Board Room, Cupertino Elementary School District Due to a misunderstanding of the meeting place by the Engineering Department, the meeting was delayed until 8:30 P.M. I SALUTE TO THE FLAG II ROLL CALL: Commissioners present: Fitzgerald, Rampy, Small, Thomson, Frolich Commissioners absent: Adamo, Snyder Staff present: City ClerIc Engineertng Inspector MINUTES OF THE PREVIOUS MEETINGS: January 27, 1964, and Study Session on January 23, 1964. Comm. Small moved, and Comm. Fitzgerald seconded the motion, that the minutes of January 23 and 27, 1964, be approved as read. III COMMUNICATIQNS: A. Written -- None that did not apply to applications of the agenda for this evening. B. Verbal -- None IV HEARINGS SCHEDULED: A. GEORGE YAMAOKA: Application 89-2-63 to rezone acre-s from A-2 :B-4 to R-3-II; on the south side Lucille between Blaney Avenue and Randy Lane. by City Council. 7.85 of Returned ¡VIr. Yamaoka explained that he was the owner of subject property and distributed copies of the new road pattern to the Commissioners. In his opening statement, Mr. Yamaoka stated that it would be very difficult to put R-l so near the freeway and Blaney Avenue. He designed a road pattern that would encourage all right turns inro and out of the development. The Engineering Inspector stated that the road pattern has been checked and approved by the City Engineering Department and noted that the right turns onto the main thoroughfares are highly acceptable. -1- Comm. Fitzgerald asked how many units were planned and if they were one or two story. Mr. Yamaoka stated there were 174 units, as before, and they would be both one and two story units with 1 garage and I carport for each unit. Comm. Rampy stated that his main concern with this pro- ject has been the traffic pattern, which has been cleared up with this new map. Comm. Small asked if the applicant had considered the vacancy factor in this area and cited several in the the area with a very high percentage of vacancies. Mr. Yamaoka said that his plans have been approved by FHA, and that they check into this type of situation before granting approval. He stated that he planned to build a first class development and charge a minimum rent, thus making it attractive to potential renters. Mr. Yamaoka has done several similar projects in the Sunnyvale area and has not had any vacancy problems and does not anticipate any here. Comm. Thomson noted an error on the map -- there are 9 lots whereas the map shows 10. said there are actual1yJlO lots. the key says Mr. Yamaoka In answer to Comm. Fitzgerald's question whether he had considered bUilding town houses, Mr. Yamaoka said he had explored the situation and found they were having a hard time selling them. It was his contention that ~ is easier to rent apartments than sell town houses. Chairman Frolich asked what the rental fees would be. The applicant felt the range would be from $105 to $125 per month. After considerable discussion whether or not 176 units would be acceptable on this acreage, Chairman Frolich felt a report from the City Staff at the Second Hearing would be in order. Comm. Small asked whether there were any elevations to evaluate at this point. The applicant stated he would have them at the Second Hearing. Chairman Frolich asked for comments from the audience. Mr. Robert Jacobs, 19851 Baywood Drive, Cupertino, wanted to know how large these apartments would be to get an idea what effect this development would have on the schools. The applicant said they would one and two bedroom units. Comm. Small moved to close the First Hearing. Co~n. Rampy seconded the motion. Comm. Small moved to have a site layout plan incorporated into the application and to require a corrected map from the applicant be reviewed by the City Staff. Motion was seconded by Comm. Fitzgerald. Motion carried, 5-0 -2- B. MASON ENTERPRISES, INC.: Application 1-2-64 to rezone 20 acres from R-I:B-2 and R-3-H to R-24-H; between Blaney Avenue and Portal Avenue, 500' north of Stevens Creek Blvd. Second Hearing. Tentative Map application I-TM-64 (176 lots). Mr. Louis Tersini, of Mason Enterprises, stated that they had presented their application fully at the First Hearing and asked for opinions and questions from the Commission and the audience and then he and his associates would rebut. The City Clerk stated that City Hall had received a petition against this development, signed by 353 people, most of whom lived in the Idlewild Grees, Triumph and Baywood subdivisions. Chairman Frolich asked for comments from the audience. Mr. Robert Jacobs, 19851 Baywood Drive, Cupertino, reminded the Commission that a town house development proposed for an area on Foothills Blvd, which also was designed by Mr. Goodwin Steinberg, was recently denied by both the Plalming Commission and the City Council. He also felt there would be undue overcrowding in Portal School and that the traffic problem ',.¡ould be compounded. Mr. Jacobs then asked permission to show some slides he had taken of the Eichler town house development with cars and boats, etc., displayed in the parking lots, as opposed to pictures of some well-kept homes in subdivisions surrounding the property in question. One other point of interest that Mr. Jacobs brought out was that the Council was meeting on this date at City Hall to discuss the po:ò::J1bl11ty of considering this as a park site for the City of Cupertino. Mr. Joseph Streiner, who said he lives in the Triumph tract, said this was R-l when he and his neighbors purchased their homes and they hope the master plan will call for compatible zoning in that area. The following people wished to go down on record as strenuously objecting to this town house development; Mr. William Utterback, 19777 Wheaton, Cupertino Mr. Thomas Traeumer, 10376 Tonita Way, Cupertino Mr. Keith Irwin, 19843 Baywood, Cupertino Mr.. William Botsch, 10184 Portal, Cupertino Mr. R. H. Nebel, 10226 Portal Avenue, Cupertino Mr. George Koonce, Blaney & Merritt, Cupertino Mr. Ed MacGuire, 19776 Amherst Drive, Cupertino Mr. Joe Sparagna, 10415 Plum Tree, Cupertino Mr. James Monaghan, 10167 Dennison Ave., Cupertino Mr. Charles Alexander, 10270 Portal, Cupertino -3- The Mason Enterprises representatives then proceeded to show the audience details of the project to which they were objecting. It was the feeling of Mr. Tersini that if the objectors understood the quality of the town house project planned for this property as opposed to what might be built on it as it is presently zoned, that they wouldn't be so violently , opposed to it. He explained to the audience that portion on Stevens Creek Blvd. is already zoned multi- ple and once it is built, the owner of the adjoining property could quite properly come in and ask for multiple zoning for adjacent property, thus ending up with a great number of apartments on this property, which would create a much worse traffic problem. He then gave a recap of the details as presented at the First Hearing. Mr. Goodwin Steinberg mentioned that he had checked with the school district and they told him a development of this type would probably not present a hardship to them. An FHA representative commended Mr. Tersini on this develop- ment as the best thought out plan he had seen in Northern California. When all who wished to had spoken, Comm. Small again explained the pros and cons of the town house d~velopment as planned and the alternatives for this land. Comm. Thomson moved to table this application until the next regular meeting to enable th~ Commissioners to do a little research of their own on the merits of this appli- cation. Motion was seconded by Comm. Fitzgerald. AYES: Comm. Fitzgerald, Rampy, Small, Thomson, Frolich NAYS: None ABSENT: Comm. Adamo, Snyder Motion carried, 5-0 D. CALDELT INVESTMENT CO.: Appl. 2-u-64 for a Use Permit; Property zoned PC..H, 1 acre on north side of Pacifica Drive, 400' east of Highway 9. Use Permit sought for a Medical Dental Building. Second Hearing. Mr. Steven Olian, 1906 Irving Street, San Francisco, was the representative from Caldelt. He stated that he had verified it with the City Engineering Department that commercial and professional use of this land will be intermingled. Comm. Small moved to close the Second Hearing. Comm. Rampy seconded the motion. Comm. Small moved to recommend approval of application 2-u-64 to the City Council, subject to the satisfaction of the City Attorney. Motion was seconded by Comm. Rampy. AYES: Comm. Fitzgerald, Rampy, Small, Thomson, Frolich NAYS: None ABSENT: Comm. Adamo, Snyder Motion carried, 5-0 -4- E. ELDRED J. KUNKEL: Appl. l-v-64 for a Variance to allow a front yard set-back of 1314" where Ordinance requires 201; southwest corner of Wolfe Road and Vicksburg Drive. Mr. Kunkel stated that upon further examination of his plans, he felt the variation should be on the rear of the property rather than the front. Chairman Frolich stated that this would then cause a delay in that the Published Hcaring was for a front yard set-back and that it must be readvertiaed to enable interested per- sons to be represented before the Commission makes any decisions. There were half a dozen or so interested neighbors present and they were invited by the Chairman to come forward and look at the plans and discuss the situation with Mr. ~1Dkel. They were all happy with the results of this discussion. Comm. Fitzgerald moved to table this application until the next regular meeting. Motion seconded by Comm. Small. Motion carried, 5-0 V UNFINISHED BUSINESS -- None VII NEW BUSINESS A. Miscellaneous -- None B. Set time for next regular Planning Commission meeting. February 24, 1964, is a holiday for City Staff. Chairman Prolich announced that unless otherwise published, the next Planning COlInnission Meeting will be held at Cupertino Sonior High School on Wednesday, February 26, at 8 P.M. This was made in the form of a motion by Comm. Rampy and seconded by Comm. Fitzgerald. Mot ion carried, 5-·0 The Chairman asked that the Assistant City Engineer be in- structed to "red flag" the tIme and place of the next meet- ing on the next agenda to call attention to any changes.
