II MINUTES OF THE LAST MEETING
The Clerk read the minutes and they were approved as read.
III COMMUNICATIONS
A. Written
I, The minutes of the last meeting of the Tri-County Planning
Commission were read. They discussed sign boards and sign
ordinances.
2. The County Boundary Commission sent several descriptions of
annexations within three miles of the City Limits - Jefferson
#14 to Santa Clara, Homestead ffl9 to Santa Clara. Stelling-
Annex to Sunnyvale, Fremont-Truman Ii 2 to Los Altos.
B. Oral
l. Mr. Aronson. who owns property contiguous to Homestead
#J-C, expressed interest in entering Cupertino by joining
Homestead #)-C. Aronson was anxious to get industrial zoning
upon annexation to Cupertino. The area is now in industrial
use, but is not so zoned by the County. A planing mill,
lumber yard and swimming pool are among the uses now estab-
lished on Mr. Aronson's acreage. Moved by Commissioner
Neilsen that the question of attaching Aronson's parcel to
Homestead tJ-C be referred to the City Attorney; seconded by
Commissioner Bell and carried 4 - O. Chairman Leonard noted
that this parcel had been in 11-1 use for about thirty years.
2. Nick Lazaneo announced a proposal to move the Du Pont
residence and garage. Commissioner Bell asked if business of
this sort couldn't be transacted simply by securing a permit
from the County and the City Clerk, without going through
the flanning Commission. Chairman Leonard explained that the
building inspector of the County prefers that the local
Planning Commission verify County zoning as it applies to
localities. He advised Lazaneo to secure an initial permit
from the County.
IV UNFINISHED BUSINESS
1. Char~qn Plans on a proposed commercial buildi~
Moved by Commissioner Cali that the sketches go to the review
committee on architectural and site control; seconded by
Commissioner Bell and carried 4-0.
2. Bianchi - controversy
Attorney Anderson said that he had been instructed by the
Council to take any necessary steps in forcing Bianchi to
comply with our building and zoning ordinances. In this
respect he is limited to injunctive relief, or a restraining
order. Chairman Leonard observed that the Eianchis have not
as yet signed the second half of the letter ?repared for
them. After some discussion, it was moved by Commissioner
Bell that the Commission reaffirm their previous stand;
seconded by Commissioner Cali and carried 4-0.
J. Highwav #9 widening
Chairman Leonard mentioned the traffic difficulties along the
road and said that drive-in parking may eventually be parallel
parking. He queried the Commission on their feelings about
taking some action on both parking and sewer facilities while
the streets were torn up. Quick action might prevent the
necessity for extra digging. He thought that the needed
funds might be in the coffers of the Sanitation District.

Since any sewer line must traverse the Stevens Creek Road,
it would be safe to install some trunk line. Mark Thomas'
engineering plans would probably still be good. The County
may have the necessary monies, according to Councilman
Meyerholz. Commissioner Bell thoug~that it would be good
to talk to the County about putting in a stub. The funds
of Sanitation District #7 have come from the local taxpayers.
4. Sewer crossi~ at Stevens Creek Road & HighwaY #9:
Homestead Road and Highway #9
Commissioner Bell favored a report to the Council. and
deferring the question until after the April 26th election.
5. Master Plan elements
Chairman Leonard said that a work session might be needed to
get a thoroughly representative opinion. Commissioner Bell
said he would commence preparation of maps this week. Com-
missioner Cali stated that it was useless to rezone land if
nothing develops upon it. This serves merely to benefit
real estate men who receive sales commissions while the City
may spend its time to no avail.
V NEW BUSINESS
1. Use Permit - Cupertino Union Chur~, west 4 acres of Arch
Wilson's home place on Stevens Creek Road
Chairman Leonard reported an application for a use permit and
for architectural and site control. The property has a front-
age of 250 I and a depth of approxil118.tely 475 I. The Church
wishes to give Mr. Wilson a quick answer and therefore wishes
Planning Commission action as soon as possible. Mr. Paviso,
representing the Church, reported approval by the County
Health Department. Chairman Leonard requested that notice of
the hearing be mailed to those people within )00' of the site.
The Clerk was instructed to publish notice of the hearing
scheduled for May 4th on the Church application for a use
permit.
It was recorded in the minutes that the septic tank
system had been approved by the County Health Department
April 17, 1956.
2. Use Permit - G~t1nQ Drive-In Market addition (Kawamoto)
Chairman Leonard observed that Kawamoto does not have commer-
cial zoning, but that he is located in an R-)-H zone.
Commissioner Bell moved that, on application for a use permit,
the Commission grant it and instruct Kawamoto to request a
building permit from the County which the Commission will
approve after the County accepts it for site control; seconded
by Commissioner Cali and carried 4 - o.
). Chairman Leonard announced that a newly appointed
Commission will be seated at the next meeting.
