RECOMMENDATION: Staff recommends that the Planning Commission: Approve EXC-2006-09 subject to the model resolution. BACKGROUND: Cupertino Medical Center is an urgent care center that is currently located at 20289 Stevens Creek Boulevard and has been operating at this location for the past 25 years. The applicant, Dr. Yung-Kuang Chen, has indicated that the current location is outdated and no longer fits the needs of the center (See Exhibit A). As a result, the center has found a new location and is in need of relocating to this site by the beginning of 2007 as their current lease on Stevens Creek Boulevard is about to expire. DISCUSSION: Cupertino Medical Center The applicant intends to relocate the Cupertino Medical Center to an existing one-story, 15,650 square foot industrial building located at 10040 Bubb Road on the east side of Bubb Road, one lot south of Stevens Creek Boulevard. The site is surrounded by a gas station and Stevens Creek Boulevard to the north, a one- story industrial business park to the south, one-story business parks to the west across Bubb Road and Highway 85 to the east. In addition to its urgent care facility, Cupertino Medical Center will also provide associated physical therapy services and a cosmetic skin care center. The hours of operation for the center will be 8 a.m. to 8 p.m., seven days a week. No ambulance service will be provided at this center since it will only accommodate urgent care services for ambulatory persons. The urgent care facility will occupy approximately 7,000 square feet. The physical therapy and skin care center will occupy approximately 3,000 square feet and 1,000 square feet, respectively. Additionally, approximately 1,200 square feet of space will be utilized as record fe-I File No. U-2006-09 Page 2 October 10, 2006 storage and emergency medical supply storage. The remaining 3,500 square feet is anticipated to be sub-leased to a future office tenant. The urgent care center, with its physical therapy and skin care center, is a professional office use and is permitted in the ML-rc (Light Industrial, West Valley Industrial Park) zoning district. Therefore, there are no issues related to this use occupying this site. Parking Exception Request The site was not developed for medical office use and is, therefore, not able to accommodate the parking required for a medical office use of this size per the City's parking ordinance (Chapter 19.100 of the Cupertino Municipal Code). The City's parking ordinance requires 1 parking space for each 175 square feet of floor area for a medical office and 1 parking space for each 285 square feet for general office. If this parking ratio were applied, the site would require 70 parking spaces for the urgent care center and 12 parking spaces for the office area to be subleased in the future, for a total of 82 parking spaces. There are 61 existing parking spaces on site. Therefore, the applicant is requesting a parking exception to allow the existing 61 parking spaces to satisfy the parking requirements for the site. The applicant has indicated that the urgent care center and its associated uses will not require the same amount of parking as a typical medical office that accommodates numerous patients per hour. For comparison, the existing urgent care center on Stevens Creek Boulevard operates on a parking ratio of 1 space for each 250 square feet that has been sufficient to accommodate its existing use. Parking Analysis A parking analysis (See Exhibit B) was conducted by Fehr and Peers that compared the existing parking demand at the Stevens Creek Boulevard urgent care center, which was applied to determine the future parking demand at the Bubb Road location. The study estimates that the proposed parking demand will be 30 spaces for the urgent carel skin care center, 10 parking spaces for the physical therapy services and 16 parking spaces for the office to be sub-leased. A total of 56 parking spaces would be required based upon the proposed parking demand estimates. Therefore, the study concluded that the proposed supply of the existing 61 parking spaces on site would be adequate to meet the expected parking demand of the Cupertino Medical Center and the additional office space. PARKING EXCEPTION This parking exception approval is granted to allow the existing 61 parking spaces on the subject property to satisfy the parking requirements for the site based upon occupancy of a 12,185 square foot urgent care center (including incidental physical therapy services and skin care center) and 3,465 square foot general office space within the existing 15,650 square foot building and in accordance with the parking analysis conducted by Fehr and Peers, dated September 15, 2006 (Exhibit B). 2. I am requesting transfer of parking variance form my current location to our new location. Cupertino Medical Center has been in its current location for 25 years serving the needs of the Cupertino community. Our current location is outdated and no longer fits the need of the Center. The current space requires substantial tenant improvements in order to continue to work. Also, our current landlord has been difficult to negotiate with regarding a renewal of our lease. Currently the medical center occupies 6,700 square feet of rentable space. We currently have 27 parking spaces, which is 4 per 1,000 square foot. Parking requirements at current location has been averaging 25 spaces throughout the day. This includes up to 15 spaces for staff use. Our patient flow rate is up to eight patients per hour, which comes out to approximately 25 parking. The new location has an estimated total 15,060 square feet (one tenant, Ivy Review, lease expires April 7, 2007). The medical center seeks to occupy approximately 7,000 square feet of that building. An additional 3,000 to 4,000 square feet is needed to add physical therapy and hire an additional four staff members. Physical therapy requires much less parking space due to the lower patient volume. Physical therapy would maximize at four patients per hour for the 4,000 square feet and with the four additional staff I would estimate parking requirements of approximately 10 spaces. I am also expanding the cosmetic skin care center (which is located adjacent to the medical center), which would take up to 1,000 square foot. It is anticipated that inside the medical use, we would have as much as 1500 square feet utilized as record storage and emergency medical supply storage. At the new location of 10040 Bubb Road there are 61 parking spaces at this time, which would easily accommodate the approximately 40 parking spaces, which are needed for medical use. The remaining 4,600 to 5,600 square feet of additional space would be anticipated as office use---requiring parking of 3 per 1000 square feet would be 14 to 17 parking.....a total of 57 parking for the site. '-1 Cupertino Medical Center has spent significant time and effort to find the ideal location, which would fit the needs of the Center and also the City. This particular building has the required parking spaces needed for our operation even though it does not meet the specific guidelines of the Planning Commission. However, as you can see we have been able to operate at the current location with 4 per 1000 sf for more than 25 years. In addition, Cupertino Medical Center has, and will, continue to serve the needs of the community and the city. I strongly believe that we maintain our partnership with the city and the community by staying involved. Cupertino Medical Center is involved with disaster planning. Dr. Yung Chen has been working closely with Marcia Hovey in continued disaster preparedness. In fact, Cupertino Medical Center is the only medical facility that can handle acute care in the City of Cupertino. We have volunteered our staff and facility in case of a disaster. We have also held disaster drill planning for the city and county fire departments. We received a grant directly from ,the Department of Homeland Security and we are identified as a Community Disaster Relief Center. Dr. Yung Chen has also been involved in deploying the automatic defibrillators that the City of Cupertino now has throughout the various city buildings. The City of Cupertino and Cupertino Union School District and various city and county workers also receive their medical care here when they are injured on the job. In summary, Cupertino Medical Center is requesting a parking variance from the Planning Commission to operate at the 10040 Bubb Road property. Ryan Walbert Subject: Parking Analysis for the Cupertino Medical Center in Cupertino, California SJ06-885 This memorandum presents the results of the parking analysis for the Cupertino Medical Center. The Cupertino Medical Center, a 6,700-square foot (s.f.) urgent care/skincare facility, located at 20289 Stevens Creek Boulevard is planning to move to a larger 16,000-s.f. building at 10040 Bubb Road in Cupertino. The new building would include approximately 7,000 s.f. for urgent care, 4,000 s.f. for physical therapy use, and 1,000 s.f. for cosmetic skin care center. In addition, the remaining 4,000 s.f. of the building will be leased out for general office use. The new site currently provides 61 parking spaces which does not meet the City's parking requirements. The purpose of this study is to measure the parking demand at the existing medical center and determine the appropriate parking supply for the new location. This memorandum summarizes our study approach, analysis, and findings. City of Cupertino Parking Requirements . The City of Cupertino's Municipal Code requires one parking space per 175 square feet of medical office space and one parking space per 250 square feet of general office space. Thus, 83 parking spaces are required for the proposed project at their new location. Existing Parking Demand Parking occupancy surveys were conducted at the Cupertino Medical Center to measure the existing parking demand. Surveys were conducted every 15 minutes from 8:00 AM to 5:00 PM on Wednesday, September 6, 2006. The detailed survey results are contained in Attachment A. The medical center currently shares their existing parking lot with two other medical offices and a mortgage lender. The existing site provides a total of 81 parking spaces. Thirty of those spaces are designated medical parking only. The parking survey only counted the vehicles parked for the Cupertino Medical Center. The results of the parking survey indicated that the peak parking demand occurred at 12:15 pm with 25 vehicles parked. This parking demand was divided by the existing square footage to determine the parking demand rate per 1,000 square feet. The resulting rate is 3.73 spaces per 1,000 square feet. The applicant provided hourly patient data from September 6, 2006 for the urgent care/skin care center. This data indicated a maximum of 9 patients arriving between 10:00 am and 11 :00 am. This data corresponded to our parking survey. Table 1 summarizes the existing peak parking demand for the medical center. The urgent care/skin care center was estimated to have a future peak parking demand of 30 spaces. The physical therapy use is expected to have an average of 3 to 4 patients arriving during one hour and 4 employees. Assuming some overlap of patients, the parking demand for the physical therapy use is expected to be 10 spaces. Adding the 16 required parking spaces for the remaining office space results in a total parking demand of 56 parking spaces. Table 2 summarizes the future parking demand for each use.
