De Anza Boulevard Cupertino, California 95014 RESOLUTION No. 2991 OF THE aMlING CC* h SSION OF THE CITY OF C WMMNO RENDING APPROVAL OF A USE PERMIT TO OPERATE AN EXISTING SERVICE STATION ON A 24-HOUR BASIS SECTION I• FINDINGS WHEREAS, the Planning Commission of the City of Cupertino received an application for a Use Permit, as described on Page 2 of this Resolution; and WHEREAS, the applicant has met the burden of proof required to support said application.; and WHEREAS, the Planning Camu ssion finis that the application meets the following requirements: a) That the use or uses are in conformance with the General Plan of the City of Cupertino, and are not detrimental to existing uses or to uses specifically permitted in the zone in which the proposed use is to be located. b) That the property involved is adequate in size and shape to aoccumodate the proposed use. c) That the proposed use will not generate a level of traffic over and above that of the capacity of the existing street system. d) That the proposed use is otherwise not detrimental to the health, safety, peace, morals and general welfare of persons residing or working in the neighborhood of such proposed uses, nor injurious to property and improvements in the neighborhood. NOW, THEREFORE, BE IT RESOLVED: That after careful consideration of maps, facts, exhibits, testimony and other evidence submitted in this matter, the application for Use Permit is hereby recommended for approval, subject to the conditions which are enumerated in this Resolution beginning on Page 2 thereof; and That the subconclusions upon which the findings and conditions specified in this Resolution are based and contained in the Public Hearing record concerning Application 4-U-87 as set forth in the Minutes of the Planning Camnission Meeting of February 9, 1987, and are incorporated by reference as though fully set forth herein. - 1 - RESOLUTION NO. 2991 (4-U-87) 02/09/87 Page - 2 - SECTION II• APPLICATION DESCRIPTION Application No(s) 4-U-87 Applicant: Mobil oil Corporation Property Owner: Mobil oil Corporation Location: South side of Stevens Creek Boulevard between Miller Avenue and east Estates Drive USE PEEN (4-U-87) To operate an existing gas station an a 24-hour a day basis 1. APPROVED E}�iIBTTS The recommendation of approval is based on Exhibit A of Application 4-U-87, except as may be amended by the Conditions contained in this Resolution. \ 2. PARKING II4PFS/VII4F2TI5 The applicant shall restripe parking spaces as shown on Exhibit A. one space shall be designated as a handicapped parking space. 3. The applicant shall plant and irrigate the expanded parkway along East Estates Drive. B. The applicant shall replant existing planters with trees and plants to provide color and height. The applicant shall return to ASAC for informal review of new plantings. 5. ON SITE PARKING All automobiles parked on the site shall be placed in the approved, striped off-street parking spaces as shown on Exhibit A.• The servicing of automobiles outside of the service bays other than the dispensing of gasoline and oil and the replacement of minor parts such as water hoses, fan belts, etc., is prohibited. ' RESOLUTION NO. 2991 (4-U-87) 02/09/87 Page - 3 - ID 7. SECURITY The applicant shall implement a prepayment system for gasoline purchases made after 8:00 PM. The sales area at which payment is made shall be kept visible for surveillance by passing police vehicles.
