Reso 1807RESOLUTION NO.1807 OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO RECOMMENDING A PROPOSED AMENDMENT TO THE TRAFFIC l INTENSITY PERFORMANCE STANDARD POLICY MANUAL WHICH WOULD EXEMPT OUTDOOR SEATING AREAS OF FORMAL SIT- DOWN RESTAURANTS FROM THE NORMAL TRIP LI11ITATIONS OF THE TRAFFIC INTENSITY PERFORMANCE STANDARD AS STATED ON ATTACHMF21T A. The Planning Commission recommends the attached policy amendment based upon the following findings: 1. The Commission finds that the outdoor seating areas are an asset to the character of the community; and 2. Outdoor seating areas when operated as incidental to the primary use of the restaurant as a formal sit-down establishment will not severely increase the traffic generation from the restaurant facility; and 3. Restaurant uses which are not of a formal sit-down nature (e.g. fast-food facilities) are characterized by higher turn -over rates, high peak hour demand levels and the common use of disposable food.containers. Koenitzer, Chairman Planning Commission • ATTACHMENT A' Amendment to the Traffic Intensity Performance Standard Policy:Manual - Section IIB, Policy No. 9 • Outdoor seating areas shall be exempted from calculation of trips as: normally required in the Traffic Intensity Performance Standard, provided that said areas are clearly incidental to the primary use of the building as a formal sit-down facility and that said area does not exceed more than 20% of the seating capacity accommodated within the enclosed area of the building. This provision shall not apply to fast-food or other "non-formal sit-down" • restaurants as such uses are characterized by higher turn-over rates, higher peak hour demand levels, and due to the common use of disposable food containers have a greater potential impact upon the surrounding neighbor- hood. Such restaurants shall continue to be evaluated under the provisions of the Traffic Intensity Performance Standard trip calculations through the , use permit review process.
