COMMISSION HELD ON MARCH 14, 1984 IN THE COUNCIL
CHAMBERS, CUPERTINO, CALIFORNIA
Chairperson Blaine called the meeting to order at 7:30 p.m. in the Council
Chambers, City Hall.

PUBLIC HEARINGS
6. Application 11-U-82 of COMMUNITY HOUSING DEVELOPERS: PUBLIC HEARING
1111 TO CONSIDER AN AMENDMENT OF THE USE PERMIT regarding design changes,
improvement requirements and other miscellaneous changes and
ENVIRONMENTAL REVIEW: The project was previously assessed, hence, no
action is required. The subject property is located approximately 150
ft. south of Stevens Creek Boulevard and 280 ft. east of Stelling Road
in a P (Planned Development with residential 10-20 dwelling units per
gross acre intent) zoning district. First Hearing. Tentative City
Council hearing date - March 19,' 1984.
Director of Planning and Development Sisk presented a staff report to the
Commission.
Linda Smith, Director of Community Housing Developers stated to the
Commission that the elimination of the carport structures was due to
economic factors.
Assistant City Engineer Whitten explained changes in the street design to
the Commission.
Commission discussion ensued regarding street dedication of adjacent
proeprties.
Roberta Holliman, 11155 La Paloma Dr., stated to the Commission that the
League of Women Voters supported the completion of the project.
Carol McDowell, 10422 Noel Avenue, stated to the Commission that she would
1110 like to see the project completed and that she had no objection to the
narrow streets.
It was moved by Com. Szabo, seconded by Coma Koenitzer and passed
unanimously to close the Public Hearing. •

Planning Commission discussion ensued regarding the changes in the
^' application.

Com. Claudy stated that he could not vot- on the application changes as he
• felt that the project, although admirable, was being downgraded.
' Linda Smith attempted to explain to tlhe Commission the reasoning behind
the cuts in the project. g

It was moved by Com. Szabo., seconded by C.m. Koenitzer and passed with a .
2-2 vote with Com. Koenitzer and !Co . Claudy abstaining to recommend

1 7. Investigation of complaints regarding P.J. Mulligan's.
Assistant Planning Director Cowan pre ented a staff report to the
Commission. .

Com. Claudy questioned staff as to whetae the Community Services Officer
, and the City Manager had been notified lire arding the incident reports from
the Sheriff's Department.
Assistant Planning Director Cowan stat-d to the Commission that the City
Manager had requested the Sheriff's D;ep.rtment to send copies of all
incident reports to the ABC Board whoj •uld then investigate for .possible .
, revocation of liquor licensing. 1

Discussion ensued between staff and Coum fission regarding various means of
notifying businesses and the. public of ity policy regarding the nuisance
issue.

?; Louie Feinstein, 4250 Albany, San Jose,'llo er of P.J. Mulligan's, stated
to the Commission that he had been orking with the neighborhoods to
. alleviate the problem by adding private •atrolling of the parking lot and
; the ambulance service. He commented that drinking in the parking lot was
probably not from his patrons but could Lb- from the 7 Eleven 'Store across
the street and then proceeded to give. explanation of the 2 a.m. closure
procedures used.

.Darlene Thorne, stated to the Commission that she was concerned with
element #2 of the proposed policy regarding amendment of the
non-conforming use ordinance and that she felt it would effect all

. , businesses in Cupertino. j
" Assistant Planning. Director Cowan gave .. brief explanation of the intent
,of the proposed policy.

Discussion ensued between Commission, staff and Ms. Thorne regarding
' control of uses permitted.
Lee Cheney, 10221 Adrianna, stated his' c•ncern to the Commission regarding
charges for false alarms.
Com. Szabo gave a brief explanation of the background of the false alarm Ilk
ordinance and its fees. li

• . Mr. Cheney suggested to the Commission that the City- should consider
'having its own police department.

Mr. Feinstein, stated to Commission that problems may become more severe
4111 if owners of drinking establishments fear- revokation if incidents are
reported to the Sheriff's Department and questioned whether his use permit
would be denied were he to expand his dining area.
Commission discussion ensued regarding definition of use permits and the
proposed policies recommended by staff.
It was moved by Com. Claudy, seconded by Com. Koenitzer and passed
unanimously to send a minute order to the City Council requesting their
direction regarding the policies.
8. Application 24-U-83 - Monta Vista Properties (Terry Brown):
Modification of setbacks for two lots located on the north side of
Granada Avenue _approximately 200 ft. west of Orange Avenue.
Assistant Planning Director Cowan presented a staff report to the
Commission stating that there had been a change in plot plan in the
application.
Commission discussion ensued regarding the lot lines.
Terry Brown, 21884 Stevens Creek Blvd., stated to the Commission that he
had discussed the change with Mr. Bill Harris the owner of the property to
the northwest and that he had stated there would be no problem.
It was moved by Com. Claudy, seconded by Com. Szabo and passed with a 3-1
4111/ vote with Com. Koenitzer abstaining to send a minute order to file the
reversal of the lot lines.
REPORT OF THE PLANNING COMMISSION
Discussion ensued between the Commission and staff regarding Resolution
No. 2489 of the Planning Commission.
Com. Claudy requested updated information regarding Seven Springs and
progress on Stevens Creek Blvd. and Foothill.
Director of Planning and Developement Sisk reported on the status of the
Seven Springs application and the progress at Stevens Creek Blvd. and
Foothill.
Chairperson Blaine reported on a public hearing regarding Highway 85 and a '
request from the. Parks and Recreation Commission regarding a volunteer for
the Civic Service Awards Selection Committee.
Com. Koenitzer was appointed to the Civic Service Award Committee.
Com. Claudy commented on the disappearance of the pond near his home.
Chairperson Blaine commented on a County Planning Commission meeting.
Meeting was adjourned at 9:20 p.m.
