SECTION III: CONDITIONS A I TIISTERED BY THE PUBLIC WORKS DEPARTMENT
1. STREET IMPROVEMENTS & DEDICATION
Street widening, improvements, and dedications shall be provided in
accordance with City Standards and specifications and as required by
the City Engineer.
2. RAINBOW DRIVE IMPROVEMENT
An interim improvement plan for the Rainbow Drive frontage shall be
required. The subdivider shall also provide for permanent
improvement of said frontage, including plans and specifications,
411 under a deferred agreement to be implemented at such time as the
Seven Springs Ranch project to the south implements roadway
improvements on said frontage.
3. CURB, GUTTER & SIDEWALK
Curbs, gutters, sidewalks, and structures shall be installed to
grades and be constructed in accordance with standards specified by
the City Engineer.
4. LIGHTING
Street lighting shall be installed and shall be as approved by the
City Engineer. On-street lighting shall be as required by the
Architectural and Site Approval Committee and ordinances and
regulations of the City. All on and off-site lighting shall
designed to in no way interfere with adjacent areas and shall be no
higher than the maximum height permitted by the zone in which the
property is located.
5. FIRE HYDRANT'S
Fire hydrants shall be located as required by the City.
6. TRAFFIC CONTROL SIGNS
411 Traffic control signs shall be placed at locations to be specified
by the City.

14. rTPCIRICAL AND TELEPHONE TRANSFORMERS
Electrical and telephone transformers shall be screened with fencing
and landscaping, or undergrounded, such that they are not visible
from public street areas.
15. DENMSTION REQUIREMENT
The subdivider shall remove all existing structures not within that
portion designated as a "remainder" parcel prior to recordation of
the final map, or post a bond or other financial security
(acceptable to the City) guaranteeing their removal prior to
issuance of any building permits.
If the subdivider elects to post a financial security and remove the
structures prior to issuance of building permits, he/she shall
record a covenant, or other acceptable legal instrument precluding
transfer of ownership of any individual parcel until the structures
are removed.
16. TREE PROTECTION
Prior to commencement of an site work, building demolition, tree
removal or other disturbance of existing site conditions, the
subdivider shall install protective fencing around each tree to be
retained in accordance with the following schedule:

The subdivider shall provide detailed information on the tree
protection fencing devices and protection of tree root systems prior
to installation of said devices. These materials shall be subject
to . staff approval. Staff may require additional review by a
Landscape Architect or Arborist if deemed necessary. Staff shall
retain final authority to allow removal of any tree which is
determined to be unhealthy, or the location of which unduly
constrains implementation of the approved subdivision.
17. COMPLETION OF ANNMNATION
The final subdivision map may not be recorded until all land area
encompassed therein is certified by the Secretary of State as
annexed to the City of Cupertino
18. SETBACK INTERPRETATION
The westerly line of Lot 6, as well as that portion of the northerly
Ilk line of Lot 6 parallel to Belknap Drive as shown on Exhibit A 2nd
Rev., shall be deemed the front line for purposes of establishing
setbacks. Accordingly, the Easterly property line of said Lot 6
shall be the rear lot line.
