Reso 2461L t 34-U-83 PESOLUTION NO. 2461 OF THE PLANNING C011HISSION OF THE CITY OF CUPERTINO RECOMMENDING APPROVAL OF A USE PERMIT FOR CONSTRUCTION OF A 1,900 SO. FT. SMALL ANIMAL VETERINARY CLINIC. APPLICANT: Conald K. Jones D.V.M.1 A1DRESS: 1564 Hiramonte Avenue, Los Altos, California 94022 -A DRESS: October 7, 1993 LdCATION: Northeast corner of Foothill Boulevard and Stevens Creek Boulevard. FINDINGS AND SUBCONCLUSIONS: Approval is recommended subject to the findings as set forth on Page 1 and subconclusions as set forth in the minutes of the Planning Commission meeting of November 14, 1983. CONDITIONS: 1-14. Standard Q-anditions to the entent that they do not conflict with the special conditions enumerated herein. In the event a conflict does exist, the special conditions enumerated herein shall apply. 15. I?. tisN L+wi a �S 3 Approval is granted to construct and operate a single -story structure of 1,900 square feet„for use as a veterinary clinic dedicated to outpatient treatment of small animals and household pets. Commercial boarding of animals is prohibited. Overnight keeping of animals shall be restricted to instances of medical necessity. On -premise treatment of equine, bovine, or other livestock such as sheep or swine is prohibited. i Resolution No. 2461 (continued) 34-U-83 16. Acoustical Study The applicant/property owner shall retain an acoustical engineer to evaluate noise impacts from animals kept within the proposed structure. The applicant shall employ reasonable measures to ensure that no noise from animals treated at the facility is audible at the common boundary line between this property and the adjoining residential sites. 1?_ Dedication The applicant/property owner shall dedicate land area for roadway purposes as described on Exhibits P and C of Application 34-U-83. or as may be required by the Director of Public Works. 20. Site Plan Modification N Exhibits A and A-1 shall be modified to provide a continuous 20 ft. wide aisleway adjoining the entire east property line, and to reflect full compliance with City of Cupertino Parking Area Layout Dimensions. In addition, an exterior trash enclosure shall be provided, the location thereof subject to staff approval_ Earth motonding shall be provided on the west edge of the parking area. and sped wens -sired trees shall be added to both lot frontages. In the event that the applicant or subsequent property owner shall desire to make any minor changes. alteration or amendment in the approved development plan or building permit. a written request and revised development or building permit shall be submitted to the Director of Planning and Development. If the Director of Planning and Development makes a finding that the changes are minor and do not affect the genera-1 appearance of the area or the interests of owners of property within or adjoining the development area, the Director of Planning and Development may certify the change on the revised plan. If such approval is withheld, the applicant way appeal to the- Planning Commission. If the changes are material, the Director of Planning and Development shall submit the change to the Planning Commission for approval. If the change is denied by the Planning Commission, the applicant may appeal to the City Council as provided in Ordinance No. 652 of the City of . Cupertino. If the change is approved, an appeal may be made by an interested party. Further, any member of the City Council may request a hearing before the City Council, said request to be made within ten (10) days from the date of approval - when the change has been approved by the Planning Commission. 2 Resolution No. 2461 (continued) 34-U-83 21. Parcel_Merger The Applicant shall merge individual parcels into one parcel. 22. Handicap Parking Space Handicapped ramps shall be provided; however, the handicapped parking space may be eliminated if not in conflict with other laws.
