BACKGROUND:
The applicant, Steve Cox of HPC Architecture, representing Abundant Life Assembly of
God Church is proposing to expand an existing preschool program from 54 students to
138 students. The proposed application is referred to the Planning Commission since
the applicant is proposing to more than double the number of students and the project
site is adjacent to an existing R1 residential neighborhood.
DISCUSSION:
The existing preschool activity operates on the first floor of an existing two story class
room building. The applicant proposes to expand the school to use the second floor of
the existing class room building and an existing meeting hall (please see attached site
plan). The proposed pre-school intensification will have no impacts on the church
operation since the pre-school only operates during week days (Monday thru Friday)
from 7 AM to 6 PM, while the majority of the church activities will occur either after 6
PM and/ or during weekends.
No exterior changes are being proposed and the days and hours of operation are
unchanged. A traffic analysis was prepared by Pang Engineers Inc. on May 25, 2007
(see attached). The report concluded that the proposed expansion is expected to
slightly increase the AM and PM peak hour trips, but the net trip increase is consider
insignificant and no further traffic analysis or mitigations are required.

APPROVING REFERRAL OF A DIRECTOR'S MINOR MODIFICATION TO A USE PERMIT
(1-U-73) TO EXPAND AN EXITING PRE-SCHOOL PROGRAM FROM 54 to 158 STUDENTS
AT AN EXISTING CHURCH (ABUNDANT LIFE ASSEMBLY OF GOD)
SECTION I: FINDINGS
WHEREAS, the Planning Commission of the City of Cupertino received a referral for
Director's Minor Modification, as described in Section II of this Resolution; and
WHEREAS, the necessary public notices have been given in accordance with the Procedural
Ordinance of the City of Cupertino, and the Planning Commission has held one or more
public hearings on this matter; and
WHEREAS, the applicant has met the burden of proof required to support said application;
and has satisfied the following requirements:
1) The proposed use, at the proposed location, will not be detrimental or injurious to
property or improvements in the vicinity, and will not be detrimental to the public health,
safety, general welfare, or convenience;
2) The proposed use will be located and conducted in a manner in accord with the
Cupertino Comprehensive General Plan and the purpose of this title.
NOW, THEREFORE, BE IT RESOLVED:
That after careful consideration of maps, facts, exhibits, testimony and other evidence
submitted in this matter, the application for Director's Minor Modification is hereby approved;
and
That the subconclusions upon which the findings and conditions specified in this resolution
are based and contained in the public hearing record concerning Application No. DIR-2006-
17 as set forth in the Minutes of the Planning Commission Meeting of June 26, 2007, are
incorporated by reference as though fully set forth herein.

Government Code Section 66020(d) (1), these Conditions constitute written notice of a

reservations, and other exactions. You are hereby further notified that the 90-day
approval period in which you may protest these fees, dedications, reservations, and
other exactions, pursuant to Government Code Section 66020(a), has begun. If you fail

RESOLUTION NO. 6468
OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO
APPROVING REFERRAL OF A DIRECTOR'S MINOR MODIFICATION TO A USE PERMIT
(1-U-73) TO EXPAND AN EXITING PRE-SCHOOL PROGRAM FROM 54 to 138 STUDENTS
AT AN EXISTING CHURCH (ABUNDANT LIFE ASSEMBLY OF GOD)
SECTION I: FINDINGS
WHEREAS, the Planning Commission of the City of Cupertino received a referral for
Director's Minor Modification, as described in Section II of this Resolution; and
WHEREAS, the necessary public notices have been given in accordance with the Procedural
Ordinance of the City of Cupertino, and the Planning Commission has held one or more
public hearings on this matter; and
WHEREAS, the applicant has met the burden of proof required to support said application;
and has satisfied the following requirements:
1) The proposed use, at the proposed location, will not be detrimental or injurious to
property or improvements in the vicinity, and will not be detrimental to the public health,
safety, general welfare, or convenience;
2) The proposed use will be located and conducted in a manner in accord with the
Cupertino Comprehensive General Plan and the purpose of this title.
NOW, THEREFORE, BE IT RESOLVED:
That after careful consideration of maps, facts, exhibits, testimony and other evidence
submitted in this matter, the application for Director's Minor Modification is hereby approved;
and
That the subconclusions upon which the findings and conditions specified in this resolution
are based and contained in the public hearing record concerning Application No. DIR-2006-
17 as set forth in the Minutes of the Planning Commission Meeting of June 26, 2007, are
incorporated by reference as though fully set forth herein.

as may be amended by the conditions contained in this Resolution.
2. EXPIRATION OF APPROVAL
This approval of the modification is effective June 26,2007. The fourteen calendar day
appeal period will expire on July 10, 2007.
3. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees,
dedication requirements, reservation requirements, and other exactions. Pursuant to
Government Code Section 66020(d) (1), these Conditions constitute written notice of a
statement of the amount of such fees, and a description of the dedications,
reservations, and other exactions. You are hereby further notified that the 90-day
approval period in which you may protest these fees, dedications, reservations, and
other exactions, pursuant to Government Code Section 66020(a), has begun. If you fail
to file a protest within this 90-day period complying with all of the requirements of
Section 66020, you will be legally barred from later challenging such exactions.
