Application Summary:
Review of Use Permit U-2003-03, Condition 10 (Wolf Camera), related to the

RECOMMENDATION:
1. The Planning Commission should review the previously approved construction
management plan and provide input or further directions.

BACKGROUND:
On August 21, 2007, the Planning Commission directed staff to schedule the
construction management plan for the Wolf Camera mixed-use project (U-2003-03) for
review and comments.
DISCUSSION:
Construction Management Plan
According to the original use permit approval (condition #10), a construction
management plan is required to address the following:
.:. Construction vehicle routing
.:. Construction equipment staging area
.:. Dust control
.:. Patron parking
Prior to the issuance of the building permit for the condominium building, the applicant
submitted a construction management plan (see exhibit A). The plan provides specific
measures that deal with the location of the construction trailer, materials storage,
construction parking and general construction site maintenance. In addition, the
property owner (Greg Bunker) has entered into a parking agreement with the Original
Pancake House across the street from De Anza Boulevard so the construction work and
employees from Wolf Camera could park there during construction of the site.
Since the August 21, 2007 Planning Commission meeting where we received concerns
from the neighbors, the Building Department has investigated into the site maintenance

issues and have found the construction site to be generally in good standing since all
the heavy construction work have been completed. We did receive additional
confirmation from the construction manager of the project that addition construction
management measures will be enforced to further minimize future impacts to the
adjacent neighborhood (see exhibit B). A sign will be placed right before the entrance to
the residential area that there shall not be any construction traffic beyond the point of
the project's frontage.
The Planning Department is in the process of working with the Public Works
Department to investigate into the claim by several adjacent residences that there has
been some damage caused by construction trucks to the curb and sidewalk leading into
Wildflower Court. According to Public Works Department, the applicant is required to.
repair and resurface the street and another other damages associated with the project on
the public right-of-way prior to the final occupancy release of the project. The City also
has collected a performance bond in the amount of $149,319 and a labor and material
bond in the amount of $149,319 that will ensure the improvement and repair work to
the public right-of-way will be completed to the City's satisfaction.
Staff has not received any email or correspondence from the neighbor with regard to
the construction site issues since the August 21, 2007 Planning Commission meeting.

Larry-
Thank you for reviewing the jobsite issues yesterday. With regards to the issues discussed, this is how we will
proceed.
1. Tree installation- Steve and Jason are copied on this e-mail. In the near future, we will meet with them to
discuss the procedures for city installed heritage tree. Work will not proceed in this area until we do so.
2. Site c1eanup- While the site appeared fairly clean, we will have a crew touch up the site.
3. Debris box- the debris box was put on the street temporarilly while some underground work was occuring. It
will be moved on site.
4. Street Encroachment- Apparantly our encroachment permit does not cover trailer or fencing. We will remove
them off the street.
5. Private street parking- We are unaware of any people parking on this street. All workers have been
informed. we will be ordering a sign to located near the street entrance, which will state "No Construction
Parking".
Sorry for the inconvenience and we will work more diligently so that there are no future issues. If you have any
