MINUTES OF THE REGULAR MEETING OF THE PLANNING COMMISSION HELD ON f£SRUARY 13, 1984 IN THE COUNCIL CHAMBER, CITY HALL, CUPERTINO, CALIFORNIA
Chairperson Blaine called the meeting to order at 7230 p.m.in the Council Chamber, City Hall.

It was moved by Com. Adams, seconded by Com. Koenitzer and passed unanimously t.,., approve the rninutes of January 9, 1984 with pages 2, 6 and 8 amended.
It was moved by Com. Adams, seoonde~ by Com. Koenitzer, and passed with Com. Claudy abe~aining to approve the minutes of January 23, 1984 as su~mitted.

WRITTEN COMMUNICATIONS
Dirl9ctor of Planning and Development Sisk stated to the Cc.rrunission that Mr. Coward from ~ancho Deep Cliff had written the Commission requesting a new date of March 14 for the use permit hearing of Stevens Creek Stables. He went on to state that the Planning Department would readvertise.
It was moved by Com. Adams, seconded by Com. Koenitzer and passed unanimously to change the he&ring date of Stevens Creek Stables from February 22, '1984 to March 111, 1984.

The subject property is located on the east aide of Imperial Avenue approximately 100 ft. south of Lomita Avenue. First hearing. Tentative City Council.hearing date -Ma.rah -13, 1984.
Assistant Planning Director Cowar1 p~esentod a staff roport to the Cotllllission.
Kim Johansen, 71118 Chiala Lane, had no comments for the Commission other than that the existing buildirAg on the site would be demolished.
It was moved by Com. Claudy, seconded by Com. Adams an~ passed unanimously to olose the public hearing.
It was moved by Com. Adrua5, seconded by Com. Claudy and passed unanimously to approve the granting of a Negative Declaration.
It was moved by Com. Adams, second.ad by Com. Koenitzer and passed unanimously to recommend approval of Application 14-Z-83.

Application 20-TM-83 (Revised) of De Anza Properties (John Vidovich): Tentative Map to designate the development phases and parcel subdivision of an approved mixed residential/office development consisting ·:1f 248 dwelling units and a 45,000 sq. ft. office building and Environmental Review¥ The p1--ojeot
was prcwiot,sly assessed, hence, no action environmental action is required. The subject property is located between Stevens Creek Bouleva?'d and Hodrigues Avenue approximately 800 ft. west of Blaney Avenue in a P (Planned Development w~th colll!llercial, office and residential intent) zonin& district. Direotor or Planning and Development Sisk presented a start: report to the Commission ~'3<lommending approval of the application. He went on to state that Mr. Vidovich does not wish to build the BMRs in the first phase of development and that Mi•. Vidovich would be discussing the iasuo with the City Council.
Marv Kh•keby, 7246 Sharon Drive, stated to the Comission that be anticipates a three year project at the site and
that construction on the office building would begin in either May or June with the residential beginning shortly thereafter. Mr. Kirkeby gave an explanation of the phased locations on the site.
Colll01ission discussion ensued with Mr. Kirkeby regarding phasing of the site and streets.
Com. Adams questio~ed the reason why the BMR units would not be included in the Phase I development.
Direotol~ of Planning and Development Sisk stated to the Commis$iOn that Mr. Vidovich was waiting for a decision. regarding the BMR unit.s from the City Couno:n.
Mr. Kirk~by stated to the Commission that it was more eoonomically feasible to build the BMR un:l.ts later.
Discussion enqued. between Co~isaion and staff .regarding the BMR unit fees and requirements.
Mr. Kirkeby stated to the Commission that Mt•. Vidovich wanted the City Council to reoonsider the value of the l3MR units and questioned whether the developer would have to build his development at a loss.
Commission discussion ensued regarding the application.
Com. Claudy stated that he would like unit 6 of the development to become unit 2 and that he would like Condition No. 17 amended to state that all of Rodrigues would go in at the development ~f unit 2.
Com. Adams questioned Mr. Kirkeby for his reasons for phasing the developrr.ent.. Mr. Kirkeby stated to Commission that for economlc reasons tho development was being phased and that the assessment fees were p~.aoing a heavy burden on the project.
It was moved by Com. Koenitzer, seconded by Com. Adams and passed unanimously to close the public hearing.
It was moved by Com. Adams, seconded by Com. Claudy and passed unanimously to recommend approval of Application 20-TM-83 (Revised) with the following amendments:

(McDonald ·~1) i Use Permit to oonstruot and op~rate a drive-through facility at an existing fast-food reataurant and Environmental Review: The Environmental Review Committee reoo!lll!enda the granting of a Negative Declaration. The subject property is located on the southeast corner of Homestead Road and Stelling Road in a P (Plannou Development with reoreational/entertainment intent) zoning district. First hearing. Tentative City Council hearing date -Febrtiary 21, 1984.
4. Criteria for Review of Drive-Through windows.
Items 3 and 4 were to be heard oonourrt:.;ttly, as per the. agenda.
Assistant Planning Director Cowan presented a staff report and a brief hist<:>ry on drive-up windows in the City of Cupertiuo.
The staff reoonnnended that the McDonald 'a application be continued until aft.ar the criteria for drive-up windows had been set.
City Attorney Kilian advised to Commission that they would need more findings in order to l.iroit the number of similar businesses with drive-up windows.

Assistant Planning Dir•ector Cowan presented a staff report to th~ Commission. He went on to state tbat he felt the matter of drive-through windows should ba controlled.
Com. Adams stated that he felt t~e design as presented would wipe out needed parking spotf; at the site.
Linda ca11an, 99 AL1aden Boulevard, stated to tho Commission that she felt there was no enthusiasm for drive-through windows in Cupertino and stated that thougt sha f9lt pollution was not an issue, community character definitely was. She went on to present statistics on three types or service,~d an explanation of the proposed plan··

Wayne Johnson, owner of' McDonald's, statec'i to Commission that the amount of transactions were higher at drive-throughs and that each transaction usually served more than one customer.
Discussion ensued between Commission and Mr. regarding the makeup of a transaction and various co the existing building.
Johnson changes.
Robert Clark, regional construction manager for McDonald's? stated to Commission that the new decor would be light, bright and simple. He went on to explain the design of the building and of the positive air system that would be installed.
It was moved by Com. Claudy, :;e~or.ded by Com. Szabo and passed unanimously to continue Application 41-U,-83 to the meeting of March 12, 1984.
Planning Commission listed the following recommendations to staff on dri ve-·thr•ough window ori teria:
Send criteria to Architectural and Site Approval Committee
for' r>e'liew. J .. ook at other uses in adjacent properties and increased impacts at the sites. Prohibit oa1•hop usage. Increase driva-through stations as appl"'OPl''iate. Limit the number of facilities in the City legally .and agendize the criteria to be revie~•ed at tb.e meeting of Ma1•ch 12.
