Chairperson Blaine called the meeting to order at 7:30 p.m. in the Council
Chambers, City Hall.

APPROVAL OF MINUTES:
It was moved by Com. Koenitzer', seconded by Com. Adams and passed with
• Com. Claudy abstaining to approve the minutes of February 27, 1984.
POSTPONEMENTS OR NEW AGENDA ITEMS:
It was moved by Com. Claudy, seconded by Com. Koenitzer and passed
unanimously to continue item 6 Application 8-TM-76 (Revised) of LARRY
WILLARD for one month.

PUBLIC HEARINGS:
MINUTES OF THE PLANNING COMMISSION MEETING OF APRIL 9, 1894
1. Application 6-U-73 of VALLCO PARK, LTD:" AMENDMENT' TO USE PERMIT to
allow construction of a three level parking structure on westerly side
of the existing Vallco Fashion Park between the existing Sears/Roebuck
and Emporium stores. ENVIRONMENTAL REVIEW: The Environmental Review
Committee recommends the granting of a Negative Declaration. Vallco
Fashion Park is located on the east and west side of Wolfe Road
between Stevens Creek Boulevard and State Highway 280. First
Hearing. Tentative City Council hearing date - April 16, 1984.
Assistant Planning Director Cowan presented a staff report to the
Commission.
Walter Ward, General Manager, Vallco Fashion Park, stated to the
Commission that there was currently insufficient parking for clientele
during peak times and that they wished to complete the new parking
structure prior to the opening of the new Emporium store in November.
Mike Kelly, architect, 455 Beach St., San Francisco, gave a brief history
of the sound analysis done at the site and a description of the proposed
facility to the Commission.
Jim Mills, acoustical engineer, 3776 Thrust Way, Santa Clara, explained to
the Commission the noise level measured at the site and the concepts of
sound dissipation with regards to the proposed structure.
Commission discussion ensued with Mr. Kelly regarding the proposed
structure. •
Jack Greenspan, Costa Mesa, explained the distribution of compact vs.
standard size parking spaces in the structure to the Commission.
Rob Fair, 10226 Dennison Avenue, stated his concerns to the Commission
regarding noise at the proposed site.
Commission discussed the problems of noise and access with Mr. Ward.
Nicholas Timarheulen, 19630 Merrit Drive, commented to the Commission
regarding noise and pollution at the site.
Don Barbe, 10396 Norwich Avenue, stated his concerns regarding invasion of
privacy to the Commission.
Mrs. Schmitz-Salue, 20309 Silverado Avenue, questioned the Commission
regarding effects on property values in the area due to increased noise.
Margaret Kaito, 10154 Dennison, questioned the Commission regarding
traffic during peak hours and inadequacy of 4-way stop signs at the site.
It was moved by Com. Adams, seconded by Com. Claudy and passed unanimously
to close the public hearing.
Commission discussion ensued regarding the application.
It was moved by Com. Claudy, seconded by Com. Koenitzer and passed 10
unanimously to recommend the approval of a Negative Declaration.

It was moved by Com. Claudy, seconded by Com. Adams and passed with a
unanimous vote to recommend approval of Appl-ication 6-U-73 of Vallco Park,
LTD, conditions 1-14, 15, 16, 17 deleted, striping shall be in accordance
with existing ratios of compact/standard size or new ratio as per
ordinance in effect at time of striping, 18-22, 23 noise problems shall be
subject to review, with findings and subconclusions as per staff
recommendation..
RECESS: 9:50 P.M. - 10:05 P.M.
It was moved by Com. Claudy, seconded by Com. Koenitzer and passed
unanimously to continue items 3-7 to Wednesday April 11, 1984 at 7:30 p.m.
2. Application 40-U-83 of SYSOREX INSTITUTE (SEDGEWICK SCHOOL): USE
PERMIT to operate a private technical school at the existing Sedgewick
Elementary School site. The proposal includes the expansion of
parking facilities to accommodate 231 vehicles and refurbishing of
existing buildings. ENVIRONMENTAL REVIEW: The Environmental Review
Committee recommends the granting of a Negative Declaration. The
subject property is located on the southwest corner of Tantau Avenue
and Phil Lane in a BA (Public Building) zoning district. First
Hearing. Planning Commission has final approval.
Director of Planning and Development Sisk presented a staff report to the
Commission.
Pat McKinley, Vice -President, Board of Education, Cupertino Unified School
District, addressed the Commission stating the projects intent and
possible assets to the community.
Jack Belote, stated to the Commission that the school district was
interested in optimal use of the land and buildings the district has
acquired and with the proposed project sees an opportunity to maintain the
school at no cost to,the District. He went on to give an explanation of
modifications at the site.
Dr. Gary Casper, Sysorex Institute, 10590 N. Tantau, explained the
background of the corporation to the Commission and listed his concerns
with regards to the conditions of approval.
Discussion ensued between Commission and Mr. Casper regarding the
institute.
Beulah Abbate, 19131 Barnhart Avenue, stated to the Commission that she
was happy to know what the use would be but was- concerned with the
possible traffic generation.
Ruth McKelvy, 907 Tantau, stated her concerns to the Commission regarding
traffic and public access to the turf area at the school.
Linda Woessner, 965 Tantau Avenue, commented to the Commission that she
had canvassed the neighborhood and that the concensus was mostly negative
to the project. She felt that it would be a very good use for the site
but was concerned with traffic generation and proposed that Sysorex should
provide a crossing guard.

Milton Carris, 19230 Tilson Avenue, stated to the Commission that he did
not feel that the streets could handle the high traffic density that would
be caused by the school and that"he was concerned with the -possibility of
excess noise and pollution.
Tom Burger, 10630 S. Tantau Avenue, remarked to the Commission that the
introduction of the school would add to an existing traffic problem.
Ms. McElvey and Ms. Woessner commented on the hours and makeup of the FUSD
Adult Education program that had previously used the site.
It was moved by Com. Adams, seconded by Com. Koenitzer and passed
unanimously to close the public hearing.
Commission discussion ensued regarding parking restraints at the site.
It was moved by Com. Koenitzer, seconded by Com. Adams and passed
unanimously to recommend approval of the Negative Declaration.
It was moved by Com..Koenitzer, seconded by Com. Adams and passed with a
unanimous vote to approve Application 40-U-83 of Sysorex Institute with
conditions 1-15, 16 modified, 17-21, add 22 stating that the entrance to
the turf area shall be provided off Tantau and existing play equipment
moved on to turf, with findings and subconclusions as per staff
recommendation.
It was moved by Chairperson Blaine, seconded by Com. Claudy and passed
unanimously to amend the motion and add condition 23 requiring a crossing
guard to be paid for by Sysorex Institute and hired by the City of
Cupertino to cover the hours of Fremont Older Elementary School.
Discussion ensued between staff and Pat McKinley regarding condition 19.
City Attorney Kilian stated that the applicant could,appea1 the conditions
to the City Council.
8. Appointment of a Planning Commissioner to BMR Subcommittee.
Chairperson Blaine was appointed,to the BMR Subcommittee.
Meeting was adjourned at 11:45 p.m. to Wednesday April 11, 1984 at 7:30
p.m.
