I ROLL CALL Commissioners Present: Commissioners Absent: Leonard, Bell, Cali, Neilsen, Paizis None II MINUTES OF THE LAST REGULAR MEETING, 5/4/56: The Clerk read the minutes which were approved as read. III COMMUNICATIONS A. Written: 1. The minutes of the last Tri-County Planning Council were received. 2. Notification by the County 21anning ~omrnission of nearby annexations; it was noted that a propcs~i new annexation to Sunnyvale encompassed property just west of ~athanson. 3. Fremont High School District requests schcol zoning for two parcels not clearly identified by the descriptions attached. B. Oral: 1. Ken Miller, Realtor, expressed interest in a gas station at the foot of So~th Blaney, that is the corner of Blaney and Bollinger,. No formal application has been made yet. 2. Dan Aronson presented a map showing land owned by Mr. and Mrs. LeCroye Silvey of 10)20 Loyola Drive, Los Altos. The Silveys are interested in annexing to Cupertino. The land in question is a strip between Cupertino's proposed "Homestead 3-C" and the railroad track. IV UNFINISHED BUSINESS 1. Mr, Kirkish, representing the Monta Vista Assembly of God Church, said that they had dec:deã on th~ Alves property. Comm:ssioner Cali moved that the application be set for heariñg at the earlJlest possible date; seconded by Commissioner Bell and carried S - O. 2. Commissioner Bell moved that a permit be granted the Rundle Company for construction of a sign on Town & Country Market; seconded by Commissioner Paizis and carried S - o. 3. A report from Mr. Bell showed that the setbacks on Highway 9 between Mariani Avenue and Stevens Creek Road varied by about 90', as everyone had suspected. Chairman Leonard reported that the County expects that the Highway 9 right-of- way will be 120' at some places and 76' at others. 4. On the subject of gas stations, Mr. Cali said that no policy had been established, in his opinion, since a policy would have to be something agreed upon by all, and the Commission has not adopted such a stand as yet. He said, however, that service stations are common to all Cities and that Cupertino must learn to live with them. Investigation showed that most Cities have one or two stations from several major oil companies. In accordance with this, Cupert',no might r.ave six or eight such stations. The present a1-pli0a- tions are for sites on the extreme limits of the City. He noted that stations located across the street from the City limits would draw the sales tax in the event that such were enacted. Applications should be made for rezoning to com- mercial. Commissioner Bell moved that we adopt a policy of requiring commercial zoning plus a use permit for gas station applications; seconded by Commissioner Paizis, and carried '5 - o. - 2 - V NEW BUSINESS 1. A letter from Walter Fields accompanied a preliminary sub- division map designated as Town & Country homesites, The use conforms to the zoning now in effect. George Somps presented himself as the Engineer who prepared the plat. He discussed the engineering aspects and answered questions. Sam Miller, Business Manager of the School District, briefed the Commission on the number of children that may be expected in different types of subdivisions as indicated by statistics. He explained the method by which a School Dis- trict anticipates the need for new school facilities. Chairman Leonard expressed concern over possible future con- demnation of orchards in order to obtain school sites. He felt this sort of thing could be avoided by proper planning. 2. Texaco has amended its application to include rezoning and architectural control for the Kompanica Property at the south- west corner of Highway 9 and Homestead Road. Commissioner Cali moved that we set the hearing fo~ June 1; seconded by Commissioner.> Paizls and carried ., - 0. J. Commissioner Cali asked if the Planning Commission was able to hire a Planning Consultant. Chairman Leonard said that the Commission had been alloted funds although they were not as yet available. Commissioner Cali moved that we engage a Planning Adviser, imme~iately if possible; seconded by Com- missioner Bell and ~ied S - O. VI A Subdivision Ordinance was discussed. George Somps suggested that Los Altos' Ordinance be examined since it was recently enacted for a òommunity with conditions somewhat resembling Cupertino's. VII ADJOURNMENT at 10:45 P.M. The possibility of an extension being added to the School Business Administration Office on North Stelling was mentioned. 2. William Charron presented revised plans for his building at Stevens Creek Road and Randy Lane, The Commission voted unanimously to approve the plans. J, A letter to Woodbridge Marshall, County ~lanning Commission, was proposed in which we might request a map showing setbacks in the area. 4. The Texas Company was required to apply for rezoning, use permit, and architectural control rather than a use permit alone. 5. A lengthy discussion on setbacks along Highway 9 between McClellan Road and Mariani Avenue brought forth some pertinent information and revealed the need for accurate details which were expected at the next regularly scheduled meeting. 6. Service Station policy was also discussed. June 1 was set as a tentative date for the first hearing on the Texas Company, subject to space being available in the San Jose Mercury at the ne,essary time. '1. The feaSibility of a subdivision ordinance was considered, and also the best means of securing same.
