Chen Passed 5-0-0 CONSENT CALENDAR: None PUBLIC HEARING Application No.: Applicant: Location: 07-Z-01 Grosvenor California Limited 10120 Imperial Avenue & Results Way Rezoning of approx. 20 acres from Light Industrial to Planned (Light Industrial) to provide tbr a previously approved transfer of office square footage from an adjacent parcel. Tentative City Council date: November 5, 2001 Staff presentation: Ms. Ciddy Wordell, City Planner, referred to the zoning plat map, and illustrated the locations of the parcels. She reviewed the background of the application, noting the actions that transferred the industrial development from the Summerhill residential property to the Bubb Road property; a condition of approval that it had to be zoned planned development, because transferring square footage involves planned development. Ms. Wordell pointed out that the development was on hold since the Summerhill developers did not follow through on the option they had for the property. She said the use permit goes with the land and is valid tbr two years. Chair Kwok opened the meeting for public input. Ms. Ann Anger, resident, expressed concern that the parcel was now light industrial, and said that she was pleased when the parcel was going to be developed into 56 townhomes. Ms. Wordell clarified that the parcels are zoned light industry; however, the residential parcel will not be zoned light industry; the three parcels will be changed to planned light industry and the top parcel rezoned to residential. She said it was not changing the uses, only accommodating a transfer of square footage. In response to Ms. Anger's question, Com. Corr explained that the 56 townhome parcel is still zoned for residential and clarified that the 20 acre parcel was the former Measurex parcel, now the Grosvenor property. Ms. Anger said she looked forward to the groundbreaking of the townhome project. Chair Kwok closed the public haring. MOTION: SECOND: VOTE: Com. Auerbach moved to approve Application 07-Z-01 Com. Corr Passed 5-0-0 Ms. Wordell said the item would be forwarded to City Council on November 19, 2001. Application No.: Applicant: Location: 10-U-01 Diocese of San Jose (St. Josephs of Cupertino) 10110 No. DeAnza Boulevard Use permit to construct to construct an approximately 2,100 square foot conference building and covered walkway at an existing church Planning Commission decision final unless appealed Chair Kwok noted for the record that he was a member of St. Joseph's Church of Cupertino; but had no financial interest in the item. Staff presentation: Mr. Colin Jung, Senior Planner, said the use permit was for St. Josephs Church to build a small conference building on their property; square footage of 2,100. He said issues analyzed for the staff report include parking, trees, architecture, building materials and pedestrian access. He reviewed the application, noting the location of the proposed conference building, the layout of the other buildings, the landscape plan and parking area. He noted that they exceeded the required parking of 132 spaces, with 154 spaces. Mr. Jung said that a condition of approval is that the applicant hire an arborist to review the impact of the landscape improvements on the cedar trees. He also reviewed the site and architectural design as outlined iii the staff report; and said that staff was recommending a condition requiring an 8 foot wide pedestrian pathway across the asphalt, composed of colored, stamped concrete or pavers. Staff recommends approval of the project. Com. Auerbach questioned a possible raised walkway, that would elevate the pedestrian area and act as a speed bump, similar to speed reduction methods used in some neighborhoods, and to make the pedestrians more visible. Mr. Jung said he did not foresee any problems, as long as it was flat on the top; and that they had to be weary of handicapped access. He said there was no handicapped ramp on the bank side and a ramp would affect the tree. He said that they could require a handicap ramp with some later application at the CoAmerica Bank. Com. Auerbach referred to the expanded site plan, and noted that there was a lot of ingress and egress off DeAnza Boulevard. He questioned if the illustrated area would be more useful and attractive as a park area as there was plenty of area for a second row of parking to narrow the drive. He said his concern was mostly an aesthetic one and suggested that city beautification do something with the area. Mr. Jung said that he was not certain if the easements would allow lbr narrowing the driveway more than it is at present. Chair Kwok said that he was familiar with the area, and said that church activities are minimal during the week and there was no reason for through traffic through various areas iii the church property; he illustrated the parking areas for church parking. PlnnnJng Comrniegion Minutoe 4 Oemor g, 2001 Com. Corr said he concurred with Com. Auerbach, and suggested a planter strip along DeAnza Boulevard to make the area more aesthetically pleasing. Chair Kwok illustrated the area that the church wanted to put more landscaping to beautiful the area, and said it would decrease the parking spaces along the perimeter of DeAnza Boulevard by about ten parking spaces. Mr. Jack Christensen, representing the applicant, addressed the parking, and questioned if the property would have to be dedicated if they did anything beyond the property line. He questioned if the city would give the property to the church, or would the city property have to be landscaped by the applicant? Mr. Jung said that he was not qualified to speak on the issue, but that it would require Public Works' review as it appears that half the driveway is in the city right-of-way, and they were interested in doing some street widening. There was no one present from the church to address the application. Com. Patnoe questioned how much leeway there was to have the particular application tie into some of the other beautification measures that are separate from what the applicant is asking the Planning Commission to do. He said he felt they were not concerned about the structure itself; but with another part of the particular property, and questioned if the approval was being tied into having them do something else. Mr. Jung indicated he would have to review the issue; and noted the location of the buildings, tte said the application was for both properties, and both parcels were tied together, since the church did not function on its own. Ms. Wordell cited an example where the parcels were tied together at the Woodworks by Vallco, where the rear parking area was poorly improved. The rationale at the time was that they were making some major architectural changes, and it would be a long time before the building would do anything again to provide a link to be able to improve their parking. Although they were not adding square footage, the linkage was that they weren't making improvements, but changes that would last a long time, which provided the opportunity to bring things up to speed. Com. Patnoe suggested continuing the application to find out about the street parking situation, and said it would allow the options regarding the street to be reviewed at the next meeting. Mr. Jung said he felt it was important to have the property owner's representative present to discuss the issue. He said it would also provide staff'the time to investigate the easement issue. Chair Kwok said in fairness to the applicant, he felt the improvements along the perimeter of DeAnza Boulevard should be the responsibility of the Ernst and Young Development t¥om previous years, and not tied into the church expansion. He illustrated the areas tbr suggested improvement along the perimeters of the church and added landscaping to beautify the area. In response to Com. Auerbach's request, Mr. Jung explained what a landscape easmnent involved. He cited the example of a full Heart of the City improvement-type development on Stevens Creek Boulevard where everything inboard from the sidewalk toward the mid-center line of the street is in the public right-of-way, which would include the sidewalk and a ten foot landscape strip. On the other side of the sidewalk toward the development that is private land, there is a landscape easement along that portion which the developer of the project, if it is significant enough, plants with the Heart of the City landscape improvements. Planuing Commission Minutes 5 October 8, 2001 Chair Kwok said that there was some public improvement along the illustrated stretch about six months ago. Mr. Jung recalled that recently there was dedication associated with the gasoline station. He indicated that staff needed to review the issue further to ascertain if it is part of the DeAnza Boulevard zoning or part of the improvement plan focused on the Crossroads quarters. Com. Auerbach said he was in favor of continuing the application so that the issue could be clarified. Mr. Christenson referred to the earlier question about raising the sidewalk; and said he felt it was not advantageous to raise the sidewalk any higher, since traffic bad to slow down quite a bit to get in the lot. Chair Kwok closed tile public hearing. Com. Corr said he felt the project was outstanding; however, he felt there was small piece missing and that it could be more attractive. REPORT OF THE DIRECTOR OF COMMUNITY DEVELOPMENT: Ms. Wordell reported that a meeting was held regarding tile General Plan; including 27 business community members for briefing on the progress of the General Plan.
