June 24, 2003
CALL TO ORDER
At 7:40~.m., Chairperson Shirley Lin-Kinoshita called the meeting to order in the City Manager's
Office, 10300 Torre Avenue.
ROLL CALL
Present: Chairperson Shirley Lin-Kinoshita, Commissioners Nancy Canter (7:45 p.m.), David
Kim, Janet Mohr, Carl Orr, and Rita Young (7:45 p.m.). Commissioners absent: Hema Kundargi.

APPROVAL OF MINUTES
1. Minutes of the regular meeting of May 27, 2003.
Carl Orr and David Kim moved and seconded to approve the minutes as presented. The
motion carried unanimously, with Hema Kundargi absent.

Nancy Cantor distributed a flyer listing the exhibit schedule for the Euphrat Museum of Art for the
calendar year.

NEW BUSINESS
Report from the ad hoc committee members for the Distinguished Artist of the Year award
(Kundargi, Orr, Young)
· Select recipient
· Select award date and location
· Consider feasibility of arranging for a performance/exhibition
Janet Mohr moved and Nancy Cantor seconded to accept the committee's recommendation
to select Constance Guidotti as the Distinguished Artist for 2003. The City Clerk will send
written notification, and Chairperson Lin-Kinoshita will contact her by phone to confirm if
she is available to accept the award at the Shakespeare performance on August 9 and if her
work can be seen in the community. The City Clerk will also determine if the lobby would

be available on the evening of August 18 (or longer) in case she would like to display some
of her artwork.
Request for a Fine Arts Commissioner to serve as one of the judges for a teen photography
contest at the Cupertino Library, "Teens View the Many Faces of Cupertino." Judging will
take place in September in two categories, age 13-16, and 17-19. Contact Gayathri Kanth
446-1677 ext 3312.
Janet Mohr volunteered to serve as a judge, and will contact Ms. Kanth directly. Nancy
Cantor will be the alternate judge if necessary.
UNFINISHED BUSINESS
5. Status report on the Art and Wine Festival information booth. The event is July 19-20.
The City Clerk and Commissioner Janet Mohr will collaborate on materials to be
distributed at the information booth. The other commissioners agreed to the following
schedule: Saturday morning, set-up by Carl Orr and booth staffed by Shirley Lin-
Kinoshita. Saturday afternoon, booth staffed by Hema Kundargi (Carl Orr will confirm
this time with her) and Nancy Cantor is available as backup. Sunday moming, booth
staffed by David Kim and Rita Young in the morning, and Nancy Cantor and Carl Orr in
the afternoon.
Finalize the General Guidelines for Selecting Public Art

The subcommittee members said that they had not had an opportunity to update the
materials, and asked that it be pulled from the agenda until further notice.

The Commission suggested that when the park is opened and/or sculpture is unveiled, VIP
invitations should include past Distinguished Artists and Fine Arts Commission members.

ACQUISITION PROCEDURES
All potential acquisitions, whether gifts, donations, purchases, commissions, loans of
works of art to the city of Cupertino must be reviewed by the Fine Arts Commission
and (city council, mayor, general manager????)
GUIDELINES
*May want to include:
Works of art should not be accepted if the city couidn 't provide for the storage,
protection and preservation of the work under conditions that ensure its availability to
the public, and insure its permanency in the cities collection,
INSURANCE: is the city self-insured
TITLE: to the work of art acquired shall be transferred to the city of Cupertino.
COPYRIGHT: Works of art acquired through the process defined in acquisition
procedures shall effect a copyright agreement with the artist prior to acquisition so that
the city can arrange to use reproductions of the work for publicity, and professional
purposes without infringing on the artist's copyright. Institutions or individuals
interested in reproducing works of art in the city of Cupertino collection shall contact
.(whom) in writing to request reproduction privileges.
DOCUMENTATION and MAINTAENCE of the Collection
The Fine Arts Commission will develop and maintain the archives and records
complete documentation of each work of art in the city's collection.

Condition report
Description of work provided by artist
Recommended care and maintenance provided by artist
Appraisal of work if available-provided by the artist

DEACCESSION OF WORKS OFART
Works of art which are the property of the city of Cupertino may be deaccessioned only
according to city policy and only for the purpose of benefiting the
collection.

Funds received from the public sale of works of art from the collection will be used
only to benefit the collect ion of art for the city. Proceeds frotn the deaccession will be
directed back to the purchase of works of art for the collection or to the conservation
of objects in the collection.

General Guidelines for Selecting Public Art
Background
The City desires to acquire art for its permanent collection of sited works, permanent
portable collection, and temporary collections.
The Commission desires to create a visual identity for the City by placing artworks in
various locations. The Commission has in the last year begun to lay the groundwork for
selecting public artworks by drawing up policies and setting clear guidelines and
objectives. The Commission will be proposing a One Percent for Art program as part of
the General Plan update to fund and ensure the City's long-term goal of placing artworks
in the City. The Commission is currently researching potential sites on public lands to
place completed artworks or to commission artworks in the near future.
Guidelines
The following guidelines are meant to assist in the selection of sited works:
Sited works will be appropriate to the location, i.e. be proportionate in size and be
integrated into the environs or architecture.
To ensure excellence in the work's physical embodiment of the principles of design, the
involvement of a peer professional in aesthetic decision-making is desirable.
Sited works may reflect the history and culture of the area.
Various visual media and materials both traditional and non-traditional will be
considered. Durable materials with minimum maintenance requirements and maximum
resistance to vandalism will be required.
An artist will have proven ability and experience in designing, managing and producing
hands-on large-scale integrated artwork. Selection of artists will not be restricted by age,
gender or ethnic background.
Public liability and environmental concerns will be addressed.
The de-accessioning or removal of an artwork will follow legal procedures and protect
both artist and City from liability.
Where public funds are used, the community surrounding the future art may be invited to
participate in helping to select the art and helping to generate community acceptance.
A timeline will be designed to provide adequate time to coordinate and educate parties
involved and to structure the overall plan for a project.
It is desirable to involve the selected artist andior a public art consultant on a project
design team at the conceptual phase of architectural planning. This will help to fully
integrate art works into building projects, to help to provide developers with a positive
experience and to help to prevent expensive retrofitting later. If an artist has not yet been
selected, the consultant will offer art options and selection procedures. The function of
the consultant will be to foster communication among people with differing backgrounds
(e.g. artist, developer, planner, public works, architect, landscape architect, engineers,
attorney, community), to manage the fabrication/installation processes and to promote
integration of art with the environs. They will also keep the project on track, on time and
on budget.

Blossom Festival
Children's Art Past activity: First year was a competition, 2nd year was an
Display exhibit of 4 Seasons comer, Each model received a $45 stipend,
schools got plaques totaling about $400. Third and fourth years
were felt banners. Interest waning, too time-consuming on part
of FAC to finish/install/teardown. 3rd and 4th years were felt
banners made by students. 5th year was an art exhibit - creation
supervised by Euphrat Arts in Schools programs
This is 6th year, again Euphrat is overseeing the project, which
will be 2-d and 3-d projects in the theme of"Stevens Creek,
Naturally", about indigenous plant, animal and insect life of the
creek.
Euphrat Family Day Cancelled for this year. Instead, Euphrat held a hands-on art and
April 1 2003 an information booth, FAC created brochures and flyers of
upcoming recreational and art events for the booth at the Flea
Market on April 5.
Student Artist of 2002 was handled by a different agency. Unknown if the
