He cited the repo11 submitted documenting trips generated per thousand square feet; Staff Report noted that even if giveP the 40% for clivened side nips, the trip gc "1crntion factor would be 6.6 r.rips per thousand squru·e feet. SwJf suggested a continuance of this Item to allow 1.he Applicant time to address the above concerns. Mr. Daniel Bryant, Proprietor, stated that an already existing sit~ of Eggroll Fantasy was primarily a restaurant operation with a portion of the. business a ta.kc-out operation. He presented studies showiug: -Origin of patrons before corning to a restaurant (Chan 9, industry wide figures); he esti- mated that 65% of their business was side trip diversion Population demographics within a 3.0 mile radius, including E.s.li.r:ruttci.J'~w;..s.;, Eating and Drinking Places; he added that the restaurant did not generate trips; rather, the restaurant competed for tl1e sales dollar. The proposed location of the restaurant would reduce trips Chart of D.illl.Y-5.ill.c..s., including amount of average sale and number of peak hour sales; study completed over a three month period. Applicants would not maintain the present site, sincr: the new site was a better market area· and offered a long term lease; he confumed tho.t no more than four employees would be on site even during peak hour operacions; 1'.lr. Allan Byer, Proreny Owner, supponed the proposed operation and added that De Anza Shopping Center did not have a large volume of traffic nor djd they have phms for another ' restaurant in the Center. !vir. Consensus reached by the Commission that a favorable vote was not possible without the Apr-licant ad.dressing the traffic issue; Applicant was agreeable to a continuancl~ of this Item. Mr. Louis Buenda requested a prompt resolutio:1 of this issue due to the upcoming peak business peiiod. He added that food prepano.on wouid be done at a central location and not · on-site, thlls the proposed four employees would be sufficient even at peak hours. The Public Hearing was then opened. Szabo concuffed and noted the current parking deficit which spilled into a residential area. Com. Adams objected to the a.rchitecrurnl n>otif of Building l, the p:Jrk:ing deficit and the location of the trash ,nclosures. Vice Chr. Sorensen summarized concerns of the Commission; Mr. Schmidt requested f u.rther direction regarding uses for Building 1 and cited time and financial constraints on the project. He requested ;,i deci.s~on in order to procee.d w me Council as soon as possible. Mr. Piasecki summarized the issues of the Commission as follows: Linkage of driveways both off site and on site with Cicero's Modification of square footage to confonn ·with parking requirements of the City Modification of archite,cture of Building 1 Ddin.ing the limits of the bar/lounge activity Shifting of Building 2 to the north to provide adequate landscape screening on-site Com. Adams did not wish any expansion of the "Village Gent," ".Nitc Cap" or bar/lounge activity. Mr. Schmidt confirmed drnt expamion of square footage or use of r!ither operation was not being considered; he stated that he could not speak for these establishments. Expansion of Hamasushi would be used for banquet and/or open seating for dining. Co~. Adams commented that plans for modificarions to I.he parking had not been seen by the Commfasion; however, Building I was unbalanced and the second story appeared to be a.n add-on. ConcwTence reached by the other members of the Commissicm. Mr. Schmidt was favorable to a Cominuance if such wou!d rot delay the date of the Council Hearing; since lhis was nor possible, he requested that the Commission vote in order to proceed with an appeal to the Council. Vice Chr. Sorensen noting the public pres.em for this Application, revi~we.d rl1e Brown Act and stated that the Commission would hear testimony concerning the Ice Rink under Oral Communi<:ations. Ms. Cocker stated that the Application before the Commission did not address the issue of the kc Rink and that any testimony would be taken after hearing Item 4. Smfifu.'i.k~tatiQ!l;. Mr. Caughey reviewed the history of Application 31-U-86; a floor area plan showing options for developing this area were presented. He noted the minor access problem between the: lower tenant space and the expanded parking garage; a cross section diagram showing the tunnel to be used to rem~dy this situation was shown. Mr. P••trck McM:L1an, Save the Valko Ice Ri!ik Committee, stated that statements m;111e by Westfield, Inc., namdy, that every effort w keep the Ice Rink open had [)een accepted in good faith by the public; current develop.ments were disquieting. Especially disqdeting were statements that pahaps the rink would not continue to operate. He asked that the Commission do what.cvcr was in their power to ensure continuance of the Jee Rink. !v!r. Fritz Ea1on thanked the Commfasion for being so kind to Westfield Inc., in approving the retail space desired.
