GRANTING A USE PERMIT TO ALLOW THE OPERATION OF A
�`JTINUOUS PRIVATE SCHOOL FACILITY OFFERING CLASSES
VR0:1 KINDERGARTEN THROUGH SIXTH GRADE IN ADDITION
TO THE OTHER CHURCH RELATED ACTIVITIES ON THE SUBJECT SITE.

FINDINGS AND SUBCONCLUSIONS:
Approval is recommended subject to the findings as set forth on Page 1 and subconclusions
as set forth in the minutes of the Planning Commission meeting of June 8, 1981.
1-14. Standard Conditions to the extent that they do not conflict with the special
conditions enumerated herein. In the event a conflict does exist, the special
conditions enumerated herein shall apply.
15. The approval is based upon Exhibit A of Application 26-U-74 (Revised) and
dated April, 1981 and the letter from Emil Straka, President, and David L.
Klinger, Vice President, Bethel Lutheran Church, dated April 30, 1981 as may
be amended by additional conditions contained herein.
16. The Use Permit is granted to conduct a continuous private school operation
in addition to other church related activities. The private school shall
v be operated in conformance with State and County requirements and limited
to grades kindergarten through the sixth grade. The number of classrooms
shall be limited to those which are existing and proposed on the site plan
labeled Exhibit A and including the parish fellowship hall. A review of
this use permit shall be required if the school operation proposes to expand
beyond the sixth grade.
17. No phonographs; radios, public address or paging systems, powered megaphones,
bells, buzzers or similar noise -making devices including musical groups will
be permitted outdoors at any time.
18. Enrollment in Grades K through 6 shall be limited to no more than 150 students.
19. School activities shall not be permitted in the southern undeveloped portion of
the site. The development of the storage shop and play structure area in the
southerlymost portion of the site is not approved at this time.
PASSED AND ADOPTED this 8th day of June, 1981, at a regular meeting of the Planning
Commission of the City of Cupertino, State of California, by the following roll call vote:

OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO
GRANTING APPROVAL OF A REVISION TO A USE PERMIT TO
CONSTRUCT A PLAYGROUND AND REMOVE RESTRICTIONS ON
UTILIZATION OF THE SOUTHERLY LOT.

CONDITIONS OF APPROVAL:
1. All of the previous conditions imposed in Planning Commission Resolution No.
2217 shall remain in full force and effect with the exception of Condition
No. 19 which is amended as follows:
19. The southerly portion of the site shall be developed with perimeter
landscaping and grass turf areas. The perimeter landscaped area
shall be a minimum of 10 ft. in width and shall, as a minimum, provide
the following materials.
East and West Side of Southerly Lot
Box Wood - 5 ft. on center, 5 gallon size.
Hollywood Junipers - 16 ft. on center; 5 gallon size
Southerly Property Line
Shrubs - 7 ft. on center, 5 gallons
Photinia Fraseri or Pittisporum
Southwest and Southeast Corners
Clusters of three 15 gallon Coast Redwoods at each of these southerly
corners.
The specific materials shall be worked out with the adjoining residents
subject to final staff approval. The play yard areas shall be moved a
minimum of 10 ft. from the property line to provide a buffer from the
adjoining single -family -lot: Additionally, the taller playequipment
shall -be located as far from the'Common property line as possible' -subject
to staff review•at the building permit level.
20. The southerly area shall not be used for any activity until the
plantings have been installed to the staff's satisfaction.
