I SALUTE TO THE FLAG II ROLL CALL Commissioners Present: Commissioners Absent: Adamo, Fitch, Leonard, Small Eagar, Rampy, Snyder III Mariani Rezoning Application Moved by Commissioner Fltch;·'Seconded by Commissioner Adamo, that the R-3-H element be revised as follows: 1. All lands taken or to be taken by the State in connection with their acquisitlon of a right-of~way for the Junipero Serra Freeway are hereby subtracted from the property descr~ion before us. 2. 1\ strip one lot deep next to the Junipero Serra Freeway is to be defined by tentatlve and final map with 25' of additional depth which is to be planted and maintained as a buffer strip intended to shield the residents of the multlples from the effects of freeway traffic. This provision is not to be re- quired if final freeway plans provlde for sufficient depress~on of the freeway to damp-out the noise where the multiples will be located. 3. A strip one lot deep next to the R-I area is hereby changed to the R-2-H designatlon. Units built hereon are to be of one story construction reasonably compatible in styling and appear- ance with the R-I homes already constructed at the time the R-2-H structures are started. AYES: Commissioners: Adamo, Fitch, Leonard, Small NAYS: Commissioners: None ABSENT: Commissioners: Eagar, Rampy, S~yder MOTION CARRIED: 4-0 Moved by Commissioner Fitch; Seconded by Comm~ssioner Adamo, that the R-2-H and R-3-H elements as redefined in the foregoing motion be sub- ject to the following conditions: I. Dedications: (a) Sufficient lands to be dedicated on appli- cants side to permlt the widening of Homestead Road to a 90' right-of-way in front of the multiple; (b) Sufficient lands to be dedicated on applicants side to permit widening of Blaney Avenue to a 72' right-of-way in front of the multiple; (c) In addition applicant is to file with the City official letters from the following agencies that they will require nothing further than these street areas for their facilities: City of Cupertino on storm drains or ditches; Cupert~no Sani- tary District on sewer lines; S.C. Valley Flood Control Dis- -1- trict on pipes or ditches for run-off waters. 2. Improvements: Appl~cant to follow the regularly established rules of the City in making, paying for, or bonding for the various improvements including but not limited to: stre~t- widening, interior streets, curbs, gutters, sidewalks, -street lights, water malns and fire plugs, electroliers and under- ground cable, slgnalization of important intersections,. . . 3. Contributions: Applicant to make the regular contributions on storm drainage for both on-tract and off-tract facilities: to obtain clearances from the Cupertino Sanitary District for sewer facilities under their regular rules, and the City's; to pay such fees and make such deposits as are the regular practice of the City in matters like plan checking and all other items. 4. Restrlctions: After consideration, the usual restrictions call· ing for plans before recommendation and a time limit on con- struction under ~~in of voided zoning if not completed, are hereby waived. (a) Applicant expressly aCknowledges familiarity with Ordi- nance 144 _ Revised, and hereby affirms his statement made a~ one of the hearings that he is agreeable to the terms and c( ditions in the ordinance; (b) To insure plans eventually in keeping with applicant's assurances to the Commission· that the multiples "...will not be junk...", all plans are to limit average density to 20 families to the acre; and are to provide living areas of not less than 625' on one-bedroom units, and 800' on two-bedroom units.
