III MINUTES OF PREVIOUS MEETmG, JUNE 26, 1967
The Plannin¡¡; Director stated that Appendix A to the Minutes of
June 26th has not been submitted as yet.
Moved by Comm. Frolich, seconded by Comm. Horgan, to delay approval
of the Minutes of June 26, 1967, until the next regular meeting.

IV ANNOUNCEMENT OF POSTPONEMENTS, ETC. -- There were none.
V WRITTEN COMMUNICATIONS -- There were none.
VI VERBAL COMMUNICATIONS
A. The Planning Director said the City Council would like to meet
with the Planning Commission in the near future to discuss
planning policies, revision of the General Plan, etc. He con-
tinued to say that policy meetings in addition to the routine
work with applications are very important, and that it is
desirable to schedule this meeting as soon as possible. He
realized, however, that extra meetings of the Council and
vacations would make it difficult to set a date possible for all
parties to attend.

Vice-Chairman Bryson asked for verbal communications from the
audience. There were none.
VII HEARmGS SCHEDULED:
12-Z-67 A.
9-TM-67
THOR E. JOHNSON (RON L. KANE): REZONmG (12-Z-67) from
Agricultural-Residential, Single-fami.ly, I-acre lots (Al-43)
to Residential, Single-family, 7,500 sq. ft. lots (Rl-7.5),
and TENTATIVE MAP (9-TM-67), approx. one acre, located
east side of Mount Crest Drive. First Hearing.
The Planning Director stated that, from a Planning point of view,
there are no problems. The application is for a small parcel sur-
rounded by Rl-7.5 on three sides.
The Director of Public Works recommended the following condition if
the a.pplication is approved: "Precautions on grading operations be
made to prevent material from impacting against the fence along
Linda Vista Drive."
Mr. Ron L. Kane, 11073 Bel Aire Court, Cupertino, said the pads are
in, so there should be no need for any more grading. Because of the
terrain, it isn't practical to divide this property into more than
two lots.
The City Attorney advised that the s1Iggested condition could be made
a part of the Tentative Map or the engineering plans, but it is not
a matter of rezoning.
Mr. Karr, 11175 Linda Vista Drive, said he spoke for the homeowners
on the north side of this property who are concerned about the
development of the property because they already have a runoff problem.
They are concerned about the 7500 sq. ft. lot request. He noted that
any homes built there will look directly into their bedrooms. He
said they would like to see Parcel 2 zoned 1/2 acre and Parcel 1
zoned 10,000 sq. ft. to insure that only one home can be built on
each parcel.
Vice-Chairman Bryson proposed a zoning that would eliminate the possi-
bility of building any more than two homes there. The Planning
Director suggested Rl-15, requiring a minimum of 15,000 sq. ft. per
lot.

The Director of Public Works is to review the topography of the area,
per the request or Comm. Hirshon.
Mr. Thor Johnson, 21827 Terrace Drive, said there has not been any
grading done on that property in the past four or five years.
Moved by Comm. Horgan, seconded by Comm. Frolich, to close the
Public Hearings on application 12-Z-67.
Motion carried, 4-0
Moved by Comm. Horgan, seconded by Comm. Frolich, to recommend
approval to change the zoning of the parcel described in application
12-Z-67 from Al-43 to Rl-15, with the consent of the property
owners.

Moved by Comm. Horgan, seconded by Comm. Frolich, to continue
application 9-TM-67 to the next regular meeting, to provide the
applicant the opportunity to present a grading plan acceptable to
the City Engineer. This plan is to show no movement of earth
against the fence and is to show an adequate drainage plan. It
is also to show additional information regarding topography.

13-Z-67 B. NORMAN J. NATHANSON (KAY HOMES): REZONING (13-Z-67) from
Residential, Single-family, 10,000 sq. ft. lots (RI-IO) to
Residential, Single-family, 7,500 sq. ft. lots (Rl-7.5),
approx. 37 acres, located south of Junipero Serra Freeway
and east of proposed Mary Avenue extension. First Hearing.
Mr. Norman Nathanson, l0500 Mary Avenue, Cupertino, said the
property to be developed is 33.6 acres; he would retain approxi-.
mately 3.3 acres with his home. He has no intention of moving
from his home.
The Planning Director said that the General Plan indicates medium
density (7.3-10.0 dwelling units per net acre), justified by the
nearness to the College. On the other hand, we are almost running
out of good Rl land, and the balance between Rl and R3 may be
upset. He recommended the rezoning, adding that the Planning
Department does want to include the three acres which Mr. Nathanson
mentioned, in the rezoning as well as on the Tentative Map; otherwise
we get into difficulties with the street pattern, street dedications,
etc. The three acres can be designed as "Unit 2".

The Planning Director also suggested two conditions to protect the
quality of Mary Avenue:
l. There shall be no direct access from lots to Mary Avenue and
only one street access at the foot of the planned ramp to the
freeway overcrossing.
2. Slope easements for the aforesaid ramp shall be secured.
Vice-Chairman Bryson asked for comments from the audience. There
were none.
Moved by Comm. Frolich, seconded by Comm. Horgan, to close the
Public Hearings.
Motion carried, 4-0
Moved by Comm. Frolich, seconded by Comm. Horgan, to recommend
application 13-Z-67 for approval, ,dth the standard conditions
plus the two suggested by the Planning Director. Motion and
second were withdrawn.
Moved by Comm. Frolich, seconded by Comm. Horgan, to reopen the
Public Hearings on application 13-Z-67.
Motion carried, 4-0
Mr. Nathanson said he and the developer are agreeable to one access
to Mary Avenue from the development, but as long as he keeps the
three acres from being developed, he would like to keep his access
to Mary Avenue open. He cited the fa.c.t that on the developed part
of Mary Avenue from Stevens Creek Blvd. to Evelyn Avenue, there are
driveways onto Mary Avenue. He couldn't see where it would be too
harmful to retain his driveway.
The Planning Director said that the driveway access to Mary Avenue
would be no problem as long as those three acres remain undivided.
However, if the three acres were subdivided, the individual lots
should have access from one or two cul-de-sacs connecting with
Greenleaf Drive. A second street intersection in Mary Avenue would
be very undesirable because it would cause problems with signaliza-
tion and left-turn lanes.
The City Attorney did not feel the 3.3 acres had to be concerned
with the rest of the property. The Planning Director then suggested
amending the condition to: "The restriction does not apply as long
as the 3.3 acres remain undivided."

The Director of Public Works, in response to a question by the City
Attorney, said a back-up policy is not the only criteria for an
expressway. Perhaps a back-up policy would not be needed here if
there is a full 90' street. It would be a good idea for both
aesthetics and traffic control, however.
Comm. Frolich said perhaps what the applicant is asking for is two
rather than one access to Mary Avenue, to preserve the access for
these three acres. Mr. Nathanson said the present map shows only
one access to Mary Avenue. In addition, he emphasized that he is
asking for retention of his 3.3 acres.
Moved by Comm. Frolich, seconded by Comm. Horgan, to close the
Public Hearings.

Moved by Comm. Frolich, seconded by Comm. Horgan, to recommend
approval of application 13-Z-67, subject to the following conditions:
1-12 Standard Conditions.
13. There shall be no direct access from lots to Mary Avenue and only
two street accesaes¡ one ~t the foot of the planned ramp to
the freew8¥ overcrossing; the additional street to be located
at some point south of the present Nathanson driveway.
14. Slope easements for the aforesaid ramp shall be secured.

Delete "take place" on last line and replace with "requir-
ing a Building Permit arc made."
Third line shall read: "Commission may, as set forth in
Ordinance 220(g) of the City of Cupertino, impose...."
Second line shall read: "erosion; safety measures shall
include but not be restricted"
New section to be added. Planning Director to study fur-
ther at what lot area there should be requirement of full
street improvements and sewers, etc.
Third line: Replace the í'lord "mainly" with the word
"primarily" .
Fourth line: Delete the vords "but not".
