PC Reso 1559 , 12-U-76 RESOLUTION NO. 1559 OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO APPROVING A USE PERMIT TO MODIFY AN EXISTING CONVENTIONAL SERVICE STATION TO A SELF-SERVE "POST PAY" SYSTEM �. APPLICANT: USA Petroleum Corporation (Urich Enterprises, Inc.) ADDRESS: 1633 - 26th St. , Santa Monica, California 90404 SUBMITTED: June 30, 1976 LOCATION: Southeast corner of the intersection of So. Blaney Ave. and Stevens Creek Blvd. ZONE: CG (General Commercial) . CONDITIONS AND FURTHER FINDINGS: 1-14. Standard Conditions to the extent that they do not conflict with the special conditions enumerated herein. In the event a conflict does exist, the special conditions as enumerated herein shall apply. 15. The approval is based upon Exhibit A, 12-U-76, as may be approved by additional conditions contained herein. 16. That this use permit will be reviewed one year after renovation and that the City shall reserve the right to close the driveway entrances • and modify the plan as per a more acceptable alternative should the City Traffic Engineer find the undesirable effect of cars queueing onto Stevens Creek Blvd. and/or disrupting traffic flow at the inter- section, subject to review and concurrence by the Planning Commission. A faithful performance bond or other financial guarantee shall be sub- mitted prior to issuance of building permits to ensure the completion of the modification if they are deemed necessary. 17. That the property owner shall sign a statement agreeing to grant reciprocal driveway and parking easements to the property to the east which will be initiated at such time as the City can obtain the same reciprocal easements of the adjacent property owner to the east. 18. That at the end of the twelve-month period the City reserves the right to review the stacking and waiting time at the drive-up cashier window and require its deletion should it find idling to be detrimental to the health of customers and adjacent residents. 19. That the applicant shall provide a minimum of a 20-ft. planting area and the installation of minimal planting along the Stevens Creek frontage to the easterly property line subject to the review and approval by the Architectural and Site Approval Committee. PERMIT WHEREAS, the Planning Commission of the'`City of Cupertino received an application for a USE PERMIT, as stated on Page 2; and WHEREAS, the applicant has met the burden'of proof required to support said application; and WHEREAS, the Planning Commission finds that the application meets the following requirements: a. Encourages the most appropriate'use of land, b. Conserves and stabilizes the value- of property. c., Provides' for adequate open spaces for light and air, d. Permits adequate control of fires, e.. Promotes the health, safety and public welfare, f. Provides for the orderly development of the City, and • g. Is advantageous to the property and improvements in the zoning district and neighborhood in which the property is located; NOW, THEREFORE, BE IT RESOLVED: - That after careful consideration of maps, , facts, exhibits and other evidence submitted in this. matter, the application of the USE PERMIT be, and the same is hereby granted, subject ' to the conditions stated on Page 2; and BE IT FURTHER RESOLVED: That the aforementioned findings be approved and adopted, and that the Secretary be, and is hereby- directed too notify the parties affected by this decision. • (Continued ' -1- " on Page 2) r 12,U-76 r Resolution No. 1559 (continued) • 20. The applicant shall improve all of the paved areas to City of Cupertino specifications for parking lots. 21. The southerly landscaped area shall be enlarged to a minimum of eight feet in width allowing a 29-ft. driveway and shall be planted with landscaped materials intended to screen this area from the adjacent residential parcel subject to the Architectural and Site Approval Committee's review and approval. 22. The two curb cuts. on Stevens Creek Blvd. shall be shifted to the east approximately twelve ft. so as to reduce potential traffic conflict with.. the Blaney Avenue/Stevens Creek Blvd. intersection.
