PASSED AND ADOPTED this 12th day of February, 1979, at a regular meeting of the Planning Commission of the City of Cupertino, State of California, by the following roll call vote: AYES: Commissioners Adams, Claudy, Gatto, Koenitzer, Chairperson Blaine ,�A\ S: None ABSTAIN: None ABSENT: ,:t:ne APPROVED: /s/ Sharon Blaine Sharon Blaine, Chairpersnn Planning Commission i bert Cewan ,%!:,�istant PT:urning Director 1 V RESOLUTION OF THE BOARD OF DIRECTORS OF THE EVERGREEN RESOURCE CONSERVATION DISTRICT APPROVING THE ACCEPTANCE OF VOSS POND AND ADJACENT LAND AS AN OUTDOOR EDUCATIONAL SITE WHEREAS, on January 29, 1979 at a Special Meeting of the Evergreen Resource Conservation District a motion was passed to accept Voss Pond and the surrounding land, at no cost to the district, as an environ- mental teaching site, with the understanding that a portion of the adjacent Kaiser Permanente property could also be used for the same purpose; and WHEREAS, Kaiser Permanente has stated that they would donate, without cost to the district, an area to the Evergreen Resource Conservation District for the purposes of an environmental teaching site; and WHEREAS, the City of Cupertino hes agreed to donate, without cost to the District, the Voss Pond and surrounding area to the Evercreen Resource Conservation District; and WHEREAS, Kaiser Permanente has stated they would accept the return of the land from the Evergreen Resource Conservation District in the event the Evergreen Resource Conservation District could no longer use the land as an environmental teaching site; and WHEREAS, the City of Cupertino has stated they would accept the Oeturn of the pond and the surrounding land from the Evergreen Resource Conservation District in the event the Evergreen Resource Conservation District could no longer use the pond and the land as an environmental teaching site; and WHEREAS, it is deemed to be in the best interest of the people of Santa Clara County that Voss Pond and the surrounding land be used for an environmental teaching site; NOW, THEREFORE, BE IT RESOLVED that the Evergreen Resource Conser- vation District accept, without cost to the Evergreen Resource Conservation District, Voss Pond and the surrounding land from the City of Cupertino for the use as an environmental teaching site. -1- PASSED AND ADOPTED by the Board of Directors of the Evergreen Resource Conservation District on l��z �( , 1979, by the following vote: AYES: NOES: ABSENT: ATTEST: Secretary, Evergreen Resource Conservation District IzAt jc 0 -2- C a-irperson, Evergreen Resource Conservation District
