OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO
411 RECOMMENDING THE APPROVAL OF A TENTATIVE MAP TO
SUBDIVIDE .75 ACRE INTO THREE DUPLEX LOTS.

CONDITIONS:
1-14. Standard Conditions to the extent that they do not conflict with the
special conditions enumerated herein. In the Event a conflict does
exist, the special conditions as enumerated herein shall apply.
15. That the approval is based on Exhibit A, 14-TM-76, as may be amended
by additional conditions contained herein.
16. The building envelope for Lot B shall be shifted westerly 15 ft.
Additionally, the easterly property line of Lot B shall be shifted
to the west approximately 20 ft. to incorporate the landscape area
and .oak tree into the area for Lot C.
17. The two oak trees ndted to be saved on Exhibit A shall be preserved
during and after construction. The applicant shall provide the staff
with the proposed techniques to ensure their preservation, at the
building permit stage. The oak tree shall. be reviewed at the use
permit stage to consider an alternative pattern of development to
save said tree.
18. The applicant shall provide separate sanitary sewer laterals to the
satisfaction of the Cupertino Sanitary District standards.
19. The applicant shall install the initial planting and irrigation system
for the landscaping on the easterly property line to the satisfaction
of the Architectural and Site Approval Committee and Public Works staff.
The City will assume the responsibility for maintenance of this area.

20. The Architectural and Site Approval Committee shall have the ability
to meander the sound wall on the easterly. property line to achieve a

• more interesting design standard along this portion of Foothill Blvd.
The applicant shall record a public easement incorporating that area
outside the east side of the wall prior to recordation of the final map.
21. The pavement, curbs, gutters and storm drains and water mains of the
private street shall be constructed to the standards of City streets,
subject to the approval of the City Engineer, except that the City
'® • Engineer may permit modifications recommended by a licensed engineer.
The minimum width of a private street shall be twenty-four (24) feet
curb to curb, with curb and gutter on both side of the street, unless
otherwise approved by the City Engineer.

RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO RECOMMENDING
THE APPROVAL OF A TENTATIVE MAP
WHEREAS, the attached application has been submitted to the City of Cupertino
requesting approval of a tentative map; and
WHEREAS, the Planning Commission has held at least one public hearing in
regard to the application; and
WHEREAS, the Planning Commission has duly considered and heard all evidence
submitted in regard to said application; and
WHEREAS, the necessary public notices have been given as required by the
subdivision and procedural ordinances of the City of Cupertino.
NOW, THEREFORE, BE IT RESOLVED:
1. That the Planning Commission makes the following findings :
a) That the proposed map is consistent with the general and specific
plans.
b) That the design or improvement of the proposed subdivision is
consistent with the general and specific plans.
c) That the site is physically suitable for the type of development.
d) That the site is physically suitable for the proposed density of
development.
e) That the design of the subdivision or the proposed improvements are
not likely to cause substantial environmental damage or substantially
and avoidably injure fish or wildlife or their habitat.
f) That the design of the subdivision or the type of improvements are
not likely to cause serious public health problems.
g) That the design of the subdivision or the type of improvements will
not conflict with easements, acquired by the public at large, for
access through or use of, property within the proposed subdivision.

22. All private streets shall be inspected by the City during construction.
23. Sidewalks shall be a minimum of four and one-half (4.5) feet in width.
24. The private street and the major walkways shall be lighted to an
intensity approved by the City Engineer. The type and location of
electroliers are subject to approval by the Architectural and Site
Approval Committee.
• 25. There shall be a system for the naming of the private street and
for address numbers, subject to approval by the Building Department
after consultantions with the Postmaster, the Central Fire District
and the County Communications Office.
26. City Ordinance No. 276 regulating parking of trailers, campers,
•
repairing vehicles , etc. , shall apply to the private street and to
all "parking along said street. The parking of recreational vehicles
such as boats, trailers, campers, etc. , shall be prohibited through-
out the entire development unless said parking is within an enclosed
area. Vehicular curb parking along the private street shall be pro-
hibited except in designated areas. Appropriate "No Parking" signs
shall be installed by the applicant.
