MINUTES OF THE LAST MEETING, 4/20/56:
The Clerk read the minutes which were approved as read.
SEATING OF REAPPOINTED MEMBERS; SELECTION OF OFFICERS FOR THE
NEW TERM:
Mayor Wilson announced the reappointment of the previous Plan-
ning Commissioners, Mr. Leonard, Mr. Neilsen and Hr. Paizis, and
said that he would recognize nominations for Chairman and Vice-
Chairman. Commissioner Paizis nominated Burrel Leonard for
Chairman; seconded by Commissioner Bell. Moved by Commissioner
Ca11 that nominations for Chairman be closed; seconded by
Commissioner Bell and carried S - 0 by voice vote. Commissioner
~ nominated Commissioner Bell for Vice-Chairman; seconded by
Commissioner Paizis. Moved bY Commissioner Leonard that nomi-
nations be closed; seconded by Commissioner Paizis and carried
5 - 0 by voice vote. Moved by Commissioner Paizis that a white
ballot be cast in favor of Burrel Leonard and Ray Bell for the
posts of Chairman and Vice-Chairman respectively; seconded by
Commissioner Cali and carried by voice vote, no dissent being
heard.

B. Oral
l. Church of God. Monta Vista. Use Permit on N. Stellin~
Church Representatives have arranged with John Alves for four
acres adjacent to Garden Gate on the east side of N. Stelling.
No representatives of the Church were present.
2. Mr. Bachman on a Service Station. Hwv 9 near Bollin~er
Frontage on his property is zoned R-)-H and the rear portion
R-l:B-2. He has been approached by the Signal Oil Company
who offer a service station lease. Mr. Bachman says there
is only one service station on the east side of Highway 9
between Saratoga and Cupertino. Commissioner Bell asked
about the grade level at that point. Mr. Bachman said that
the property was close to the grade of the road which would
make a suitable entrance for the service station. Chairman
Leonard observed that the County now is inclined to prefer
rezonings rather than use permits. As far as Cupertino is
concerned, properties which have been in long commercial use,
and are residentially zoned areas, have been issued use
permits. Attorney Anderson noted the heavy traffic from El
Camino to Santa Cruz, indicating substanial gasoline purchases

along the route with subsequent benefit to Cupertino in the
event of a sales tax, Mr. Bachman's proposed site is 120' x
120', roughly 1/) acre. The Commission felt that further
study of service stations in general would be appropriate, so
that they might arrive at a policy for similar proposals in
the future. Moved by Commissioner Cali that the inquiry be
tabled until the next meeting; seconded by Commissioner Bell
and carried S - o.
3. Charles D. Pond: Inquiry on a Kennel on Stevens Creek
Road near Calabazas Creek
This small parcel on the west bank of the creek is now zoned
R-)-H. Pond wonders if a kennel use would be acceptable in
Cupertino and if this might not be a reasonable location for
such a use. The Commission noted that the ground level is
low; in addition it is fairly close to the High School site.
Commissioner Bell observed that certain lands are now zoned
to accommodate small animals and asked if the kennel could
not locate in such a zone.
4. Hearing on Cupertino Union Ch~~
Use Permit for 4 acres on Stevens Creek Road near S. Stelling.
Leo Bianchi protested the location of the Church on the
Wilson property. He stated that it would hurt his own pro-
perty near by, that one resident had indicated he or she
would move if the Church did locate there. He also declared
that the Bianchis themselves had been told the same property
was zoned residential, Mr. Meyerholz, speaking on behalf of
the Church. said that Churches are entitled to be in any
area, traditionally. He also felt that there is nothing of a
nuisance nature in the use of a Church and that the setbacks
on this particular application are more than adequate. Moved
by Commissioner Bell that the use permit be granted; seconded
by Commissioner Neilsen and carried 5 - o.
V UNFINISHED BUSINESS
l. ~t. Joseph's Parish - Parochial School - Builder reauests
approval of plans
Chairman Leonard explained that the builder wanted verbal
approval over the telephone. Chairman Leonard said the Com-
mission had agreed to the plans approved for this year's
construction, not necessarily for everything in the future
without further approval of plans as they develop. He stated
that no action was necessary now,
2. William Charron - Report from Review Committee su£gestinæ
changes
The Commission felt that Charron should locate the proposed
building further back on the property, thus providing more
parking in the front and reducing the interior parking shown
on the plan.
VI NEW BUSINESS
1. Application by the Texas Company for a service station use
permit on the Kompanica property at Homestead and Highway 9
Texaco forwarded complete plans with their application. in
which they state that there are insufficient gasoline stations
on Homestead Road. The area is currently zoned R-1:B-2. The
Commission decided to meet Friday. May llth, to discuss the
application along with the Bachman inquiry.
2. Request bY City Council to begin work on a Subdivision
Ordinance
This is also on the agenda for the work session. A Subdivi-
sion Ordinance should be predicated on the establishment of a
sewer policy by the new Sanitary District. Mr, Meyerholz,
a Board Member of Cupertino Sanitary District, felt that the
Board would not ask for a bond election in the near future.
