The General Commercial (CG) Ordinance requires that the Planning Coininission review and approve requests for business operating hours past 11:00 PM. DISCUSSION: Gyu Kaku is a family oriented restaurant catered to lunch and dinner customers. The restaurant has been in operation since December 2011. The restaurant has 76 fixed seats and anticipates a demand for extended hours given its recent success. No bars or entertainment activities are being proposed. The restaurant building is located approximately 250 feet from the nearest residential property to the south. In addition, the restaurant building is buffered by shading trees and another building along the rear of the shopping center. There are no direct lines of sight from the residential properties to the restaurant storefront. Elephant Bar,located in the same shopping center, has similar hours of operation and has been operating without any issues. The applicant has confirmed that the same level of quality in operation and maintenance would be expected at Gyu Kaku restaurant. The Santa Clara County Sheriff's Office has reviewed the project and does not foresee any security concerns or negative impacts to the surrounding neighborhood. A condition of approval has been added to require the property owner to address security concerns in the event that they arise and reimburse the City in the event of additional Sheriff's enforcement time. OTHER DEPARTMENT/AGENCY REVIEW The City's Public Works Department, Building Division, the Santa Clara County Fire Department, and the Cupertino Sanitary District reviewed the request and have no objections to the project. LAW ENFORCEMENT SUPPORT The shopping center property owner shall pay for any additional Sheriff enforcement time resulting from documented incidents in the shopping center at the City's contracted hourly rate with the Sheriff Department at the time of the incident. 4. RESTAURANT ODOR ABATEMENT All restaurants shall install odor abatement systems to be incorporated into the air handling systems to reduce the odor impact from the restaurants to the adjacent community. 5. CONSULTATION WITH OTHER DEPARTMENTS The applicant is responsible to consult with other agencies with regard to the proposed project for additional conditions and requirements. Any misrepresentation of any submitted data may invalidate an approval by the Community Development Department. 6. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS The Conditions of Project Approval set forth herein may include certain fees, dedication requirements, reservation requirements, and other exactions.
