CMMCIWOFFICE BUIIDINC, AND TO OONSTFUCT ASSOCIATED PARKING AND IANDSCAPING MODIFICATIONS S> crtON I • FINDINGS WHEREM, the Planning Commission of the City of Cupertino received an application for a Use Permit, as described on Page 2 of this Resolution; and WHEREAS, the necessary notices have been given in accordance with the prowl Ordinance of the City -of Cupertino, and the Planning Oamuission has held one or more Public Hearings on this matter; and WHEREAS, the applicant has failed to meet the burden of proof required to support this application, in reference to the following criteria: 1) The project is inconsistent with the Floor Area Ratio (FAR) development intensity limitations of the General Plan; the project as proposed exceeds the .25 FAR for vial uses and .37 FAR for office activity and cannot be developed without bonus credit. 2) Bonus credit of up to 5000 sq. ft. for two existing parcels within the Project was requested order Policy 6a of 1-GPA-84 conoerninq redevelopment of shopping centers built prior to 1973. However, the developer did not demonstrate adequate compliance with criteria 1-4 of said Policy as regard substantial enhancement of site design • features. 3) That the property is inadequate in size and shape to ac ommdate the proposed urea. That after careful consideration of maps, facts, eadiibits, testimony and other evidence submitted in this matter, the application for Use Permit is hereby reccomesded for denial by the City Council of the City of Cupertino; and That the subconnclusions upon which the findings and conditions specified in this Resolution are based upon and contained in the Public Hearing record concerning Application 14-U-87 as set forth in the Minutes of the Planning Commission Meeting of August 24, 1987, and are incorporated by reference as though fully set forth herein.
