retail center. 3. The use does not include entertainment or a separate bar. 4. The hours are limited to 7 AM to 11 PM. 5. The use is of a type which will oceply with the findings of the DIM Associates traffic study dated January 25, 1988. The Planning Director may forward a potential restaurant or food service tenant to the Planning Commission for an interpretation of consistency with the aforementioned findings. Should the Planning Director withhold approval of a potential restaurant or food service tenant, the tenant may appeal the decision of the Planning Director to the Planning Ccimmissicn. The decision of the Planning Omni ion may be appealed to the City Council as provided in ordinance No. 652. All uses not discussed above shall require a use permit. The Planning Om mission reserves the authority to review and drone the approved uses should problems relating to parking, noise, hours of operation, or traffic arise in the future.
