OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO
RECOMMENDING THAT THE CITY COUNCIL APPROVE THE PROPOSED
MUNICIPAL CODE AMENDMENTS TO COMPLY WITH THE HOUSING
ELEMENT OF THE CITY OF CUPERTINO GENERAL PLAN
The Planning Commission recommends approval of the proposed amendments to the
City of Cupertino Municipal Code as shown in Attachment 5: Municipal Code
Amendments.
PASSED AND ADOPTED this 9th day of March 2010, at a Regular Meeting of the
Planning Commission of the City of Cupertino by the following roll call vote:

in retainin� the housing, impro�his or her health status, and mazimizino his or her

for a uru-size space Ioca�ed in a parking garage or ofher enclosed parking strucfure and
intended for nonresidential uses is eight and one-half (8.5) feef by eighteen (18}
feet. The space width shall be increased by one-half (1/2) of a foot to nine (9) feet if
adjacent on one side fo a wall or strucfure; and by one {1} foot to nine and one-half (9.5)

I. Handicapped Parkin�. The handicapped parking requiremenf embodied in

for substandard sized parking spaces in an enclosed gara�e u1 the R-1 Single-Family
Zoning District, the Community Development Director may granf an exception if fhe
request meets all of�he following criferia:
1. The exception to be granted is one that will require fhe least modification and
the mirzimum variance to accomplish the purpose.

A. In some insta.nces, the public welfare, safe�y and economy can be besf served by
the insfallation of improvemen�s on uninzproved sfreets prior fo the tirne fhat an
adjoining property owner seeks a permit. Since such adjoining properfy benefifs fiom
the sfreef improvements, fhe owners of such property are required to confribute their
share of the cost of those street improvements (jus� as permit-�ees who seek a permit
prior to the installafion of improvements are required to do) when they seek a buildinb
perrnit unless it is exempt pursuant to Sec�ion 14.04.230(D) of this chapter, a Iazuzed
de�Telo�ment�ermit, use permit, or a site and architecfural approval.
14.0�.230 D�ct�ca�ion—R�c�uire�e��s.
- A. Dedication and improvement shall be for the ru11 Iength of fhe proper�y Iu1e (of the
parcel for which the permit is sought) abutting the street for which dedicafion and
improvement is required. Dedication and improvemenf shall be made for the full
length of the property Iu1e of each lot or lots to which said building permif, planned
de�Telopment�ermit, use permit, or sife and archifectural approval applies. In case of
flag Iots whose building site is accessible only via a strip providing coruZecfion fo a
public street, the extent of streef improvemenf required sha1l consist of not less than
one-half fhe projected width of such Iofs measured along the adjacent street for which
improvements are required;
F. �Ze permittee sha1l granf easemenfs not Iess fhan ten feef uz width far public

A. As a condifion precedent fo obtaining a building permit, planned detTelG�ment
ermit, use permif, or site and architectural approval from the Cify under and pursuant
to the provisions of its ordinaszces, a permittee shall, in addifion to meeting the other
requiremenfs of this chapter:

A. As a condition precedent to obtainulg a building permi�, planned de�relo��ent

reimbursement agreement with�he City in order ta receive reimbursemenf for the
portion af sfreet improvement costs, including interest where applicable, in excess of
the insfallation cosfs incurred for fhe permiffee's property, or far the cost of the land,
upon which such improvements were installed, �ncluding in�eresf where
applicable. Any reimbursement to the permit�ee sha11 be paid out of the revenues
received by the City from fhe land reimbursement or street improvement
reimbursement charges and uzferesf, if any, assessed in the ma1-u�er provided in Section
14.04.110.
C. If the permittee cannot purchase or otherwise acquire land necessary or the
i_n.stallation of the street improvemenfs, prior fo issuance of a buildin�permit, lal--uled
develo�ment�ermit, use permit or site and archifecfural approval, the City shall
acquire the necessary Iand either by ne�otiation or pursuant to i�s eminen� domain

14.04.240 A�peals.
A. Any person aggrieved by any decision of any officer, department or

24.05.Q40 IZ�q�irer�tents—Ge�eral.
Any person who proposes fa erect or canstruct any building or strucrure for which a
building permit is required by the Ci�y, or who seeks a use permit or architectural and
si�e approval from fhe City, mus�pay a fee, as defermined under the provisions of this
chapfer, for the es�ablishmenf, mainfenance and rehabilita�ion of parks and recreation
facilities witl-tin the City. Said fee shall be a condition precedent to fhe issuance of any

14.05.070 Det�rmirtafion of F�e.
When a fee is required to be paid under the provisions of this chapter, the amount of
the fee sha1l be deferrilined by fhe Director of Public Works,pursuanf to Secfion
14.05.060. The "value per acre" portion of the fee shall be based upon the fair market
value of the subjecf properfy defermined by reference to comparable land within fhe
general subject property. As used herein, fhe term "comparable" means land of similar
size and development potential as the subjec�property. The dafe of the valuation of fhe
property shall be the date that the owner of the subjecf proper�y or his agent submits an
Iapplication for issuance af a building permif, pla.nned de�-�lopment permit, use permit
or archifectural and site appraval, whichever event occurs firsf.

alterations shall be granted until the building or residence has a sfreet address number '

"used" when acfual substantial and continuous activity has taken place upon the land
subject fo the permit or variance or, in the event of the erection ot a sfructure or
struc-tures, when sufficient building acfivity has occurred and continues to occur in a
dili�ent mazlner.

conducted in a manner detrimental �o the public health, safety, and welfare, the

A. Any signi.ficant exp.ansion in buildin�size on sife area of a lanned
