OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO
APPROVING A MODIFICATION TO A PREVIOUSLY-APPROVED USE PERMIT (25-U-83) TO
ALLOW THE OPERATION OF A PRE-SCHOOL IN AN EXISTING CHURCH FACILITY LOCATED
AT 6191 BOLLINGER RD (APN 375-41-007)
SECTION I: PROTECT DESCRIPTION

SECTION II: FINDINGS FOR USE PERMIT
WHEREAS, the Plannirig Commission of the City of Cupertino received an application for the
Modification of the Use Permit, as described in Section II of this Resolution; and
WHEREAS, the necessary public notices have been given in accordance with the Procedural
Ordinance of the City of Cupertino, and the Planning Commission has held one or more public
hearings on this matter; and
WHEREAS, the applicant has met the burden of proof required to support said application; and has
satisfied the following requirements:
1) The proposed use, at the proposed location, will not be detrimental or injurious to property or
improvements in the vicinity, and will not be detrimental to the public health, safety, general
welfare, or convenience;
2) The proposed use will be located and conducted in a manner in accord with the Cupertino
Comprehensive General Plan and the purpose of this title.
NOW,THEREFORE, BE IT RESOLVED:
T'hat after careful consideration of maps, facts, exhibits, testimony and other evidence submitted in this
matter, the application for Modification of the Use Permit are hereby Approved, subject to the
conditions which are enumerated in this Resolution begirming on Page 2 thereof; and
That the subconclusions upon which the findings and conditions specified in this resolution are
based and contained in the public hearing record concerning Application No. M-2010-09, as set forth
in the Minutes of the Planning Commission Meeting of February 22, 2011, and are incorporated by
reference though fully set forth herein.

SECTION III: CONDITIONS ADMINISTERED BY THE COMMUNITY DEVELOPMENT DEPT.
1. APPROVED EXHIBITS
The approval is based on Exhibits submitted, titled "Letter from Vest Valley
Presbyterian Church" dated January 6, 2011; an aerial photo; "Project Site and
Surrounding Land Uses"; "Project Description"; "Outdoor Play Area Weekly Timetable";
"West Valley Church Facility Use"; "Hyde Middle School Bell Schedule for 2010-2011";
"Designated Church Parking Lot" each consisting of 1 page; "Traffic Flow Plan' consisting of
2 pages; Plan Set dated July 13, 1994, consisting of 2 pages, except as may be amended
by the Conditions contained in this Resolution.
2. USE APPROVAL
Approval is granted to allow Haven Christian Preschool on the event schedule for West
Valley Presbyterian Church (approved in conjunction with 25-U-83). Haven Christian
Preschool is permitted to operate a year-around preschool with a maximum of up to 45
children and 30 students at any given tirne with five (5) staff inembers. The days and hours
of operation for the school shall be the following:
Staff hours: Monday through Friday, 7:00 a.m. to 6:30 p.m.
School hours: Monday through Friday, 9:00 a.m. to 6:00 p.m.
Drop-Off/Pick-Up hours: Monday through Friday, 7:30 a.m. to 9:00 a.m., and 3:45 p.m. to
6:00 p.m.
The preschool will be allowed to use two existing classrooms, office space, restrooms, and the
outdoor playground area.
3. MODIFICATION TO CHURCH SCHEUDLE &FUTURE INTENSIFCATION
Attachment 1, titled "Letter from West Valley Presbyterian Church" shall now supersede the
prior church schedule, Exhibit B, titled "West Valley Presbyterian Church Event Schedule" as
approved in the previous Use Permit (1-U-94). In the event that the number of attendees
changes, the intensification of uses is proposed, or any activities that may generate additional
vehicular traffic or impact parking or traffic circulation in any way is proposed, a modification
shall be submitted to the City for review.
4. PREVIOUS CONDITIONS OF APPROVAL
All prior use permit conditions of approval (25-U-83 and 1-U-94) and modifications.to use
permits (M-2009-08) shall remain in effect unless superseded by or in conflict with subsequent
conditions of approval, including conditions of approval for M-2010-09.
5. VEHICLE CIRCULATION AND.PARKING PLAN
Prior to issuance of any building permits, the applicant shall submit a final vehicle circulation
and parking plan to the satisfaction of the Director of Community Development and the
Public Works Department. The plan shall include but not be limited to provisions for:
warning signs restricting access off the Bollinger Rd exit/entrance, directional signs directing
vehicles to the northern Miller Ave entrance/exit, and children drop-off/pick-up
area/signage, and designating walkway areas withi.n the parking lot for pedestrian travel.

The applicant must adhere to the developed traffic flow plan to discourage queuing and to
ensure the safe travel of school children to and from parked vehicles. In no instance shall a
child travel unaccompanied within a parking lot to church and/or school facilities.
6. OUTDOOR PLAY AREA
Outdoor play area for the children shall be restricted to the existing outdoor playground
located on the southeast corner of the site facing Bollinger Avenue and shall adhere to the
provided outdoor play area schedule.
7. SIGNAGE &SIGN PROGRAM
Signage is not approved with this use permit application. The applicant shall be required to
submit an application for a sign program and signage prior to installation of any signage on
site. Signage shall conform to the City's Sign Ordinance.
8. STATE LICENSING REQUIREMENTS
Operation of the preschool is contingent upon the applicant obtaining proper licenses through
� the State of California's Department of Social Services (Community Care Licensing Division).
Applicant must adhere to all licensing requirements for a Child Care Center as required by
state law. -
9. OTHER DEPARTMENTS REVIEW
All building department and fire department comments must be addressed prior to
occupancy of the church facility.
10. FUTURE REVIEW OF PERMIT
In the event of any documented substantial future parking problems, the City reserves the
right to review this permit at any time for additional mitigation measures or revoke the
modification to the use permit.

Boutique -Monday 9:30am—2:OOpm, 12-15 people regularly attend. The Boutique is a
sma11 group of people who do crafts that are sold at ou.r Holiday Boutique.
Tuesda.y Prayer-Tuesday 6:30-7:30am, 8-12 people regularly attend. This is a group that
meets to pray for the church, community, city, state and nation.
Women's Bible Study—Tuesday 9:30— 11:30axn., 12-15 women regularly attend. This

Heart Spa—Tuesday 12:00-1:OOpm, 12 women regularly attend. This is a women's
worship, study and support group
Men's Breakfast—Wednesday 6:30-8:OOaxn, 12-15 men regularly attend. The group
en�a��.bxe�..k��st, fe�le��s�p and dis�us�iwn.
Quilting—Thursday 9:OOam—2:OOpm, 4 ladies attend. The group makes quilts to donate
or sell to buy supplies.
Mother's Together—Thursday 9:30am— 12:OOpm,4-6 mothers attend regularly. This is a
