OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO
RECOMMENDING THE APPROVAL OF A USE PERMIT TO ALLOW
CONSTRUCTION OF A 10,700 SQUARE FOOT BANKING/PROFESSIONAL
OFFICE BUILDING, A 13,217 SQUARE FOOT RACKETBALL FACILITY,
THE CONSTRUCTION OF SIR TENNIS COURTS, AND THE RELOCATION
OF A 2,200 SQUARE FOOT BUILDING TO THE SITE TO BE USED FOR
PROFESSIONAL OFFICES.

ACREAGE: 4.8 acres
CONDITIONS:
1-14. Standard Conditions to the extent that they do not conflict with the
special conditions enumerated herein. In the event a conflict does
exist, the special conditions as enumerated herein shall apply.
15. That the approval is based upon Exhibit A, 1st Revision, and Exhibit
B, 1st Revision, as may be modified by additional conditions contained
herein and subject to minor revisions to be approved by staff relative
to internal traffic flow and the location and number of off-street
• parking stalls.
16. That the tennis courts shall not be operated prior to 7:30 A.M. nor
after 10:30 P.M. The Architectural and Site Approval Committee shall '
review the lighting plan to ensure that tennis court lighting will not
spill over into the yards of adjoining residents.
17. The drive-up window and stacking lane area located on the existing
First National Bank site in Vallco Village Shopping Center be deleted
and replaced with landscaping materials at such time as said bank
relocates to the new bank site denoted as Building A on Exhibit A, 1st Rev.
of 2-U-76.
18. The height and acoustical properties of the fence line located adjacent
to Linnet Lane shall be reviewed and approved by the Architectural and
Site Approval Committee.
19. The landscaping solution for the landscaping bed immediately west of
the drive-up window stacking lanes shall be designed to allow air
circulation to the drive-up window and permit good site distance for
the intersection of the bank access drive with the main shopping center
access drive beginning at Wolfe Road.

RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO RECOMMEND-
ING APPROVAL OF A USE PERMIT
WHEREAS, the Planning Commission of the City of Cupertino received an
application for a USE PERMIT, as stated on Page 2; and
WHEREAS, the applicant has met the burden of proof required to support
said application; and
WHEREAS, the Planning Commission finds that the application meets the
following requirements:
a. Encourages the most appropriate use of land,
b. Conserves and stabilizes the value of property,.
c. Provides for adequate open spaces for light and air,
d. Permits adequate control of fires,
e. Promotes the health, safety and public welfare,

f. Provides for the orderly development of the City, and
g. Is advantageous to the property and improvements in the zoning
district and neighborhood in which the property is located;
NOW, THEREFORE, BE IT RESOLVED: -
That after careful consideration of maps, facts, exhibits and other
evidence submitted in this matter, the application of the USE PERMIT
is hereby recommended for approval, subject to the conditions stated
on Page 2; and
BE IT FURTHER RESOLVED:
That the aforementioned findings be approved and adopted, and that the
Secretary be, and is hereby directed to notify the parties affected by
this decision.
