RESOLUTION NO. 1802 (Minute -Order)
OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO
REQUESTING THE CITY COUNCIL TO CAREFULLY CONSIDER
THE IMPACT OF THE PENDING SEPTIC TANK ORDINANCE
UPON EXISTING LOTS OF RECORD LOCATED WITHIN
REGNART CANYON.
FINDINGS:
During the January 11, 1978 public hearing for the City of Cupertino prezoning
application 29-Z-77, several Regnart Canyon property owners and residents
gave public testimony regarding concerns related to the application of City
Ordinances on their property should their property become annexed -in the
future. The residents expressed particular concern regarding the effect
of the pending Septic Tank Ordinance revision on the operation of existing
septic tank systems 'and installation of new systems on undeveloped lots
of record.
In response to the above-referenced public testimony, the Planning Commission
hereby requests that the City Council carefully consider the differences between
the existing County regulations and pending City regulations. involving septic
tanks in order -to understand the nature of any non-conforming use that may
exist for Regnart property owners should the property be annexed in the future
and secondly, that -City Council assure that flexibility is incorporated into
the Septic Tank Ordinance to enable the City and the public health officers
to explore any and' all options to eliminate the possibility that a homeowner
. be required.to vacate a residence because of a malfunctioning septic tank
410 system.
