Verbal The City Manager advised the Planning Commission that the addition of under-ground water rlghts to standard City exhlblt, known as B on the re-zoning ordinances refers only to water rights beneath new sub-divisions which are presently belng reserved to the water utillty companies, namely San J,)se Water Works and Cali Cornia Water Service. It does not apply to eXlsting water rights or any water used or reserved for agricultural purposes or held by pri- vate parties at the present time. In essenCe, It merely reserves water rights beneath sub-divisions for the City instead of' water utilitles as at predent. IV BUILDING INSPECTOR A. Perrotti Construction Co.: site approval; 4 lots, 12 Application for arci1i tectural and apartments; Tract 2527, La Cresta. Removed from agenda. Architectural and site control applications w~ll no longer appear on the Planning Commisslon agendas, but wlll be referred to the standing commlttee fOl~ed by order of the City Council (see minutes of January 19, 1961). Lester & Lester: Appllcation to rezone 100 acres from A-2:B-4 to M-I-H, C-I-H, R-3-H, & PO-H; north side Stevens Creek Blvd. adjoining east slde of Idlewild Greens. Second hearing. Commlssj.oner Leonard vacated his seat. Boris Stanley, attorney for the Craft interests, summar~zed the comblned re-zonings by district as follows: -2- Craft Total R-3-H 19.4 44.7 C-I-H 27.5 53.9 PO-H 24.5 59.4 M-I-H 45.8 IlH .7 Mr. Stanley summarized and re-affirmed his presentation of the previous meeting. The Chairman submitted a llst of Stanford University regulations for a Ilght industrial park lncluding administrative and research offices. The Clty Attorney asked the applicant if he contemplated using County regulations withln his proposed PO zone. Mr. Stanley an- sered in the affirmative, acknowledging the fact that the Clty had adopted the County zoning regulations by reference, thus in- corporatlng the Count,r regulations for PO zonlng. At the present tlme there is no district zoned PO within the Cè.ty limits. The Plannlng Commission consldered the appllcation from the follow·· ing standpoints: location, economic implications, tax base, traffic circulation, harmony, and buffering. While considering these phases of the appllcation the public was invited to 3ubmit their views. Gene Linkem, 10252 Richwood Drive, Cupertino, ques- tioned the Planning CorrmU.ssion wlth respect to the present and future presentations by zone of the City territory. He implied that the present applications, if granted, would give the City superfluous acreage In such catagories as C-l-H and M-I-H. He quoted figures from the Cupertino Courier edltion of January 5,196j John Inglebright questloned the adequacy of the buffering inasmuch as industrial buildings can be constructed to a height of more than one story. Boris Stanley pointed out that the industrial zoning was located for the most part in the center of the territory and shielded from the single family residentia~ and vice versa, by apartment zones and professional office zones. Will Lester stated that public usage of his 100 acres will amount to 40 acres out of 100. He advised the Planning Commission that he hopes to secure plant- ing and landscaping features so as to buffer Stevens Creek Blvd. from the C-I-H zoning. He porposed that the entrance to the City from tne east by made more attractive by use of a planted area. A Mr. Alexander reglstered objection to the extension of Merrltt and Wheaton streets into the lndustrial dlstrlct from residential areas. He observed that the industrial area may prove a reality prior to the opening of the freeway, resultJ.ng in the fact that local streets will carry traffic through residentail zones into the industrial area. Relative to parking Mr. Lester stated that he preferred off-street parking entirely. _. -3- CU111mi.ssioner Sn.yder said that he WQuld like to see the multlple zone near Idlewild Greens Sub-division rather than along Home- stead Road. In this respect, he suggested switching a block of PO with R-3-H. The Planning Commission exhausted comments from the floor. Mr. Alexander said he believes he interpreted the consensus of Idlewild Greens resldents correctly in saying tllat the profess- ional office zone is preferable to ap3.rtment zoning. Moved by Commissioner Fitch that the second hearing be closed; Seconded by Commissioner Rampy. Stephen Dorclch (Los Coches Corp.): Application to rezone 2 lots located at the northeast CO~Der of Blaney Avenue and Stevens Creelc Blvd. from R-3-H to C-I-H. Second hearing. The applicant was advised to consult the City Engineer on the road section adjoining his proposed development. The parking sit- uation on the two lots was discussed as well as ingress and egress and the two level status of Stevens Creek Blvd., plus the possi- bility of signalizing the intersection. The Clty Engineer said he would present 3 or 4 alternate cross sections for selection by the Plannlng Commission and that he would also consult with the applicant relative to the public im- provements proper to the subject site. The Clty Attorney advised that the prima~J issue before the Plan- ning Commission was the zoning of the property rather than set- backs, landscaping, etc., whlch are proper subjects for future consideration. Commlssioner Fitch said that the engineering de- tail should be incorporated into the motion thus serving, possi- bly, as a precedent for other applicants. -4- . City City Engineer said he would have ~lternative cross sections prepared for February 3, 1961 and would meet with the applicant prior thel'eto. Moved by Commissioner Fitch that the hearing be continued to Feb- ruary 13, the applicant to meet with the Clty Engineer before that time and the City Engineer to present alternate street cross sections for the site; Seconded by Co~tssioner Leonard. Commissioner Fitch excused himself from the meeting. 5. R. Giuffrida: Applic~on to rezone 4t acres from R-3-H and R-l: B-2 to C-I-H & R-3-H; located on west side of Highway 9, 988 ft. north of Stevens Creel-c Blvd., 206 ft. frontage. Front 400 ft. to C-I-H, balance to R-3-H. Second hearing. Don Bandley represented the applicant. He requested an immediate vote saying that no plans were possible at this time nor until such time as the adjoining Saich property developed. Moved by Commissioner Adamo that the second hearing be closed; Seconde~ by Commissioner Rampy. Moved by Commissioner Snyder that the hearing be conintued to Feb- ruary 13, a cross section of Stevens Creek Blvd. to be considered at that time; Seconded by Commissioner Leonard. Miscellaneous John Rodrj.gues Jr. presented a map of the Rodrigues-Fisher prop- erty at the northwest corner of Homestead Road and Highway 9. He sought Planning Commission approval of a street, half in Cupertino, half in Sunnyvale, directly on the City limit line along the north side of his property. The City Attorney advised that the applicant should present the C:J.ty with the offer to dedicate the subject half street. (l\1ap not filed with City). vi. Moved by Commìssioner Leonard that the Planning Commlssion recom- mend to the City Council that this scheme of street developement be approved and that the applicant offer dedication of a half street to the City; Seconded by Commissioner Adamo. AYES: Commissioners: Adamo, Eagar, Rampy, Small, Snyder, Leonard NAYS: Commìssioners: Noœ ABSENT: Commissioners: Fitch MOTION CARRIED: 6-0 Commissioner Snyder referred to the report of the Recreation Com- mittee saying he favored recommendation of the Recreation Report in principal and allowing the City Council to explore means and methods of financing the program and the ultimate issue to be placed on the ballot. Commissioner Leonard questioned such a recommendation without tak- ing into consideration the means and advisability of financing. Commissioner Adamo maintained that the concern of the Planning Commission should be a tangible recreation program,namely the space allowed to parks and recreation and the facilities therein, rather than the financing phase. Moved by Commissloner Snyder that the Clty Recreation Report be recommended with respect to land use and recreation phl10so])hy land that the financial means and methods be integrated with some comprehensive statement of the financial needs of the City; Sec- onded by Commissioner Leonard.
