CONDITIONS AND FURTHER FINDINGS°
1-14. Standard' Conditions to the extent that they do not conflict with the
--special conditions enumerated herein. In the event a conflict does
exist,.the special conditions as enumerated herein shall apply.
15. That approval is based upon Exhibit A. lst Revision of 14-U-75, as may
be modified by additional conditions contained herein.
16. That the master plan for the site labeled:Exhibit B shall be considered
_ as information only. The.construction of any additional buildings on
t the site shall require new use permit applications. The master plan
shall serve to indicate the general location of the possible building
..:pads and the overall circulation system for the site. It shall not be
considered as a commitment to the amount of square footagejor-the
additional phases of the Watkins -Johnson industrial complex.
17. As a condition to this approval, applicant or its successor.shall
participate in street improvements required by the"Construction Phasing
for Vallco Park memo, as revised, which is a part of the Core `Area .General
Plan Amendment adopted -by City Council Resolution Noa. 3592e The participa-
tion shall be in the form of a local improvement district, or by direct
-participation if all- affected property owners agree. The applicant's
share shall be determined in the manner,-prescribed.by law for a local
improvement district and applicant's consent to such district shall be
irrevocable. The applicant shall enter into such a district upon ninety,
(90) days advance notice by the City.
18o, The outside storage of chemical or gas tanks shall be reviewed by the
Architectural and Site Approval Committee in order to insure the screening
of such tanks and equipment.
19. That the property'own:er/developer shall provide tenants with a written
noticeregardingpotential traffic problems within the Vallco Park area.
Said notice shall stipulate that the City reserves the right to review
traffic,conditions within the area at any.`time in the future and should
the City determine that constraints to insure proper traffic movement is,
-necessary, the City may impose :the appropriate constraints. This may
take the form of staggering of work ,hours by tenants, modification of
hours of operation, or a tenant-organized.car pooling program and County
transit. bus: pooling program. A. copy of said written notice shall be

RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO RECOMMEND-
ING APPROVAL OF A USE PERMIT
WHEREAS, the Planning Commission of the City of Cupertino received an
application for a USE PERMIT, as stated on Page 2; and
WHEREAS, the applicant has met the burden of proof required to support
said application; and
WHEREAS, the Planning Commission finds that the application meets the
following requirements:
a. Encourages the most appropriate use of land,
b. Conserves and stabilizes the value of property,
c. Provides for adequate open spaces for light and air,
d. Permits adequate control of fires,
e. Promotes the health, safety and public welfare,
f. Provides for the orderly development of the City, and
g. Is advantageous to the property and improvements in the zoning
district and neighborhood in which the property is located;
NOW, THEREFORE, BE IT RESOLVED:
That after careful consideration of maps, facts, exhibits and other
evidence submitted in this matter, the application of the USE PERMIT
is hereby recommended for approval, subject to the conditions stated
on Page 2; and
BE IT FURTHER RESOLVED:
That the aforementioned findings be approved and adopted, and that the
Secretary be, and is hereby directed to notify the parties affected by
this decision.

signed by the lessee and forwarded to the City prior to occupant' of
the building.
20. Prior to issuance of an occupancy permit for the second floor of the
structure, additional parking shall be provided, bringing the overall
number of parking spaces on the site to 546.
21. Every effort shall be made by Watkins -Johnson to provide a common,
driveway along the easterly property line in conjunction with The,.
Westfield Company's existing driveway. If, in the event, this:cannot
be accomplished, the proposed driveway as shown on Exhibit A, lst
Revision, may be,installed. The Director of Planning and Development
shall meet with representatives of The Westfield Company and Watkins-•
Johnson and shall file'a report with the City Council regarding the
disposition of the -subject driveways
22. The applicant shall bear a proportional share, as determined by the
City, of the cost of providing signalization at the entrance to the
property at Pruneridge Avenue midway between Wolfe.Road and Tantau
Avenue. Such _signal shall be installed at such time as:warranted
by the City of Cupertino.
