Comm. Frolich wanted it indicated in the June 8th M1.nutes that
he was not at that Planning Commission meeting because he was
re,presenting the Corrímisston at the CJty Council meeting that
"ame night at the 'City Hall. ' ,
It was moved by Gomm. Gates and seCOnded by Comm. Snyder to
accept: the Minutes of Jùnë 4 & 11 and the Ninutes as corrected
for June, 8th.

come to this Planning CommISSion meeting to swear in the two
new Commissioners. However,sJnce another Commissioner will

(a) Considered changing name o:f Bubb Road to Kennedy
Drive.
(b) Request by Mr. Smith to have R-12 zoning on the
property near Garden Gate, off Stelling, was
denied by the County Planning Commission without
prejudice.
5. Letter from Wilsey, Ham.& Blair consultant, Nr. Schoen-
feld, informing the Commission that thirty copies of
Section 31 on the Planned DevelopmenthNe been given
to the City Staff. The Assistant City Engineer said
they have been received and distributed.
It was moved by Comm. Snyder and seconded by Comm. Johnson
to receive the written communications.

B. Verbal
1. Mr. Bud Bacon, of Silver Pools, asked the Planning
Commission for a sign variance for his commercial
property fronting on Blaney. He was advised by
Chairman Thomson to go to the City Hall and make out
an application first. The City Attorney said the
Public Hearing would be required.
2. Mr. Riccard, 11120 Santa Teresa Drive, asked the Chair-
man what the criteria is for approving or denying an
application. He was referring specifically to the
Ruth & Krushkev application and noted the petition
with over 400 signatures against this application.
The Chairman said many things were considered -- among
them: traffic, water, nature of the plan, the master
plan, density, vacancy factor, etc.
3. Mr. Robert Jacobs, 19851 Baywood Drive, inquired about
a 20' strip o:f sidewalk that is needed on Blaney,
south of Pear Tree Lane, so the school children will
not have to walk in the street on their way to the new
Porta 1 SchooL He· wàs referred to the City Manager.

south end of Mt. Crest Drive. First
Mr. Griffith said he plaDned to make two 1/2 acre lots. He
explained he is putting a 2500 sq. ft. home on the one lot
and plans to put a similar or better one OD the adjoining
lot.

Comm. Johnson asked if the two homes would be on the back
portion of the acre. Answer was in the affirmative.
The City Planner said he had no objections to this rezoning.
Comm. Frolich asked if the applicant has an easement ar-
rangement with the adjoining property owner 1'or a 40' street
here. The Assistant City Engineer said this has all been
taken care 01'; He said the applicant has approved draw-
ingsfor the installation of the road.
Comm. Snyder asked if the Sanitary District can provide
sewers for these two 1/2 acre lots. Answer was yes.
Chairman Thomson asked about the slope 01' the land. The
applicant said it was to the north.
Chairman Thomson asked for comments from the audience.
There' were none.
It was moved by Comm. Frolich and seconded by Comm. Johnson
to close the Public Hearings.

It was moved by Comm. Frolich and seconded by Comm. Snyder
to approve application 16-Z-6J¡, subJect to the 12 standard
conditions except for those governed by the Hillside
Ordinance and subject to the roadway arrangement worked out
to the satisfaction 01' the City Engineer.

There was a comment 1'rom ~~. RiccaI'd. He said there is a
sign, "Will Build to Suit" where Terrace Drive blends into
Santa Teresa and wonders if this is legal. Chairman
Thomson stated that the C8mmission relies on the City Staff
to check on such matters.
Comm. Frolich suggested Mr. RiccaI'd check with the City
Engineering Department on this. He said that at the time
the tentative map comes before this body it will have all
the pertinent data on it.
V UNFINISHED BUSINESS
A. Niscellaneous
Nr. RiccaI'd wondered when Shell Oil will be improving the
Bubb and Ste,lling intersection. 'l'he Assistant City Engineer
said the 'pavihg should 'be completed later this week.

B. JOE & VINCENT MAGGIO: Appl. 6-TM-64 for approval of a
tentative map; west side of Blaney Avenue at LaMar Drive.

~~. Jack Fleming, of Mark Thomas Civil Engineering, stated
that Nr. Maggio had planned to present the map but had been
injured so he was there in his, place. He said this in-
volves 1 acre on the west side of Blaney near Somerset.
A year ago the Maggio brothers put in a street to create
building sites. At this time they wish to split the pro-
perty into five lots, two of which their existing homes
will occupy.
Nr. Fleming felt it would be a financial burden for the

Maggio brothers to 'havèto rile a ¡¡¡ubd;1vision map. He
asked that they be al10wèdtò filea,recprd of survey instead.
The city Attoríléysaidit would be sufficient to file a
Record .of Survey in this case. He said it would be different
if this created illegal lots. He stated that this case fits
into Section 4 :2': (c) of the Subdivision Ordinance and per-
mits a, Reèord o.fSurvey since the improvements have already
been completed.
,The Assistant City Engineer said he accepted the City
Attorney'é interpretation of this ordipance.
The City Attorney said this body could not withdraw 1'unds
from the General Fund, however, to repay the $50.00.
The City Attorney recommended the Planning Commission
authorize the filing of a Record of Survey for appl. 6-TM-64.
So moved by Comm. Frolich and seconded by Comm. Snyder.

The City Attorney felt the applicant should not have to pay
the $50 fee in this case.
