BACKGROUND:
The applicant, Pamela Nobel of NSA Wireless, representing Verizon Wireless, has proposed the
construction of a personal wireless service facility, consisting of six panel antennas mounted on an
existing sports field light pole, a base equipment station located in a sports field building, and an
emergency generator in a fenced enclosure at Cupertino High School, which is located at 10100 Finch
Avenue(Attachment 1).
The panel antennas will be mounted at a maximum height of 74'-6", which requires a height exception
approval for exceeding the maximum 55' antenna height requirement. The director's minor
modification permit for the associated facility and equipment has been bundled with the height
exception request so they may be considered together.
The proposed wireless facility is centrally sited on school property with single-family residential uses
located to the east, south and west and high school and commercial uses to the north.

In year 2000, Nextel (acquired now by Sprint) developed a sports field light pole wireless facility on the
south side of the home field bleachers. T-Mobile and later Clearwire applied for a collocated facility on
this southern pole in 2007, but neither of their facilities were built.
Project Description
The Verizon personal wireless service facility is proposed on an existing, approximately
92-foot tall sports field light pole located at the north end of the home field bleacher seating. The pole is
already structurally designed for heavier loads and will not need to be replaced to accommodate the
wireless facility. Six panel antennas are proposed on the pole below the field light array in a stacked
arrangement. The base equipment will be housed in an adjacent, existing sports field building. An
emergency power generator will also be sited nearby in a fenced enclosure.
DISCUSSION:
Confor�mance witli the Wireless Facilities Master Plan
Tl�e Master Plan establishes a hierarchy for site preferences for wireless communication facilities. The
highest preference is given to the use of existing mounting structures or buildings on non-residential
land. The use of a sports field light pole at a school fits this preference category.

Conformance with the Wireless Communications Facilities Ordinance
Antennas mounted on an existing utility pole do not have setback requirements, but the light pole is
setback 363 feet from the residential property line to the east and 438 feet from the residential property
line to the west.
Wireless Communications Coverage
Attachments 2 & 3 depict existing Verizon coverage and proposed Verizon coverage with the proposed
Cupertino High School cell facility. The greatest improvement in wireless coverage is expected to occur
in the East Vallco Park area where the Rosebowl and Main Street developments are proceeding and the
Rancho Rinconada &Loree Estates neighborhoods.
Radio Frequency Energy(RFE)Exposure Study
Hammett & Edison, Inc., Consulting Engineers was commissioned to evaluate the cumulative RFE
exposure of the project and the existing Sprint facility against established federal safety limits for RFE
exposure. The limits apply for continuous exposure and provide a prudent margin of safety for all
persons, regardless of age, gender, size or health. The report dated May 19, 2014 (Attachment 4) indicates
the following project and cumulative exposures at various locations around the school.

Since the calculated RFE exposures are all substantially less than the federal exposure standards for RFE,
federal law prohibits local agencies from basing their decisions on the perceived health effects of the
project.
Noise Stud�
Hammett & Edison, Inc., Consulting Engineers was also commissioned to evaluate the cumulative noise
exposure from the project's noise sources, which are the air conditioning units for the enclosed base ,
equipment station and the emergency power generator (Attachment 5). The applicable, most restrictive,
noise standard is 55 dBA on the weekends at "night time" from 6:00 p.m. to 9:00 a.m. The attenuating
effects of distance from the noise source is calculated to reduce noise levels at the residential property line
to 39.5 dBA, well below the most restrictive noise standard of 55 dBA.
Otlier Safety Considerations
Verizon will take additional measures to ensure the security and public safety of their facility
(Attachment 1 and plan set).

• The facility will be monitored electronically 24 hours per day for intrusion and environmental
disruption.
• The sign will be publicly visible, identifying a 1-800 Verizon telephone number to call in case of an
emergency.
• The emergency generator is located near the tennis courts. The generator will be enclosed and
lidded with chain link fencing.
• The sports field lights, located above the antennas, will be maintained by the School District. A
condition has been added to the development permit resolution requiring the applicant to train
school personnel or its hired contractors how to work safely around the antennas. Verizon is
capable of providing that training.
Height Exception Justification
The Applicant is requesting a height exception for the mounting height of the panel antennas of not more
than 74 feet, 6 inches, where 55 feet is the ordinance maximum height. The sports field light pole has an
existing height of 91 feet, 10 inches. The Planning Commission may grant a height exception request if it
can make the following three findings. Staff comments in(italics)follow each finding:
1. That the literal enforcement of the provisions of this chapter (19.136) will result in restrictions
inconsistent with the spirit and intent of this chapter. The purposes of this chapter are to facilitate the
development of a wireless communications infrastructure in the City for commercial, public and emergency
uses, and to protect the health, safety, welfare and aesthetic concerns of the public. Verizon desires to
improve wireless voice and data communications in this area where indoor coverage is considered good to
poor for the high school and surrounding residential neighborhoods of Rancho Rinconada and Loree Estates.
Demand for coverage and capacity is likely to increase with the Rosebozul and Main Street developments. In
general, the extent of the wireless coverage is expected to increase with the height of the antennas. More
extensive radio coverage from a single facility is desirable in large residential areas like Raneho Rineonada
where there are few good alternatives for siting wireless communication facilities. According to Verizon, at
the proposed antenna height, coverage is improved about 0.60 miles to the north, 0.25 miles to the west, 0.50
miles to the south and 0.25 miles to the east. Lower panel antenna heights would dramatically reduee
coverage nnd capacity objectives of this site location. The visual presence of the almost 92 foot tall sports
field light pole is there, regardless if the antennas are mounted at 55 feet or 74 feet 6 inehes. The City
approved an antenna height exception of 67 feet for the adjacent Sprint fRCZIlt�.
2. That granting of an exception will not result in a condition that will be detrimental or injurious to
property or improvements in the vicinity and will not be materially detrimental to the public
health, safety or welfare. Radio frequency energy emissions and noise have been studied and found to be
far below federal safety standards and city standards respectively. The wireless facility enhances the general
welfare of the community by providing more communications infrastructure and alternatives for emergenci�
communications.
3. That the exception to be granted will not result in a hazardous condition for pedestrian and
vehicular traffie. The project is not sited within the travel ways or sight lines of existing pedestrian and
motorist routes.
For the above noted reasons, Staff supports the height exception request for this project.

Design
The proposed design of the pole is depicted in the photosimulation(Attachment 6). A condition has been
added to the resolution, requiring the mounting hardware, cables and antennas to be painted to match the
pole. If the cables are not housed in a color-matched conduit, there are to be trained against and tied to
the light pole and mounting hardware.
As a design altemative, the antennas could be screened in a radome as depicted in Attachment 7. Staff
believes the radome itself, which measures 5 feet in diameter and 12 feet long, has a less than desirable
visual effect. Staff prefers Option #1 and believes this is the least visually obtrusive of the two options.
Alternative Sites Analysis
NSA Wireless/Verizon Wireless considered other sites in the area before selecting the project site. The
sites reviewed and the analysis is described in Attachment 8.
One additional site that was not mentioned by the applicant was the new 6-story office building under
construction at 5405 Stevens Creek Boulevard. This potential site is very close (0.3 miles) to an existing
Verizon cell site on the office building at 5300 Stevens Creek Boulevard, San Jose, and would overlap
coverage.
Comments from the Technology, Information � Communications Commission (TICC)
Plans and other supporting project documentation were referred to the TICC subcommittee for review.
Their written comments are attached (Attachment 9)
The TTCC members were supportive of the project, but had a couple of questions and recommendations.
The questions included whether the antenna height limit applied to antennas mounted on an existing
light pole, the extent of City authority on projects on school property, and if there was adequate
tolerances in the equipment's noise generation to allow for increased noise from equipment aging and
still meet the noise standards.
One TICC member recommended that the resolution cite specific noise standards instead of a generalized
City standard, and that additional safety measures be built into the project because of its location at a high
school. The additional safety measures are described in the staff report under the subtitle—Other Safety
Considerations. Conditions were also added to the draft Minor Modification resolution to respond to the
recommendations. One condition references the City's specific daytime and nighttime noise standard,
and the other condition requires Verizon to train school employees or school hired contractors that
maintain the sports field lights in RF safety.
Comments from the public and neighborhood meeting
The applicant has coordinated a neighborhood meeting for August 22nd. Any comments from that
meeting will be reported out at the Planning Commission hearing. No other public comments have been
received yet.
Environmental Assessment
The Director's Minor Modification and Height Exception applications are categorically exempt from the
California Environmental Quality Act (CEQA) per section 15303 (Conversion of Small Structures) of the
CEQA Guidelines because the existing light pole will be converted to a dual purpose: light pole and
telecommunications facility in an urban, developed environment. The proposed facility will also not

generate significant noise or RFE emissions, which are estimated to be below city and federal safety
standards respectively.

WHEREAS, the Planning Commission of the City of Cupertino received a referral of a Director's Minor

3. ABANDONMENT
If after installation, the aerial is not used for its permitted purpose for a continuous period of 18
months, said antennas and associated facilities shall be removed. The applicant shall bear the entire
cost of demolition and removal.
4. EXPIRATION DATE
This Director's Minor Modification shall expire ten (10) years after the effective date of the permit.
The applicant may apply for a renewal of the minor modification at which time the Director of
Community Development may review the state of wireless communication and camouflage
technologies to determine if the visual impact of the personal wireless facility can be reduced.
5. CAMOUFLAGING OF EQUIPMENT
The antennas, mounting brackets, and cables that run from the antennas and other aerially mounted
equipment to the base equipment shall be painted or housed in conduit that matches the color of the
sports field light pole. Exposed cables shall be bundled together and affixed to the light pole and
mounting hardware to the extent practical.
6. NOISE PERFORMANCE STANDARD FOR MECHANICAL EQUIPMENT
The project's mechanical equipment shall generate noise at the adjacent residential property lines no
louder than what is allowed in the City's Community Noise Control Ordinance (Cupertino
Municipal Code Section 10.48), which is 55 dBA at nighttime and 65 dBA at daytime.
7. SAFETY TRAINING FOR SCHOOL EMPLOYEES OR SCHOOL-HIRED CONTRACTORS
Verizon Wireless or any other subsequent owner of this personal wireless service facility shall train
all school employees or school-hired contractors to safely maintain the sports field lights above
panel antennas.

SECTION I: PROJECT DESCRIPTION

SECTION II: FINDINGS FOR EXCEPTION
WHEREAS, in order to provide height flexibility in situations where practical difficulties, unnecessary
hardships or results inconsistent with the purpose and intent of Chapter 19.136 occurs, an applicant for
development may file an exception request to seek approval to deviate from the standards; and
WHEREAS, the Planning Commission finds the following with regards to the Height Exception for this
application:
L That the literal enforcement of the provisions of this title will result in restrictions inconsistent with
the spirit and intent of this title in that the extra antenna height above the ordinance maximum of 55
feet is needed to provide adequate coverage for wireless voice and data communications for the
school and the surrounding existing and new residential and office complexes in this Cupertino
neighborhood and the visual presence of the almost 92-foot tall sports field light pole does not
change regardless of whether the antennas are mounted at 55 feet or 74 feet 6 inches;
2. That the proposed project will not be injurious to property or improvements in the area nor be
materially detrimental to the public health, safety, or welfare in that radio frequency energy
emissions and noise have been studied and found to be far below federal safety standards and city
standards respectively. The facility improves the general welfare by providing additional and
alternative communications infrastructure for emergency communications;
3. The proposed development will not create a hazardous condition for pedestrian or vehicular traffic
because it is not sited within the travel ways or sight lines of pedestrian or vehicular traffic.
NOW, THEREFORE, BE IT RESOLVED:
That after careful consideration of maps, facts, exhibits, testimony and other evidence submitted in this
matter, application no. EXC-2014-06 is hereby approved; and
That the subconclusions upon which the findings and conditions specified in this Resolution are based
and contained in the Public Hearing record concerning Application EXC-2014-06, as set forth in the
Minutes of the Planning Commission Meeting of August 26, 2014, and are incorporated by reference
herein.
