PC Reso 1520 7-U-76 RESOLUTION NO. 1520 OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO ® RECOMMENDING THE APPROVAL OF A MASTER USE PERMIT TO ALLOW VARIOUS COMMERCIAL USES REQUIRING A USE PERMIT AS SET FORTH IN SECTION 95.1 IN THE GENERAL COMMERCIAL ZONING ORDINANCE. APPLICANT: Vallco Park, Ltd. ADDRESS:, P. 0. Drawer V, Cupertino, California 95014 SUBMITTED: April 2, 19.76 LOCATION: Vallco Fashion Park Regional Shopping Center mall located adjacent to and westerly of Wolfe Road. ZONE: P (Planned Development Zone with a Regional Shopping Center Commercial Use Intended) ACREAGE: 26.0+ CONDITIONS AND FURTHER FINDINGS : 1-14. Standard Conditions to the extent that they do not conflict with the special conditions enumerated herein. In the event a conflict does exist, the special conditions enumerated herein shall apply. 15. That the approval is based upon Exhibit A - 7-U-76, as may be modified by additional conditions contained herein. 16. That the entrances to all of the conditional uses approved by this ® master use permit shall be from the interior mall area to ensure proper functional integration with the remainder of the shopping center. Permitted uses not requiring use permit approval and not regulated by this master use permit may have exterior entrances subject to Architectural and Site Approval Committee review and City Council approval. 17. That the approval constitutes a master use permit which hereafter allows the conditional uses enumerated in Section 95.1 of the General Commercial zoning ordinance, subject to review by the Director of Planning and Development. Prior to initiation of a use listed under Section 95.1, the Director of Planning and Development shall review the proposed activity to determine its compatibility with the approved list of uses. The approval may include technically-oriented conditions to satisfy the health code and other agency requirements related to public health and safety. Vallco Park, Ltd. shall have the ability to appeal the decision of the Director to the Planning Commission. 18. The approval does not approve the "gross leasable" square footage described in Exhibit A - 7-U-76. The allowable gross leasable square footage is regulated by use permit 6-U-73 as modified by General Plan Revision 2-GPA-75. 19. The use permit shall include the area denoted by Exhibit A - 7-U-76 and the future mall shop space located easterly of Wolfe Road. -2- CITY OF CUPERTINO f City Hall, 10300 Torre Avenue Cupertino, California 95014411 Telephone: (408) 252-4505 RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO RECOMMEND- ING APPROVAL OF A USE PERMIT WHEREAS, the Planning Commission of the City of Cupertino received an application for a USE PERMIT, as stated on Page 2; and WHEREAS, the applicant has met the burden of proof required to support said application; and WHEREAS, the Planning Commission finds that the application meets the following requirements: a. Encourages the most appropriate use of land, b. Conserves and stabilizes the value of property, c. Provides for adequate open spaces for light and air, d. Permits adequate control of fires, e. Promotes the health, safety and public welfare, 111 f. Provides for the orderly development of the City, and g. Is advantageous to the property and improvements in the zoning district and neighborhood in which the property is located; NOW, THEREFORE, BE IT RESOLVED: That after careful consideration of maps, facts, exhibits and other evidence submitted in this matter, the application of the USE PERMIT is hereby recommended for approval, subject to the conditions stated on Page 2; and BE IT FURTHER RESOLVED: That the aforementioned findings be approved and adopted, and that the Secretary be, and is hereby directed to notify the parties affected by this decision.
