MINUTES OF THE PREVIOUS MEETINGS: July 22, 23, 30,
August 12, 15, 1963
Due.to the long agenda, the reading of the minutes was
deferred until the next regular meeting. This was moved
by Comm. Small and seconded by Comm. Fitzgerald.

A. Written:
(I) Letter from League of California, reviewing
current legislature of the State.
(2) Letter from John W. Parsley requesting a two-week
continuance on his application.
(3) Agenda for the August 21st County Planning Com-
mission meeting.
(4) Letter from the Sanitary District regarding
ordinances.
(5) Communication from the County Planning Commission
requesting delay of Application 93-z-63 until they
have a chance to review this area as a possible
park location, as part of the Stevens Creek Park
Chain.
Comm. Small moved, and Comm. Fitzgerald seconded, that the
communications be received and filed.

HEARINGS SCHEDULED:
A. BOGDANICH BUILDING CO.: Appl. 86-z-63 to rezone 8
acres from R-l:B-D to R-l; adjoining the south side
of McClellan Road, east and west of Madrid Road. First
Hearing (Annexation in progress.)
Since the applicant was not present at the time set for the
Hearing, Comm. Small suggested action on this application be delayed
until later on in the meeting.
B. GEORGE YAMAOKA: Appl. 89-Z-63 to rezone 7.85 acres
from A-2:B-4 to R-3-H; on the south side of Lucille
between Blaney Avenue and Randy Lane. First Hearing
. continued.
This application was presented by Mr. Sidney R. Mitchell,
Consulting Civil Engineer. Chairman Frolich asked how large lots 4
and 5 were. Mr. Mitchum replied Lot 4 was about 1 acre and they pro-
posed 30 units for. it. Lot 5 was It to 1-3/4 acres and they proposed
60 units for it.
Chairman Frolich pointed out the parking problems with
multiples in a cuI de sac, and wondered if the developer would go to
the ratio 2:1 instead of the usually required It:l parking spaces per
unit. Mr. Yamaoka stated he will endeavor to have as close to the
2:1 ratio as possible.

Comm. Small questioned ~¡hether Mr. Yamaoka had surveyed
the apartment situation in Cupertino lately. Mr. Yamaoka stated he
had checked the situation in Cupertino and surrounding areas, but isn't
worried about it because he intends to put in first class units and
feels he will have no trouble renting them.
Comm. Fitzgerald asked how many stories high this develop-
ment would go and what the buffer against Lynwood Acres would be.
Mr. Yamaoka stated the buildings would be two-story and the carports
would be up against the property line to act as a buffer.
Blueprints showed only one street going out to Lucille Ave.
Comm. Small wondered if this area would lend itself better to a garden
apartment setup.
Comm. Fitzgerald suggested that before the next hearing,
Mr. Yamaoka's engineer should get together with the City Engineer and
work out a better street plan.
Since there were no comments from the audience, Comm.
Fitzgerald moved that the first hearing be closed. Comm. Small seconded.

C. ELL VEE CONSTRUCTION CO.: Appl 91-2-63 to rezone
34 acres from A to R-24-H; bounded on the north by
Stevens Creek Blvd., on the east by the lands of
Foothill College, on the south by McClellan Road
and on the west by the Southern Pacific Railroad.
Second Hearing. (Annexation in progress.)
Presentation was made by Mr. Ned Abrams, Architect. He
indicated it was essentially the same concept as the Moldaw appli-
cation 26-u-63, which was approved at the August 15th Planning Com-
mission meeting. ~1en completed, there will be 400 individually-
owned homes with a common green and responsibility for the maintenance
of it and the streets will be the homeowners through their association.
This development will be comprised of two-story units with the car-
ports beneath the patios with 12 units per acre.
The problem of traffic came up. Comm. Fitzgerald asked if
the developer planned to put in the road along the railroad tracks
right away. Mr. Abrams stated there would be a 50' fully dedicated
street along thé fI'eeway,instead of a street alorig the·. nailroad -
tracks. If the financing for the whole street is possible right away
the developer plans to dö this. Comm. Small felt there would have to
be provision to get the traffic out to Stevens Creek Road since
McClellan couldn't possible handle it all.
Mr. Robert Shook, Ass't City Engineer, stated his depart-
ment had contacted the State and they inferred the corporation yard
adjoining subject property was permanent. He also stated there will
be 300' divider strips, 16' wide along Stevens Creek Blvd, making
left-hand turns available.
At this point, Mr. A. C. Barlow, 21739 Terrace Drive,
Cupertino, submitted aþetition, signed by 236 citizens, protesting
the rezoning of subject property.
Comm. Adamo asked how zoning this area Industrial would
alleviate the traffic situation. Comm. Small questioned the City
Attorney regarding whether any rezoning would have to be subject to
the ordinance of annexation. Answer: yes.
Comm. Fitzgerald wondered if perhaps, instead of a zoning
problem, there was an engineering problem involved. He suggested the
principles meet again with the City Engineers to resolve the traffic
problems.

D. WILLIAM H. CRAFT, et al: Appl. 92-Z-63 to rezone ap-
~roximately III acres from A-2:B-4 to PC-H; on the
north side of Stevens Creek Blvd east and west of
Calabazas Creek. First Hearing.
Mr. Boris Stanley, Attorney, 10111 S. Saratoga-Sunnyvale
Rd., Cupertino, presented this application. He introduced a tentative
map showing 34 acres as C-l (commercial), 18 acres as P-O (profession-
al), 23 acres as M-1 (industrial), and 16 acres as R-3 (multiple).
Twenty-six of the III acres will be in freeway, creek, and roads.
Mr. . Stanley indicated that the height of the buildings in the R-3
development would depend upon a lot of factors, but definitely would
not exceed 3 stories.
Comm. Fitzgerald stated that the master plan shows R & D
where C-l is indicated on this map. Mr. Stanley stated that because
Cupertino does not as yet have R ~ D zoning, this tentative ~D does
not preclude this type of zoning.
Chairman Frolich felt it was in order to invite the Plan-
ning Consultant to the next regular ~lanning Commission meeting.
City Engineer Lahi pointed out that on 25% of the information was in
so far, but that he would see to it that the files are completed before
the next Hearing.
Attorney Anderson added that road plans should be compat-
ible with surrounding streets. Mr. Lahi indicated that the major city
streets, as planned by the State, are on file at the City 1~11, but
that this problem should be ironed out between the neighbors involved.
Chairman Frolich questioned the advisability of having Amherst opened
up into the industrial park.

E. VALLCO PARK, a corporation: Appl. 94-z-63 to rezone
275 acres from A,M-l and A-2:B-4 to PC-H; between Homestead Road and
Stevens Creek Blvd east and west of proposed Wolfe Road. First Hearing.
Mr. William Watson, of Roclcrise and Watson, presented the
overall plan. He stated the plan was for a long term lease rather
than sale of the property, and that they were asking for general
zoning now.
Mr. Allen Walter, the architect in charge of the overall
planning, stated that 4~ years ago these property owners joined tc-
gether. He read so~e of their objectives drawn up at that time:
1. That drifting without planning must end.
2. Long range objectives should be stated.
3. Suitable roads needed.
4. The community cannot exist on middle-class homes alone.
5. A comprehensive general plan is needed.

Mr. Walter went on to say that Varian intended to 3pend
between $150 million and $190 million on this industrial parl~ over
a ten year period. They would have between a $75 million to $100
million payroll.
Mr. Blaney, of Livingston and Blaney, Planners, in pointing
out how the Cupertino site was chosen stated that:

Varian wanted quality environment.
Varian 'wanted a site where traffic could be handled.
Varian wanted a site where it would be in the center of future
employees, keeping traffic problems down to a minimum.
Varian and Vallco sought annexation last spring.
He went on to say that the exterior of the buildlngs would
be cOmpatible with the R & D, whether they were used for that purpose
or not. He stated that the development would take between 10 to 15
years, and that they would employ between 11,000 and 12,000 people.
He also stated that the entrance would be on Homestead Road and that
the day shift would probably be comprised of about 5,900 people.
Mr. Blaney indicated that Wolfe Road must be completed at the time the
State is building the freeway or they will not include that inter-
change. Pruneridge will be 4-lane to Wolfe Road. It is' estimated
that about 50% of the people will use the freeway.
Mr. Blaney foresaw 2 major problems:
height is needed to make 2 manufacturing floors
setback should include parking.
Homestead east of Wolfe would have a 60' yard instead of
20'. East, along vlestwood Oaks, would be a 20' landscaped buffer.
Stevens Creek Road would have a 60' landscaped setback. West, along
side Idlewild Greens, would have a solid wall fence with 20' land-
scaped.
(1) 42' maximum
and (2) the landscape
At this point, Mr. Howard Patterson, representing Varian,
stated that when Vallco Industrial Park is completed, it will be
about the size Stanford Industrial Parl~ is now. He stated that it
would be filled up within less than 10 years.
Comm. Fitzgerald said that since the Tantau improvement
would be a necessity, who would put in the Tantau overcrossing of
the freeway. Mr. Patterson indicated the developer would pay for
roads used chiefly by their employees. A 6-lane Wolfe Road would
be dedicated by Vallco. Vallco will dedicate the roads as shown on
the map insofar as they are on subject property.
Mr. Roy Roberts, 824 Parnell Place, Sunnyvale, was glad to
see no access road to Linnet Lane.
Comm. Fitzgerald moved that the first Hearing be closed.

Mr. Clauss Fritzen presented a tentative map and stated the
intent of the developer.

At this point, the communication from the County Planning
Commission was brought up. To help clarify the situation, Mrs. Dorothy
Varian, 10114 Crescent Road, Cupertino, recounted her conversation
with Mr. Belser, who stated the Board of Supervisors had agreed to. pay
50% of the development costs of a parle in this location. She indicated
they wish to have this property held available until the bond issue
comes up. The County plans to malce a formal presentation at that
time.
The Cupertino Planning Commission stated they would go
along with the wishes of the County Planning Commission to delay
passing on this application for a reasonable length of time.

Mr. Gene r~stin presented the tentative map which showed
the front of the property as commercial and rear as R-24. What they
would like to put in here is garden anartments with a small commercial
area in the front. There would be 144 units, with a pañcing ratio in
excess of 2:1. Comm. Fitzgerald asked if all the parking would be
along the property line. Answer: yes.
The general feeling of the Commission was that it would be
much wiser to extend the multiples right out to Highway 9 or to go all
commercial with this property.
Comm. Small moved the first Hearing on the zoning be
closed, with the stipulation that the tentative map study be con-
tinued. Comm. Adamo seconded.

Mr. Ants Lahi gave a staff report on the Oakdell Ranch,
Unit 2. He requested that the developer get together with the City
Engineering Department regarding future curb lines and slope easement.
Mr. Jack Kuzi, of MacKay and Somps, received approval, subject to the
sol1Jtion of the aliü;nment and right-of-way problems on Stevens Creek
Blvd. Slope easements will be necessary.
