Saratoga-Sunnyvale Road I SALUTE TO THE FLAG II ROLL CALL: MINUTES OF THE PREVIOUS MEETING: April 23, 1962 Commissioners Present: Adamo, Fitzgerald, Frollch, Leonard, Rampy, Snyder, Small Commissioners Absent: None Staff Present: City Mana~cr, 'City Attorney, City ·Clerk, City Engineer Minutes of the meeting of April 23, 1962, approved as submitted. III CHAIRMANSHIP OF PLANNING COMMISSION Moved by Commissioner Snyder, seconded by Commissioner Fitzgerald, that Commissioner Frolich be nominated ~ Chairman. Moved by Commissioner Frolich, seconded by Commissioner Leonard, that Commissioner Snyder be nominated fur Chairman. .- Moved by Commissioner Leonerd that nominations be closed; seconded by Commissioner Adamo. Commissioner Frolich declined nomination and requested that his name be eliminated from the nominations. Commissioner Leonard withdrew his previous motion. Moved by Commissioner Leonard that nominations be closed and a white ballot be cast for Commissioner Snyder; seconded by Commissioner Fitzgerald; and unanimously carried. Commissioner Small gave up his seat as Chairman, and Commissioner Snyder assumed the seat of Chairman. Moved by Commissioner Leonard that Commissioner Small be commended for his excellent performance in the duties of Chairman during his term as such; seconded by Commissioner Fitzgerald; and unanimously carried. Moved by Commissioner Small that Commissioner Frollch be Vice- Chairman; seconded by Commissioner Fitzgerald. Moved by Commissioner I,eonard, seconded by Commissioner Small, that nominations be closed and a white ballot be cast for Don Frolich for Vice-Chairman; unanimously carried. IV COMMUNICATIONS A. Written 1. County of Santa Clara Planning Commission Blossom Valley Homes, Inc., application for a division directional sign: Fremont Avenue and Clarence J. Toney, application for use permit Lomita and Pasadena Avenues. Agenda - May 2, 1962: use permit for sub- Hollenbeck Road; for duplex property, 2. County of Santa Clara Planning Commission: May 2, 1962, and April 18, 1962. 3. Sunnyvale Zoning Ordinance #324. 4. County of Santa Clara Planning Commission Agenda: May 16, 1962. Summary of Actions, 5. County of Santa Clara Planning Department: List of Recorded Subdivisions in County for April, 1962. 6. Stones on Construction Corp.: Letter requesting advisement on -1- . their study for a planned community development on Stevens Creek Blvd. Moved by Commissioner Small that the communications be received and filed; seconded by Commission Fit~gèrald; and unanimously carried. B. Verbal Mr. Severin, from the audience, displayed plans to the Commission for a convelescent home on the southwest corner of San Juan and Mt. View- Stevens Creek Road. This home would have 60 beds. The property is now in the County and zoned for residential. A home of this type would re- quire commercial zoning. Commissioner Leonard stated that this type of application usually creates controversy within a residential area. He then outlined to Mr. Severin the type of questions that will be asked when this is a formal application, and suggested that all these questions be resolved and presented at the time of application to avoid delay and to give a clear picture of the application in its entirety. Commissioner FitzgeI~ld commented that this proposed project is almost directly across the street from the proposed small-type Disney- land. Commissioner Frolich, upon a comment made by Mr. Severin, asked Mr. Storm if the City could extend water service to this property. Mr. Storm said the City definitely could. Additional presentation of this project brought,out the following: This is a taxable project; there will be little, if any, traffic, as the patients will retire early and visiting hours a~e restricted; the area involved is 2,42 acres. Commisoioner Leonard suggested that the applicants be given a check list to aid them in answering questions later when the application is formally presented, Mr. Severin was given a copy of the check list. There were no other verbal communications. V HEARINGS SCHEDULED: A. V:",CTOR CALVO' Application 51<,,2-62 to j:ezone 2 acres from A-2: B-4 to M-I-H; abutting ths west side of highway 9, 658 ft. south of Homestead Road. First Hearing. Mr. Calvo further stated that due to the fact this is a retail . business there would bè very little outside atorage. Commissioner Small ask-"d tile City Attorney if this application could be handled through the C-l or C-2 zoning with a use permit. Mr. Anderson replied that it c01.'.ld net,; it would be far better to handle this as an M-I-H use. Discussion of the proposed Junipero Serra Freeway brought out the fact that this development would not cause a traffic hazard nor inter- fere with the traffic pattern. Mr. Calvo presented a petition, signed by the surrounding property owners who are in assent to this project, to the Commission. -2- Commissioner Adamo asked Mr. Calvo about storm drainage. Mr. Calvo stated he had spoken to the City Engineer and had been advised that there would be no storm drain problem on this property. He also stated that the building will be about 8,000 square feet in area, and that he would like to have a shake roof on it but does not now know if this is possible as the Building Inspector is working on this problem. Mr. Calvo, upon question from the Commission, reiterated that he would gladly put in writing his desire to go along with the City request of a zone change in the future, should the City then have a more applic- able zoning ordinance for this type of project. Moved by Commissioner Small that the first hearing be closedj sec- onded by Commissioner Frolich. HILLSIDE ORDINANCE: Subcommittee Report Commissioner Fitzgerald, Chairman of the Subcommittee, stated that he could give no report as the subcommittee has been unable to meet. Friday, May 18, was set as the meeting night for tae Hillside Ordinance Subcommittee. Commissioner Small asked that some engineering aid be enlisted for the May 18 meeting, along with secretarial services, as already requested by Commissioner Small of the City Council ,for study sessions. The Commission decided to change the meeting date of the Subcom... mittee to May 21, 1962. VII NEW BUSINESS: A. RESOLUTION 584: A Resolution of the City Council, Being A Resolution of Intention to Initiate An Amendment To Ordinance 002 By Adding A Zoning Classification To Be Known As "Planned Community Districts (PC-H) Zoning. (See minutes of April 30). Also Dection 2 of Ordinance 002(a) Revised (May 7 minutes). The City Attorney explained the purpose of reviewing the two ordi- nances together. Discussion was held on the differing points between the R-3 and this proposed R-24-H. Commissioner Frolich stated he was in favor of approving Ordina~ce 002(L) (amendment of Planned Community Districts to Ordinance 002) to the City Council. Moved by Commissioner Frolich that Resolution 105, A Resclution Of The Planning Commission Of The City of Cupertino Recommending Enactment Of The Proposed Ordinance No. 002(k) Being Section 47 Of Santa Clara County Zoning Ordinance No. NS1200 For Medium Density Multiple Dwelling Zoning ("R..24-H") Districts, be adoptedj seconded by Commissioner Fitz- gerald. CommiSsioner Leonard suggested that the Council be advised that these Resolutions are being sent up to the Council but that study will still be continued on them. Commissioner Small said that the Stonesons are very anxious and would like to be notified of the date of this hearing and a copy of the ordinance should be sent to them.
