,Commissioner· Leonard moved that ·the applicant be notified
by letter that the Cupertino Planning Commission in general,
is trying to hold to a minimum multiple zoning in the upland
area where road and traffic conditions make it unfeasible for
prime residential load. Seconded by Commissioner Fitzgerald.

from the audience. There were none.

Stevens Creek Freeway. Second hearing continued.
Mr. Herman Ruth, representative for St~neson Development, arose to
answer any further questions the Planning Commission might have regarding
the application. Mr. Ruth introduced Mr. Schumacher, Executive Vice··
President of Stoneson.

Commissioner Adamo asked if Mr. Leonard's questions of last meeting
on the utilities had been answered. M~. Ruth assured the Commission
that these details were worked out early in the design.
Commissioner Leonard asked about the well on the Fisher property, and
whether the lack of sufficient water for the entire 69 acreS woul~ .
prohibit develppment. He pointed out that. in 10.or 15 years,the:t'e may
be sources of water for the total acreage, but·untl1 then there may be a
problem. The 16 inch main across the north end of the property would
handle 20 or 30 acres. Perhaps this problem should be ironed out before
we consider zoning.
Commissioner Fitzgerald asked how soon develoj'·.l1ent is planned.
Mr. Schumacher pointed out that it is their opinion that the need
for the development is here now, but that ,it would be apprqx:!.!I18.tely two

years before Stoneson is ready.
Commissioner Leonard pointed out that on the Town Center application,
the Commission finds itself in the position of having made a recommendation
and thel1 having it changed. It may not be unreasonable to wait until we
see where we stand in respect to an ordinance.
Mr. Ruth commented that he attended the last Council Meeting, and thàt
it became apparent that the ordinance was not effective. There were too
many requirements to make the ordinance workable. The application now before
the Commission is the first stage of a two-stage development, and it will
again be necessary for the Stoneson Development Corp. to appear before the
Commission to demonstrate precisely the second stage of development at a
later date.
CommiSsioner Frolich stated that in effect, the Commission has been
asked to approve an application for something which may change by the time
it gets to Council.
At this point in the meeting, the Chairman was notified by the City
Council that they are returning the resolution to the Commission for
amendment.
The City Attorney summarized the changes to Ordinance 2L: There were
considerable arguments brought forth by Mr. Rodrigues regarding changes in
the ordinance, and the meeting was continued until December 10. The City .
Staff then prepared a new ordinance 2.0, which has been reviewed by Council.
The matter is now before the Commission for public hearing. It is the
opinion of the City Attorney that details should be reServed for the next
meeting, and Mr. Ruth, Mr. Rodrigues, and other interested parties should De
notified! The press release indicated that there was feeling that Ordinance
2L had been changed;' At the June 25'meeting, there were·.éhanges made, which
were mailed to the Commissioners on July· 17. The resolution was adopted on
July 23. If no action on the changes is taken by the Commission within 40
days, this in effect means the changes are approved. It is unfortunate these
matters were not brought out, because now it is necessary 'to redo the
resolution.
Commissioner Frolich moved to continue the hearing until January 28.
Seconded by Commissioner Fitzgerald. All in favor.
Commissioner Frolich moved to continue the application until the next
regular meeting of the Planning Commission, seconded by Commissioner
Leonard. All in favor.
Commissioner Frolich moved that a study session be set up. Seconded
by Commissioner Ftizgerald. All in favor.
The City Attorney stated he thought it better to keep the hearing open.
If the hearing is closed, then reopened, interested parties do not know
about it.
Commissioner Leonard felt an alternate solution would be to continue
the hearing until there is an ordinance.
Commissioner Fitzgerald moved to revoke the motion closing the hearing,
seconded by Commissioner Frolich. All in favor.
Commissioner Fitzgerald moved the hearing be continued until the
meeting of January 28. Seconded by Commissioner Leonard. All in favor.
Commissioner Frolich moved that Ordinance 8020 be set for public
hearing before the Planning Commission December 26. Seconded by Commissione:·
Fitzgerald. All in favor.

Commissioner Leonard moved for adjournment until Tuesday evening,
at 8:00 p.m. Seconded by Commissioner F~olich.

December 11, 1962
Mr. George Volker, introduced Hans Westburg and Calvin Platt, from
the Planner's office.
Four maps and an aerial photo were on display, and were explained by
Mr. Volker. Also on display was a chart of Traffic Volumes.
Commissioner Leonard felt the first map did not show the industrial
trend clearly, and that the electronic firms should most definitely be
shown, since the Bay Area is recognized as the second largest electronic
center.
The Use Map extended to Cox Avenue, however Mr. Volker pointed that
Prospect Rd. has been the boundary for their other studies. The Commission<-
requested the continuing use of Cox, since this more clearly reflects our
boundaries.
The Existing Zoning Map will be updated as changes occur, and the
Planner's office will check with the City Clerk for recent changes before
publishing maps.
In 1961, the number of daily t~ips originating from, or terminating
in Cupertino was 70,886. There were 16,800 daily internal trips within
the City. Also shown on the Traffic Volume chart was the following:
In 1957, at Stevens Creek & Hwy 9 intersection, 12,000 vehicles daily;
1961 - 21,000 vehicles daily.
San Jose was not shown on the planning map; however, Mr. Volker will
add this data for presentation at the meeting in January. Inquiries to
the San Jose offices provided indefinite information at this time.
Commissioner Fitzgerald suggested that perhaps schools might be left
uncolored to stand out more clearly,
Commissioner Leonard asked Mr. Volker if having a member of the
Commission accompany members of the Planner's office might not be helpful
on data-gathering trips. Mr. Volker felt this would be most helpful, and
his office will check with the City Clerk to see which of the Commissioner"
might be available.
Mr. Volker referred to the meeting scheduled for January 15, at which
public school enrollments, eváluation of city public buildings will be
discussed. A single report in finished form will be presented at the
February meeting which will be an analysis of the material presented to d&~
The preliminary design sketch will be presented in March. On May 1,
the Preliminary General Plan will be presented. The Final General Plan
will be presented September 1. By this time, it is expected that a public
hall, or auditorium will be needed to house the meetings, due to anticipat
Mr. John Myers, who is on a Sub··Committee for the cupertino Elementar~;
School District, and is preparing an evaluation of the school district's
needs for the next 10 years, appeared at the meeting in hopes that some
of the Planner's data might be useful to his study. Mr. Volker stated
that he would keep Mr. Myers informed.
Commissioner Frolich moved the meeting be adjol1rned, seconded by
