Municipal Engineering. Mr, Thomas' offer to do the
municipal engineering for the City of Cupertino would
lnclude attendance at meetings, and such servlces as
advice on the administration of gas tax funds, subdlv1~
sion ordinanaê. budgets for engineering and other public
works, and engineering for special projects. The
Planning Commission referred the Mark Thomas letter to
the Council.
4, Stefano Cerrito: Request for Building Site approval.
Commissioner Neilsen asked how the Planning Commission
can prevent the division into four parcels. An owner
can divide a parcel into four lots without being con-
sidered a subdivider, he said, Commissioner Bell
referred to the County procedure for building site
approval and told Cerrito's agent that he must provide
the Planning Commission with a map containing the data
required by the County.
B. Verbal
Howard McLaughlin referred to his request for permission to
sell fireworks at a stand on the Miner property, The letter
itself was resting in Burrel Leonard's mail box.
Mr, McLaughlin gave the address of the proposed fireworks
stand as 10091 No, Highway 9 and said that Miner has given
his verbal approval, Commissioner Neilsen moved that the
Plannin~ Commission apDrove the permit, to be signed by
~irman Leonarà upon presentation of Miner's written
consent; seconded by Commissioner Paizis, carried 3 _ O.
IV PUBLIC HEARINGS SET FOR THIS DATE
With only threE members present the hearings were postponed unti:
the next meeting.
V UNFINISHED BUSINESS
A. Cupertino Church. i, D, Smith Archltect. Plans Submitted.
Commissioner Bell stated that the permit had already been
granted and that the plans now at hand can be examined; no
action need be taken.
B. Report on status of base maps,
The maps were considered at the end of the meetlng.
V KYNE & CUMMINGS (Mark Thomas Co, Engineers)
Review of tentative subdivision map in conflict with a proposed
freeway route near RR tracks, Review of letter from Chairman
to Division of Highways, Commissioner Bell said that it appears
the Highways h~gineers drew the routes from an aerial mosaic
without reallzing the difficulty of traversing the creek bed.

VI NEW BUSINESS
A. Set date to reorganlze Commlss1on 1957-58
The Commission agreed on a tentative date of May )1 for a
reorganizational meeting of the Planning Commission at a
place to be designated later.
B~ Inquiry by General Petroleum reg9rdlng a service statlon SE
corner Blaney & Stevens Creek, Latest letter under date of
April 29 requesting public hearing.
Commlssioner Bell advised Mr, Rukan of General Petroleum
that Blaney Avenue will become a 90' road. Mr. Rukan said
they would agree to keep all improvements out of the pro-
jected roadway and that in any event the City will not be
responsible for removing any obstructions in the right of
way. Commissioner Palzis sald that the Commlsslon is
anticlpatlng a 120' width for Stevens Creek Road. From the
looks pi the plot plan this means a set back of 12 addition-
al feet. Mr, Rukan said that his company was willing to
set back the additional distance. Commissioner Paizis
moved that the matter be set for hearing on May 17; seconded
by Commissioner Neilsen, oarried 3 - O. Commissioner Bell
said he would ask Chairman Leonard, now absent, to write to
General Petroleum glvlng the requirements on road dedication,
sanitary distriot requirement, and estimated setbaoks.
C. Mr. & Mrs. D. Snow. Plans for a single family dwelling on
Peninsular Avenue. The Commissioners were agreed that a
single residence would not be effected to as great an extent
as a subdivision. It could not create such a problem either
for the home owners or the Division of Highways.
Burrel Leonard's letter of April 27 to the Division of
Highways was re8d and met with the approval of the Planning
Commlssion. Among other things the letter disputed the
formula approach as a valid criterion for route-making.
Howard McLaughlin, employed by the Division of Highways,
suggested that a specific and reasonable alternative be
offered if the Commlssion serlously desired a route differing
from either proposal.
Mr, Kyne said it was his belief that the Blue route is
most in favor, with the Green route preferred to the Red
route. Commissioner Bell said that no action can now be
taken.
IV B. The members present spent some twenty or thirty minutes
considering the maps at hand, identifying the streets and
roads, schools, and other landmarks.
