CALL TO ORDER
At 7:25pm Philippe Dor called the meeting to order at Cupertino City Hall, 10300 Torre
Avenue, Conference Room A, Cupertino, CA.

MINUTES
Commissioner Riddell motioned to approve the minutes from the May 8, 2003 regular
meeting. Seconded by Chen and motion passed unanimously.
ORAL COMMUNICATIONS

WRITTEN COMMUNICATIONS
Commissioner Dor reported that he had received e-mail from
congratulating the Committee on doing a good job.

REPORTS
A. Santa Clara County Fire District - Chief Ben Lopes introduced Charlie Anderson,
Battalion Chief. Ben distributed the April Incident Report stating that there were no
significant losses during April. He discussed the results from the Department's
Performance Measures meeting of last month (see attached handout) addressing Training
and Education, Prevention, Emergency Response, Safety, Finance and Customer Service.
Commissioner Darknell asked about the budget situation. The Chief stated that the
budget is tough between the recession and rising costs for PERS and health care. He
assured the Commission that Marsha Hovey's position has been budgeted for next year.
B. Santa Clara County Sheriff- Carol Atwood distributed the May Statistical Data and
Public Safety Report. In addition, the Commission's packet includes the police activity
from the Council's weekly notes packet. Commissioner Riddell commented that the
police activity reports are much more informative.
C. Commissioner Reports - None.
8. NEW BUSINESS - None
OLD BUSINESS
A. Goals and Objectives for fiscal year 2003/04 - The Commission reviewed the results of
the tabulated votes on the potential goals and objectives. Discussion followed. The
Commission unanimously agreed on the following projects for this year:
1. Safe Routes to School/School Traffic Issues
2. Red Light Program
3. Rural Neighborhood Street Standards
4. Traffic Issues as they arise
In addition, the Commission asked that Marsha Hovey come to their next meeting to
explain possible Disaster Preparedness projects. As time and interest permits, the
Commission may add Emergency Arks and Emergency Preparedness Promotion to their
goals and objectives. Emma Darknell agreed to present these goals to the City Council at
their meeting of July 7th.
10. OTHER
A. It was suggested that each Commissioner visit Lincoln Elementary School and Monta
Vista High School before the next meeting and be prepared to discuss possible solutions
to traffic flow and student drop off at these sites.

Provide adequate personnel on scene of interior structure fires to meet
requirements of 2 in 2 out. Provide effective fire fighting force deployed with
sufficient additional personnel and apparatus to meet theoretical fire flow for a
residential structure fire within a response time of 15 minutes.

Law Enforcement
On 06/10, deputies stopped a bicyclist for no light on his bike on Stevens Creek and Tantau. Hc
was found to have a $15,000 wa~ant and was booked into thc main jail.
On 06/11, deputies responded to McClellan Ranch for a theft report. Someone took the goat
belonging to the 4H Club. The goat was returned the next day.
On 06/12, a citizen brandishing flagged deputies down on Tilson near Cupertino High School. A
neighbor placed garbage cans in front of his house to prevent anybody from parking during
graduation. When the victim tried to park there, the resident came out of his house brandishing a
hammer. While he was near the victim's car, he "accidentally" dropped the hammer two times,
damaging the victim's car. The homeowner was arrested for brandishing a weapon, vandalism, and
being intoxicated in public.
Deputies investigated a minor injury accident on Torre at Stevens Creek. The pedestrian was sore,
but was not transported.
Deputies investigated a prior auto burglary at the Valley Green Apartments.
Deputies investigated a prior auto burglary on Cheryl.
Deputies investigated a vandalism on Rollingdell. The vehicle's trunk lock was punched and the
driver's wing window broken. Nothing was taken from the car.
Deputies initiated a vehicle stop on a speeder on northbound 280 from De Anza. Deputies learned
the driver was chasing the suspect that stole her vehicle. The victim had her purse stolen the day
prior and the suspect returned to her residence and stole her vehicle.
On 06/13, deputies responded to N. Stelling Rd. on a report of a male who opened a letter
(addressed to someone else) with white powder. Central FD responded to test the powder. The
reporting party is mentally disabled, and there was no powder in the envelope.
Deputies investigated a minor injury accident at the intersection of Blaney and Cliftden. One of the
parties was pregnant and complained of pain. AMR and Fire treated the woman.
Deputies responded to a family disturbance call. Upon arrival a male subject told deputies he was
going to live forever. He wanted space aliens to provide him with a gun so he could shoot himself
in the head and prove to everyone he could live forever. The subject was placed in handcuffs for
safety. The subject told deputies he wanted to be booked into the Main Jail rather than go to EPS
for psychological examination. He said he would assault them to ensure he would go to jail.
Deputies explained he was better off getting an evaluation and admonished him not to assault them.
As he was being escorted, he tried to head-butt deputies. The subject struck a deputy with his head
on the left shoulder. Deputies subdued the subject immediately without further incident. He was
arrested and booked into the Main Jail.

Deputies responded to numerous disturbance calls in the area of Homestead High School.
Neighbors near the school were complaining about the loud music. The faculty at Homestead HS
was cooperative and turned the volume down.
On 06/14, deputies responded to B.J.'s Restaurant on a report of a bomb. Deputies arrived, talked
with the manager, and searched the interior/exterior of the building for any suspicious packages.
Nothing was found.
Deputies investigated a residential burglary on Tiptoe. The male resident left the house in his
vehicle. His wife, who is a quadfiplegic, was by herself in the bedroom. Shortly after her husband
left, she heard someone tinging the doorbell. A short while later, she heard someone trying the
sliding glass doors at the back of the house. Finally she heard a pop and footsteps inside the house.
The suspect had forced entry into the side garage door. She called out, and the suspect fled, leaving
via the front door. On his way out, the suspect took the husband's laptop computer. No one saw the
suspect, but some prints were lifted from the interior front door knob.
Deputies responded to B.J.'s on a call of a theft. A woman reported that someone had stolen her
purse while she was in the restaurant. A short while later, the purse was recovered, but the wallet
was missing.
On 06/15, deputies responded to the Cupertino Medical Center at 20289 Stevens Creek Blvd. in
Cupertino on a report of the front doors found open, lights on inside, and no one around. When
Deputies arrived, the reporting party was gone, the front doors were now locked, and there was a
trail of blood by the front doors and inside the front doors on the carpet. Several attempts were
made to contact someone responsible for the building. No one listed for that business had a current
phone number. Central FD responded to force entry and look for anyone injured. A search was
conducted inside and outside. Once inside, a list of names and phone numbers was obtained. A
responsible person was contacted. He responded to lock up the building.
On 06/16, deputies on routine patrol came upon a trash can fire in the VTA bus shelter at Stevens
Creek Blvd. and S. Stelling Rd. Deputies detained four male juveniles that were seen walking
from the fire. Fire responded and extinguished the fire. None of the juveniles admitted starting the
fire. They were identified, photographed, and released to their parents.
Deputies responded to B.J. Brewery on N. De Anza Blvd. in Cupertino on a report of several males
involved in a fight. After units arrived and investigated the scene, they learned the males were all
friends and were just "playing around".

Law Enforcement
On 06/17, deputies assisted FBI with a search warrant on Peach Blossom.
Deputies initiated a pedestrian stop on De Anza Blvd, south of Mariani. The subject appeared very
nervous and started hyperventilating. After a brief investigation, deputies ran the subject and he
had over 100K in warrants. Deputies took him into custody. He was carrying a bag of women's
clothing and was a registered sex offender. His identity was recorded and forwarded to SAFE task
force.
On 06/18, deputies investigated an injury accident on Miller and Phil. A Honda crossed the
centerline to avoid rear-ending a car and hit a van head on. One driver was transported with
moderate injuries.
On 06/19, deputies responded to Monta Vista High School for an alarm coming from the locker
room. About 10 juveniles went swimming in the pool. Two were caught on-scene the others were
detained at the elementary school.
On 06/20, deputies were dispatched to Long's Drags on S. De Anza Blvd. at Pacifica on a report of
a female at the pharmacy counter with a fraudulent prescription. Deputies detained the suspect who
turned out to have a felony warrant for $10,000 out of Santa Cruz County. She was additionally
arrested for a fraudulent prescription, transported and booked into the Main Jail. She is also a
suspect in the same type of crime from two weeks earlier at the same store.
Deputies responded to a report of a person down in front of Tin-Tin Market on S. Blaney Ave. /
Bollinger Rd. in Cupertino. Deputies arrived and found the victim laying on the asphalt and others
performing CPR. Fire and AMR responded and pronounced death after about 22 minutes of
attempting to revive him.
On 06/21, deputies responded with Fire to The Forum. There was a report of a fire, but it turned
out to be a smoldering towel.
Deputies responded to Park Circle East at Park Circle West for a suspicious male digging through
the trash and refusing to leave. The suspect threatened a resident with a brick. The citizen placed
the suspect under arrest for brandishing a weapon. The suspect was arrested.
Deputies responded to a call of an assault that just occurred at B.J.'s. An intoxicated female subject
became violent when the bartender refused to serve her more drinks. She began picking up glasses
from the bar, and throwing them at the bartender and the shift manager. One of the glasses thrown
shattered, and a shard of glass cut one of the customers. She also slapped the shift manager.
Deputies arrested her for assault, battery, and assault with a deadly weapon. She is 18 years old.
On 06/22, deputies received a suspicious circumstances call on Steeplechase. The residents woke

up tO find someone they did not know sleeping on their couch. The suspect had an outstanding
warrant for 18K (DUI) and was taken to jail. He is from Camp Pendleton and had been at a party
across the street the night before.
Deputies investigated a prior burglary at Shaw Saddlery on De Anza. Someone burglarized the
outbuildings at the rear of the store.
On 06/23, deputies responded to a fight on Woodlark. A juvenile was hit in the face and had his
teeth/tooth knocked out and lip cut. The suspect is known and fled prior to arrival.

Law Enforcement
On June 25, deputies responded to Kingsbury Ct. for a missing person. The husband reported
his wife missing since 5pm. Deputies searched the house and went outside to check the
swimming pool. The wife's body was floating under the cover. Deputies removed the body.
Engine 2 responded and pronounced death. The victim was fully clothed and had fresh bruises
on her arms and legs and a scratch on her back. Detectives responded and began a full
investigation.
Deputies responded to Apple Comp. at 20525 Mariani for prior internal theft report. Numerous
laptops are missing.
Deputies responded to Sedgwick School, 19150 Phil Ln. for a possible missing 8 year old. It
was determined that the parents of the 8 year old had made arrangements for her to be
somewhere else today.
On June 26, deputies responded to Farm Fresh Product at 10021 S Blaney for a prior burglary.
Sometime during the night someone broke into the business and took 85 cartons of cigarettes
and 2 rolls of lottery ticket.
Deputies investigated a prior burglary on Cheryl.
Deputies responded to Benihana's, for two counterfeit twenty-dollar bills. The bills were
forwarded to the Secret Service.
Deputies investigated a call of a kidnapping in progress. The victim, an 18 year-old female,
was at a friend's home when her 25 year-old boyfriend contacted her them. The boyfriend
grabbed her, and attempted to drag her to his car. Further investigation revealed that there was
no kidnapping, but deputies placed the male subject under arrest for domestic violence charges.
He was transported and booked into the Main Jail.
On June 27, a trespassing occurred at Deep Cliff golf course. Unknown persons were driving
golf balls toward the residences on Linda Vista and Baxley. The resident at 22034 Baxley
called and reported that her residence was being struck with golf balls. Deputies responded and
could hear the golf balls striking the residence, but no one could tell the direction from which
they were coming. The golf course itself is surrounded by a fence, and gated (secured with
padlocks) making entry with patrol vehicles impossible.
A resident at the condominium complex on Pasadena reported a burglary in progress. The RIP
saw a male climb up onto a mailbox, and then up onto the second story balcony of an office
building. Deputies and a K-9 unit surrounded the building, and entered through an open door.
The entry team found a male and a female subject sleeping on makeshift beds in the day cam

area of the building. The male alleged that he knows the owner of the building, and he was
allowed to live there. He claimed he broke in because he lost his key. Deputies were able to
contact the responsible, and on arrival, he confirmed the suspect's statements. Deputies are
investigating possible municipal code violations.
On June 30, deputies responded to a disturbance at the Cathay Bank on S. De Anza Blvd. An
adult female was causing a disturbance inside the bank and refusing to leave. She straggled
when deputies attempted to take her into custody. She was eventually booked into the Main
Jail for trespassing and assault on a police officer.
Deputies stopped a vehicle on Richwood and Miller in the City of Cupertino. A search vehicle
revealed a backpack belonging to the driver with his mail inside. Inside was a sandwich bag
with 11 zip lock bags containing Marijuana inside weighing approximately 1.0 grams each. A
further search revealed two more zip lock bags inside of the suspect's left shoe. He was
arrested and booked into the Main Jail.
