BACKGROUND:
Application Request
Philz Coffee is proposing to open a store in Cupertino located in a new commercial building (in the
Crossroads Shopping Center) previously approved by the City in November 2011 (DP-2011-03, ASA-
2011-12) and with modifications in February 2012 (M-2012-01). The coffee shop is currently undergoing
tenant improvements and intends to open in April 2013. The applicant, Jacob Jaber, representing Philz

Coffee, is requesting a Use Permit to operate the future coffee shop from the hours of 5:30 AM to 9:00
PM, seven days a week. The General Commercial (CG) Ordinance requires a Use Permit at the Planning
Commission level for commercial businesses operating hours between 11:00 PM and 7:00 AM.
Existing Center and Surroundings
The project site is located within the Byer Properties-owned portion of the Crossroads Shopping Center,
on the south side of Stevens Creek Boulevard near the terminus of Bandley Drive. To the west of the site
is TJ Maxx/Homegoods and Party City; to the east is the Mardesich Co.-owned portion of the Crossroads
Shopping Center; to the north and across the street is Target and the Bottegas Shopping Center; and to
the south is a single-family residential neighborhood on Scofield Drive. The nearest residential property
line is approximately 308 feet away from the back of the tenant space.

DISCUSSION:
Use Permit
To approve an application for a conditional use permit, the Commission must make the following
findings:
1. The proposed development and/or use, at the proposed location, will not be detrimental or injurious
to property or improvements in the vicinity, and will not be detrimental to the public health, safety,
general welfare, or convenience;
2. The proposed development and/or use will be located and conducted in a manner in accord with the
Cupertino Comprehensive General Plan, underlying zoning regulations, and the purpose of this title
and complies with the California Environmental Quality Act(CEQA).

'The draft resolution (Attachment 1) explains the facts supporting these findings for this application. The
discussion below provides a discussion of the issues related to the findings.
Philz Coffee Operational Details
Philz Coffee has several different locations throughout the Bay Area, including locations in Palo Alto and
San Jose. Existing Philz Coffee locations begin operations between the hours of 5:30 AM to 6:30 AM, and
have not had a history of problems during early morning hours, according to the applicant(Attachment 2).
The applicant anticipates a demand for early morning hours at this location, and is proposing the hours of
operation of 5:30 AM to 9:00 PM, seven days a week. Employees would typically arrive 30 minutes before
store opening time to prepare the shop for business.
The applicant indicates that Philz Coffee is committed to incorporating green initiatives in store
operations, including providing reuseable mugs, and compostable or recyclable cup and coffee
materials. The previously approved trash and delivery plan for the building is provided in Attachment
3. The building is served by a trash enclosure in the parking lot near the building and is serviced by
Recology three times a week. Trash, recycling, and composting receptacles will be provided near the
building entrance.
Proximity to Residential Area
'The coffee shop is located approximately 308 feet from the nearest residential property line to the south
on Scofield Drive. In addition, the coffee shop is buffered by the existing shopping center building at the
rear of the property and most early morning business activity will be contained to the front of the
shopping center along Stevens Creek Boulevard.
The Santa Clara County Sheriff's Office reviewed the project and does not foresee any security concerns
or negative impacts to the surrounding neighborhood. There has not been a history of security concerns at
the shopping center.

The City has previously approved similar hours of operation for other coffee shops in the City. Please

Four of the five previously approved coffee shops are located within shopping centers that adjoin
residential areas. The existing Starbucks Coffee Shop within the same Crossroads Center is located closer

to the residential neighborhood on Scofield Drive, and has been in operation since 1999. The City's Code
Enforcement Division is not aware of any complaints related to early morning hour operations at any of
the above locations.
ParkinglTraffic
The proposed store hours will not have any significant impacts to the shopping center parking since
most of the other store open significantly after 5:30AM and the parking lot directly adjacent to the
establishment is relatively empty between 5:30-7:OOAM.
As a condition of the Development Permit for the building (file no. DP-2011-03), the property owner will
be required to fund a parking survey in Apri12014, a year from when all building tenants have occupied
their respective spaces. Further, if complaints or concerns are received by the City in the future, the City
has the ability to require additional measures as deemed necessary (e.g. valet parking for the restaurant
uses).
Since traffic flows at this time of day are at lower levels than 7:OOAM, the early marning start time will
not impact the existing traffic levels of service.
OTHER DEPARTMENT/AGENCY REVIEW
The City's Public Works Department; Building Division; Code Enforcement Division; the Santa Clara
County Fire Department and Sheriff's Office; and Recology reviewed the request and have no objections
to the project. These departments and others also recently reviewed and approved the coffee shop's
tenant improvement plans.
ENVIRONMENTAL ASSESSMENT
The use permit is categorically exempt from the California Environmental Quality Act (CEQA) per
section 15301 (Existing Facilities) of the CEQA Guidelines because it relates to hours of operation only
and involves negligible or no expansion of the approved use.
PERMIT STREAMLINING ACT
This project is subject to the Permit Streamlin.ing Act (Government Code Section 65920 - 65964). The
City has complied with the deadlines found in the Permit Streamlining Act.

Deemed complete: March 13, 2013
Since this project is Categorically Exempt, the City has 60 days (until May 13, 2013) to make a decision on
the project. The Planning Commissiori s decision on this project is final unless appealed within 14
calendar days of the decision.

CONCLUSION
Staff recommends approval of the early morning hours request since it is not anticipated to have
significant impacts to the neighborhood and is consistent with other coffee shop opening hours in the

SECTION II: FINDINGS FOR A USE PERMIT:
WHEREAS, the Planning Commission of the City of Cupertino received an application for a Use Permit
as described in Section I. of this Resolution; and
WHEREAS, the necessary public notices have been given as required by the Procedural Ordinance of
the City of Cupertino, and the Planning Commission held a public hearing on March 26, 2012 in regard
to the application; and
WHEREAS, the applicant has met the burden of proof required to support said application; and
WHEREAS, the Planning Commission finds as follows with regard to this application:
a) The proposed use, at the proposed location, will not be detrimental or injurious to property or
improvements in the vicinity, and will not be detrimental to the public health, safety, general
welfare, or convenience;
The coffee shop's early morning hours will not be detrimental or injurious to property or improvements in
the vicinity, and will not be detrimental to the public health, safety, general welfare, or convenience. The
coffee shop is located in an established commercial district, located approximately 308 feet from the nearest
residential property line, and is buffered by the existing shopping center building in the rear. In addition,
there is an existing coffee shop in the same shopping center that has similar early morning hours, and is
closer to the residential area. The City has approved similar hours for at least five similar uses in other areas
of the City and has no recorded history of complaints associated with early morning operating hours at those
locations.
b) The proposed use will be located and conducted in a manner in accord with the Cupertino
Comprehensive General Plan, underlying zoning regulations, the purpose of the City's zoning
ordinances, and complies with the California Environmental Quality Act(CEQA).

The proposed early morning operating hours are consistent with and will be conducted in a manner in
accord with the General Plan, zoning ordinance, and CEQA. The conditions of approval contained in this
resolution further reduce the likelihood of adverse impacts to surrounding commercial properties and the
residential neighborhood to the rear.
NOW,THEREFORE,BE IT RESOLVED:
That after careful consideration of the, maps, facts, exhibits, testimony and other evidence submitted in
this matter, subject to the conditions which are enumerated in this Resolution:
The application for a Use Permit, Application no. U-2013-01 is hereby approved and that the
subconclusions upon which the findings and conditions specified in this resolution are based and
contained in the Public Hearing record concerning Application no. U-2013-01 as set forth in the Minutes
of Planning Commission Meeting of March 26, 2013, and are incorporated by reference as though fully set
forth herein.
SECTION III: CONDITIONS ADMINISTERED BY THE COMMUNITY DEVELOPMENT DEPT.
Planning Division:
1. APPROVED EXHIBITS
Approval is based on the plan set dated February 15, 2013 consisting of 8 sheets labeled A000, A101,
A102, A103, A201, K102, M-1, and M-2, "Tenant Improvements for Philz Coffee, 20686 Stevens
Creek Blvd., Cupertino, CA 95014," drawn by Kahn Design Associates; except as may be amended
by conditions in this resolution.
2. ACCURACY OF PROJECT PLANS
The applicant/property owner is responsible to verify all pertinent property data including but not
limited to property boundary locations, building setbacks, property size, building square footage,
any relevant easements and/or construction records. Any misrepresentation of any property data
may invalidate this approval and may require additional review.
3. PREVIOUS CONDITIONS OF APPROVAL
All prior conditions for approval file nos. DP-2011-03, ASA-2011-12, and M-2012-01 shall remain in
effect,unless superseded by the conditions of approval for U-2013-01.
4. USE APPROVAL
Approval is hereby granted to allow the 1,367 square foot coffee shop within Building E (8,011
square feet, 20682-20688 Stevens Creek Boulevard) of the Crossroads Shopping Center to be open to
the public beginning at 5:30 AM, seven days a week.
The Planning Commission shall review amendments to the project considered major by the Director
of Community Development.
5. OUTDOOR PATIO USE
The outdoor patio shall not be used by patrons prior to 7am.

6. OUTDOOR DINING ENCLOSURE
Outdoor dining areas shall not be enclosed with fencing or other structures to permanently obstruct
pedestrian walkways, unless it can be demonstrated that an enclosed outdoor seating area will not
obstruct the required walkway clearances. A separate City planning approval is required for any
enclosure of outdoor dining areas.
7. LAW ENFORCEMENT SUPPORT
The shopping center property owner shall pay for any additional Sheriff enforcement time resulting
from documented incidents in the shopping center at the City's contracted hourly rate with the
Sheriff Department at the time of the incident.
8. USE PERMIT REVIEW/ADDITIONAL RESTRICTIONS
If complaints are received related to the tenant(s) under this use permit, and the complaints are
addressed immediately by the property management, then the Planning Commission shall conduct
a public hearing on the use permit at which time, the approval for early morning operating hours
may be modified or revoked.
The City reserves the right to require additional security patrols and/or other measures as
prescribed by the Sheriff's Office or Code Enforcement.
9. CONSULTATION WITH OTHER DEPARTMENTS
The applicant is responsible to consult with other departments and/or agencies with regard to the
proposed project for additional conditions and requirements. Any misrepresentation of any
submitted data may invalidate an approval by the Community Development Department.
10. INDEMNIFICATION
To the extent permitted by law, the Applicant shall indemnify and hold harmless the City, its City
Council, its officers, employees and agents (the "indemnified parties") from and against any claim,
action, or proceeding brought by a third party against the indemnified parties and the applicant to
attack, set aside, or void this ordinance or any permit or approval authorized hereby for the project,
including (without limitation) reimbursing the City its actual attorneys' fees and costs incurred in
defense of the litigation. 'I`he City may, in its sole discretion, elect to defend any such action with
attorneys of its choice.
11. NOTICE OF FEES DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees, dedication
requirements, reservation requirements, and other exactions. Pursuant to Gov ernment Code Section
66020(d) (1), these Conditions constitute written notice of a statement of the amount of such fees,
and a description of the dedications, reservations, and other exactions. You are hereby further
notified that the 90-day approval period in which you may protest these fees, dedications,
reservations, and other exactions, pursuant to Government Code Section 66020(a), has begun. If you
fail to file a protest within this 90-day period complying with all of the requirements of Section
66020, you will be legally barred from later challenging such exactions.

A "trio' trash, recycling, and composting bin for public use shall be provided at the front and rear of
Building E (20682-20688 Stevens Creek Boulevard) to the satisfaction of the City's Environmental
Programs Manager. The property owner will be responsible for removing litter from the shopping
center on a regular basis.
