BACKGROUND:
The applicant, Bay Area Yakinaku, on behalf of Gyu Kaku located in the existing Marketplace Shopping
Center,is requesting a Use Permit to operate the restaurant closing hours unti111:00 PM,Sunday
through Thursday and 12:00 AM, Friday through Saturday. The General Commercial(CG) Ordinance
requires that the Planning Commission review and approve requests for business operating hours past
11:00 PM.
DISCUSSION:
Gyu Kaku is a family oriented restaurant catered to lunch and dinner customers. The restaurant has been
in operation since December 2011. The restaurant has 76 fixed seats and anticipates a demand for
extended hours given its recent success. According to the applicant,the last patron shall leave the
premises within 30 minutes after specified closing time and allow sufficient time for the restaurant crews
to clean up.

Project Site:Marketplace Shopping Center Location Map
The restaurant does have a license to serve beer and wine during the business hours. No bars or
entertainment activities are being proposed. The restaurant building is located approximately 250 feet
from the nearest residential property to the south. In addition,the restaurant building is buffered by
shading trees and another building along the rear of the shopping center. There are no direct lines of
sight from the residential properties to the restaurant storefront. Elephant Bar,located in the same
shopping center,has similar hours of operation and has been operating without any issues. The
applicant has confirmed that the same level of quality in operation and maintenance would be expected
at Gyu Kaku restaurant.
The Santa Clara County Sheriff's Office has reviewed the project and does not foresee any security
concerns or negative impacts to the surrounding neighborhood. A condition of approval has been added
to require the property owner to address security concerns in the event that they arise and reimburse the
City in the event of additional Sheriff's enforcement time.
OTHER DEPARTMENT/AGENCY REVIEW
The City's Public Works Department, Building Division,the Santa Clara County Fire Department,and
the Cupertino Sanitary District reviewed the request and have no objections to the project.
ENVIRONMENTAL ASSESSMENT
The project is categorically exempt from the California Environmental Quality Act(CEQA) per section
15301 (Existing Facilities) of the CEQA Guidelines.

SECTION II: FINDINGS FOP USE PEPMIT:
WHEREAS,the Planning Commission of the City of Cupertino received an application for a Use Permit
as described in Section I. of this Resolution; and
WHEREAS,the necessary public notices have been given as required by the Procedural Ordinance of
the City of Cupertino, and the Planning Commission has held at least one public hearing in regard to the
application; and
WHEREAS,the applicant has met the burden of proof required to support said application; and
WHEREAS,the Planning Commission finds as follows with regard to this application:
a) The proposed use, at the proposed location,will not be detrimental or injurious to property or
improvements in the vicinity, and will not be detrimental to the public health, safety, general
welfare, or convenience;
b) The proposed use will be located and conducted in a manner in accord with the Cupertino
Comprehensive General Plan and the purpose of the City's zoning ordinances.

matter, subject to the conditions which are enumerated in this Resolution beginning on PAGE 2 thereof,
the application for a Use Permit, Application no. U-2011-12 is hereby approved, and
That the subconclusions upon which the findings and conditions specified in this Resolution are based
and contained in the Public Hearing record concerning Application no. U-2011-12 as set forth in the
Minutes of Planning Commission Meeting of Apri110,2012, and are incorporated by reference as
though fully set forth herein.

SECTION III: CONDITIONS ADMINISTEPED BY THE COMMUNITY DEVELOPMENT DEPT.
1. APPPOVED EXHIBITS
This approval is based on E�ibits titled, "Gyu-kaku Restaurant, 19620 Stevens Creek Blvd.,
Cupertino,CA 95014;' prepared by KTA, dated December 14,2010 consisting of pages A1 and A2;
except as may be amended by the Conditions contained in this Resolution.
2. HOUP�S OF OPEP�ATION
The applicant is approved for the following hours of operation:
Sunday-Thursday: 11:00 AM- 11:00 PM
Friday-Saturday: 11:00 AM- 12:00 AM
The restaurant patrons are required to leave within 30 minutes after closing time and clean up crew
are expected to leave within one hour.
3. LAW ENFOPCEMENT SUPPOPT
The shopping center property owner shall pay for any additional Sheriff enforcement time resulting
from documented incidents in the shopping center at the City's contracted hourly rate with the
Sheriff Department at the time of the incident.
4. PESTAUP�ANT ODOP ABATEMENT
All restaurants shall install odor abatement systems to be incorporated into the air handling systems
to reduce the odor impact from the restaurants to the adjacent community.
5. CONSULTATION WITH OTHEP DEPAPTMENTS
The applicant is responsible to consult with other agencies with regard to the proposed project for
additional conditions and requirements. Any misrepresentation of any submitted data may
invalidate an approval by the Community Development Department.
6. NOTICE OF FEES, DEDICATIONS, PESEPVATIONS OP OTHEP EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees, dedication
requirements,reservation requirements, and other exactions. Pursuant to Government Code Section
66020(d) (1),these Conditions constitute written notice of a statement of the amount of such fees,
and a description of the dedications,reservations, and other exactions. You are hereby further
notified that the 90-day approval period in which you may protest these fees, dedications,
reservations, and other exactions,pursuant to Government Code Section 66020(a),has begun. If you
fail to file a protest within this 90-day period complying with all of the requirements of Section
66020,you will be legally barred from later challenging such exactions.

Bay Area Yalcinilcu is requesting the following extended hours of operation until closing
time:
Sunday through Thursday — l lam— l lpm
Friday through Saturday— l lam— 12am
Any patrons will be required to leave within 30 minutes after closing time. Clean up staff
will be expected to leave within one hour after closing time.
There will be alcohol (Beer and Wine only) served during business hours
There is no bar and no entertainment activities are proposed
The parlcing lot is cleaned daily and swept every Monday, Wednesday, Friday, Saturday,
and Sunday.
Odor concerns have been addressed through the installation of a Moli tron system.
Security Plan
The shopping plaza is patrolled by Orion Security daily between 3pm to l lpm and will
be extended on weelcends and holidays as needed. The trained security guard
continuously patrols the whole plaza and carries a cell phone at all times. Their route
includes wallcing every store entrance and exit, as well as the whole parlcing lot. The
security guard is responsible for ensuring noise compliance, no loitering, and other
security matters. "No loitering" signs are posted.
When there is any disturbance, the guard will remedy the issue or contact the appropriate
party, if necessary.

Trash Plan
The shopping plaza has a day Porter service from 8:OOam to 10:00am Monday through
Friday and 7:OOam to 10:00am Saturday and Sunday. The parlcing lot is swept 5 days per
weelc by Universal Site Services, Inc. Waste services are piciced up Monday through
Saturday in the morning by Recology South Bay. There is also a bacic up compactor in
case the first compactor gets full. A maintenance person checks the property on a regular
basis over seeing the trash and cleaning.

The R1-6i residential zone limits homes to one story,not exceeding 18 feet high. Any new two-story
homes or second story additions may be permitted with a Use Permit approved by the Planning
Commission.
In 1979, as part of a boundary realignment and property transfer with City of San Jose,the City Council
placed the R1-6i zoning designation on the seven parcels immediately south of the Three Oaks Park. The
intent of the R1-6i zone was in part to address concerns over two story developments at the time. Since
then,there have been renovations in the area and two story homes do exist in the immediate project
neighborhood.

The project includes a new 206 square foot second story addition to include a loft,powder room and two
non-habitable attic areas (with a maximum interior head clearance of 5'-8"). The new loft space opens
into a 144 sq. ft. second story deck facing the north street front. The project also entails reroofing the
existing home and a new entry trellis feature. The project meets all developments standards prescribed
in the R1 Ordinance and new privacy protection trees are proposed to address any cone of vision from the
new second story deck. Staff supports the proposed two story addition because it is modest in size and
will complement the existing neighborhood. In addition,the immediate project neighborhood has both

WHEREAS, the Planning Commission of the City of Cupertino received an application for a Minor

WHEREAS,the necessary public notices have been given in accordance with the Procedural Ordinance of
the City of Cupertino, and the Planning Commission has held one or more public hearings on this matter;
and
WHEREAS, the applicant has met the burden of proof required to support said application; and has

The City Council met on Apri13, 2012 and discussed the following item(s) of
interest to the Planning Commission:
1. Appointment of Interim Citv Manager and Execution of Emplovment Agreement
- City Council authorized the appointment and employment agreement for Amy
Chang. See the attached Press Release.
Miscellaneous:
1. Appeal of Planning Commissiori s Approval for Island's Bar & Late Night Hours
- An appeal was filed and the City Council hearing is tentatively scheduled for
May 15, 2012.
2. Office Building Project on IHOP site in Santa Clara -The City of Santa Clara
recently circulated a Notice of Preparation (for an Environmental Impact Report
(EIR)) for a proposal to develop two, 6- story office buildings,totaling 375, 000
square feet and a four level ( two below grade and two above grade) parking
structure with 1, 281 stalls and 38 surface parking stalls on the 5. 08- acre IHOP
Restaurant site at 5403 and 5405 Stevens Creek Boulevard. The property borders
Cupertino. A copy of the Notice of Preparation is attached. When the Draft EIR is
completed,the City staff is expecting to have 30-45 days to review and comment
on the document.

Cupertino Selects Interim City Manager
Cupertino, CA.-Apri14, 2012-At their meeting last night, the Cupertino City Council unanimously
approved a short-term employment agreement with Amy Chan to become Cupertino's interim
City Manager. The appointment will become effective on April 17, 2012. Ms. Chan will serve as
the interim City Manager as the City Council seeks a permanent replacement for David Knapp. Mr.
Knapp, who had served as City Manager since July 2000, recently announced that he would be
taking a job as City Manager in Highland Park, II, in order to be closer to his family.
"We are very pleased to welcome Amy to Cupertino," Mayor Mark Santoro said. "She is well-
qualified for the position and will do a greatjob for our city." Amy Chan retired as the City Manager
of Sunnyvale, CA, in December 2007. She is expected to serve as interim City Manager in Cupertino
approximately six months during the recruitment and selection of a permanent replacement for
Mr. Knapp.
"I recognize that the chief function of local government, the City Manager and our staff is to at all
times serve the best interests of all the people," acknowledged Amy Chan. "I am excited about
serving in Cupertino and look forward to assisting the City Council in making a positive transition."
"I am pleased that Mayor Santoro and the City Council have made such an excellent choice as
interim City Manager in Cupertino. Amy did an excellent job as City Manager in Sunnyvale, and we
all expect more of the same while she is in Cupertino," stated David Knapp. "Serving in Cupertino
has been the highlight of my career. My service in Highland Park represents a new chapter in my
career and for my family." Mr. Knapp will begin his job in Highland Park on May 14, 2012.
A farewell event for Mr. Knapp will be held from 5:30 to 8:30PM, on Wednesday, April 25, at the
Cupertino Senior Center, 21251 Stevens Creek Boulevard, Cupertino CA 95014.The cost is $5 per
